article 1 in order to prevent and reduce the occurrence of tourism emergencies, standardize the emergency management of tourism emergencies, improve the emergency handling ability of tourism emergencies, ensure the safety of tourists' lives and property, and promote the safe, orderly and sustainable development of tourism, in accordance with the provisions of the Emergency Response Law of the People's Republic of China, the Tourism Law of the People's Republic of China, the Wuhan Tourism Regulations and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the emergency of tourism within the administrative area of this Municipality, as well as the response and disposal of the emergency of tourism in other provinces, cities, Hong Kong, Macao and Taiwan, and overseas.
the tourism emergencies mentioned in these measures refer to natural disasters, accidents, public health incidents and social security incidents that occur suddenly, causing or possibly causing personal injuries and property losses to tourists and need to be dealt with by emergency measures.
The term "tour operators" as mentioned in these Measures refers to travel agencies and scenic spots within the administrative area of this Municipality, as well as operators who provide services such as transportation, accommodation, catering, shopping and entertainment for tourists within the administrative area of this Municipality. Article 3 The emergency management of tourism emergencies shall follow the principles of people-oriented, assistance first, unified leadership, comprehensive coordination, graded responsibility and territorial management. Article 4 The municipal and district people's governments (including Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, and the Municipal East Lake Eco-tourism Scenic Area Management Committee, the same below) are responsible for unified leadership, command and coordination of tourism emergencies, and establishing a leadership mechanism for emergency coordination of tourism emergencies. Article 5 The municipal and district people's governments shall, in accordance with the law, organize relevant departments to prepare special plans for the emergency system of tourism emergencies, and make overall arrangements for tourist emergency shelters, traffic organizations, meteorological information collection and processing, and safety maintenance of tourism-related areas. Article 6 The municipal and district people's governments shall take financial measures to ensure the funds needed for emergency response, establish and improve the special insurance system for tourism emergencies supported by finance, and provide financial support for the subsequent emergency response of tourism emergencies in this Municipality. Article 7 The municipal and district people's governments shall organize the establishment of a professional talent pool to deal with tourism emergencies, employ professionals in tourism safety, emergency rescue, foreign languages, insurance, psychology, etc., provide decision-making advice and technical support for the prevention of tourism emergencies in advance, the handling in the event and the aftermath, and establish a supporting system to compensate or reward the professionals involved in emergency handling.
tourism operators should establish a full-time (part-time) emergency rescue team composed of employees of their own units, be equipped with tourism safety supervisors, establish contact with professional emergency rescue forces, do a good job in emergency material storage, and regularly organize employees of their own units to carry out emergency training and drills, so that they can master the emergency handling procedures and emergency measures of their posts skillfully. Eighth city and district tourism authorities shall formulate their own emergency plans for tourism emergencies according to law, and report them to the emergency management department at the same level and the tourism authorities at the next higher level for the record after being approved by the people's government at the same level.
tourism operators should combine the main risk factors of their own units, formulate emergency plans for tourism emergencies according to the types of emergencies that are prone to occur, and make them public according to law. Article 9 Tourism operators shall, in accordance with relevant regulations, take the following daily safety management measures:
(1) Inspect tourism equipment and facilities, strengthen their maintenance and repair, eliminate hidden dangers in time, and ensure safe use;
(2) regularly detect and maintain alarm devices and emergency rescue equipment and facilities to keep them in good condition and ensure their normal use;
(3) Check the emergency rescue route to ensure the safe passage and exit are unblocked;
(4) regularly check and maintain dangerous buildings (structures) with hidden dangers;
(5) If any hidden danger is found, report it to relevant departments in time. Article 11 Departments of emergency management, tourism, public security, transportation, market supervision, housing security and housing management, natural resources and planning, water affairs, etc. shall urge relevant units to implement rectification and eliminate potential safety hazards, and take relevant measures according to law when necessary. Article 11 The municipal tourism administrative department shall establish a tourism emergency information platform based on the existing government emergency platform and professional emergency platform, realize the interconnection and information sharing among emergency platforms, and form a rapid response mechanism for information collection and submission of tourism emergencies and a mechanism for public opinion collection and analysis. Article 12 After receiving the early warning information, the competent department of tourism operators shall take some or all of the following measures in time:
(1) Organize relevant departments and institutions, professional technicians and experts and scholars to analyze and judge the received information and predict the possibility, influence scope and harmful results of tourism emergencies;
(2) When the possibility of tourism emergencies is predicted to increase, report to the people's government at the corresponding level in time and issue safety warnings to relevant tourism operators;
(3) according to the predicted risk situation, ask the tour operators to adjust their business behavior to avoid risks and reduce losses;
(4) Measures stipulated by other laws and regulations. Article 13 After receiving the early warning information, tour operators shall cooperate with the government and its relevant departments to take some or all of the following measures:
(1) Strengthen the risk warning for tourists through electronic display screens, television, radio, SMS and WeChat WeChat official account;
(2) Travel agencies quickly screen tourism teams that may be affected, adjust their business activities and strengthen risk control;
(3) Other tour operators shall take necessary safety precautions such as closing down, and timely transfer and evacuate tourists who may be affected.
