Regulations of Shenzhen Municipality on the planning and construction of parking lots and the management of motor vehicle parking

chapter I general provisions article 1 these regulations are formulated in accordance with the urban planning law of the people's Republic of China, the regulations on road traffic management of the people's Republic of China and other laws and administrative regulations in combination with the actual situation of this municipality in order to standardize the planning and construction activities of parking lots, maintain the parking order of motor vehicles and ensure the coordinated development of urban traffic. Article 2 These Regulations shall apply to the planning and construction of parking lots and the management of motor vehicle parking within the administrative area of this Municipality. Article 3 The meanings of relevant terms in these Regulations are as follows:

(1) Parking lots refer to various indoor or outdoor places for parking motor vehicles;

(2) Motor vehicle parking refers to the parking of motor vehicles in parking lots, temporary parking sections of roads and residential areas;

(3) Operating parking lots refer to parking lots that are open to the society and provide paid parking services for motor vehicles;

(4) Non-operating parking lots refer to parking lots that provide free services;

(5) Parking lot management units refer to professional parking lot management enterprises or other units that are responsible for providing motor vehicle parking services. Article 4 The construction of parking lots shall follow the principles of unified planning and whoever invests shall benefit. Article 5 The Shenzhen Municipal People's Government (hereinafter referred to as the municipal government) may formulate relevant policies for the development of motor vehicle parking services according to the growth of motor vehicles and the development of parking lots in this Municipality.

the government encourages individuals, legal persons or other economic organizations to invest in the construction and operation of parking lots. Article 6 The planning administrative department of the municipal government (hereinafter referred to as the municipal planning department) is responsible for the planning of parking lot construction in this Municipality; The construction administrative department of the municipal government (hereinafter referred to as the municipal construction department) is responsible for the management of parking lot construction.

the municipal public security traffic management department (hereinafter referred to as the municipal public security traffic management department) is responsible for the administration of motor vehicle parking and parking lots.

the administrative departments of industry and commerce, price and urban management of the municipal government shall, within the scope of their respective duties, do a good job in the management of parking lots. Chapter II Planning and Construction of Parking Lot Article 7 The municipal planning department shall, jointly with the municipal public security traffic control department and other relevant departments and units, formulate the parking lot planning according to the requirements of the overall urban planning of Shenzhen, and organize its implementation after examination and approval according to the prescribed procedures.

the municipal government should, according to the demand for motor vehicle parking, plan and build large-scale public parking lots in areas with tight parking conditions and areas where public transportation and private vehicles transfer, so as to facilitate citizens to park. Article 9 The municipal planning department shall, according to the urban development and urban planning, organize the compilation of parking space standards for buildings, and shall solicit the opinions of the municipal construction department, the municipal public security traffic control department and other relevant departments or units, and implement them after being reported to the municipal government for approval. Tenth new construction, renovation or expansion of buildings should be equipped with parking lots according to standards.

The parking lot allocated to the building should be designed, constructed and used simultaneously with the main building.

if the function of the building changes, the built parking lot shall not be used for other purposes; If the equipped parking lot can't meet the standard of equipped parking space after changing the function, it should be equipped with parking lot or increase the parking space according to the standard after changing the function. Article 11 under any of the following circumstances, special parking lots shall be built:

(1) offices, stadiums, theaters, exhibition halls, libraries, hospitals, tourist attractions, stations, docks, airports and other public buildings or places of various administrative institutions;

(2) shopping malls, hotels, warehouses, restaurants, entertainment and other business places with a construction area of more than 5,111 square meters.

if the public buildings and business premises specified in the preceding paragraph of this article are not equipped with parking lots before the implementation of these regulations, or the equipped parking lots are not up to standard, they shall be supplemented with parking lots according to the actual situation. Article 12 The design scheme of the parking lot shall solicit the opinions of the municipal public security traffic control department, and the construction department shall go through the construction procedures only after it is audited by the planning department. Without the consent of the planning department and the opinions of the municipal public security traffic control department, the construction unit and the construction unit shall not arbitrarily change the design scheme of the parking lot. Thirteenth government land to be built, the city planning department can temporarily lease the land for the establishment of temporary operating parking lots; The establishment of temporary operating parking lots shall be carried out by public bidding.

enterprises and institutions can use the land to be built and apply for temporary operating parking lots according to regulations. Chapter iii establishment of parking lots article 14 the parking lot management unit shall be a legal person or an economic organization without legal personality and meet the following conditions:

(1) it has certain property or funds;

(2) having its own organization and place;

(3) Having parking facilities and management facilities that meet the specified requirements;

(4) having professional management personnel suitable for the parking lot management business. Fifteenth to apply for operating a parking lot, it shall apply to the municipal public security traffic control department for the "Shenzhen Operating Parking Permit".

No paid parking service can be provided in a parking lot without a permit. Article 16 To apply for the Permit for Operating Parking Lot in Shenzhen, the following materials shall be provided:

(1) valid land use right certificate;

(2) Certificate of completion and acceptance of parking lot construction project;

(3) a list of parking facilities that meet the specified requirements and plans related to the parking lot;

(4) the corresponding parking lot management system, the list of professional inspectors and their qualification certificates;

(5) other materials as prescribed by laws and regulations.

the municipal public security traffic control department shall, within seven working days from the date of accepting the application, make a written decision on whether to approve or not.
