First, the object of handling the food business license
Food sales operators, catering service operators and unit canteens shall obtain food business licenses.
Food sales operators include supermarkets, convenience stores, grocery stores, food vendors, food vending machines and online food vendors.
Catering service operators, including ordinary catering (super-large, large, medium, small and micro), central kitchens and collective dining distribution units. Among them, super-large catering: the use area of processing and business premises is more than 3000㎡; Large-scale catering: the use area of processing and business premises is 500 ~ 3000m2 (including 500m2, excluding 3000m2); Medium-sized catering: the use area of processing and business premises 150 ~ 500m2 (including 150m2, excluding 500m2); Small catering: the use area of processing and business premises is 20 ~ 150m2 (including 20m2, excluding150m2); Miniature catering: the use area of processing and business premises is 6 ~ 20m2 (including 6m2, excluding 20m2).
Unit canteens include student canteens, kindergarten canteens, staff canteens, site canteens and other canteens, and there are five business forms.
For the definition of business forms, please refer to the Administrative Measures of Beijing Municipality on Food Business License (Provisional) and the Detailed Rules for the Examination of Beijing Food Business License (Provisional).
Two. Food business license business project
The business items of the Food Business License are divided into prepackaged foods sales (including frozen food, excluding frozen food), bulk food sales (including frozen food, excluding frozen food), special food sales (health food, formula food for special medical purposes, infant formula milk powder and other infant formula foods), other food sales, hot food sales, cold food sales, raw food sales and pastry food sales (including decoration).
The specific varieties of other kinds of food sales and other kinds of food production and sales shall be reported to China Food and Drug Administration for approval before implementation, and the price shall be clearly marked.
Three. Application procedure for food business license
Step 1: Fill in the Application Form for Food Business License, and submit relevant materials after consulting in the lobby or applying online;
Step 2: Submit relevant documents and materials. After the materials are complete, get the material receiving certificate or acceptance notice, and wait for the approval result of the license. Need on-site verification, cooperate with the food and drug supervision department to conduct on-site verification.
Step 3: Get a food business license.
Special attention is drawn to:
1. The Food Business License Application Form can be downloaded from the website of the US Food and Drug Administration. Due to different software versions, downloaded and printed documents should be consistent with PDF format.
2. The applicant shall apply for a food business license to the licensing authority with licensing jurisdiction.
3. To apply for a food business license, you should first obtain a business license and other legal qualification certificates.
4. The obtained food circulation license, catering service license and food hygiene license (health food sales) remain valid within the validity period. If it needs to be changed or postponed during the period, it shall be handled in accordance with relevant regulations.
4. Materials to be submitted when applying for a food business license
When applying for a new food business license, change, renewal, cancellation or replacement, the applicant shall submit the application materials according to the list of materials on the application form corresponding to the photo.
The application materials shall meet the following requirements:
(1) The application materials and certification materials submitted by the applicant shall be original. If a copy is needed, it shall be signed by the applicant or designated representative (entrusted agent) and marked as consistent with the original or directly stamped with the official seal. The submitted application materials and certificates shall be printed on A4 paper (except drawings). It is suggested to use font 4 in Chinese and font 12 in English.
(2) The name of the applicant should be exactly the same as the name of the qualification certificate of the legal subject such as the business license, the application form should meet the requirements, the content should be complete and accurate, and the items not involved should be filled in as "None".
(3) The business license and other subject qualification certificates shall be within the validity period. If it is a branch, it needs to provide the certification documents of its superior.
(4) Fill in the name of the legal representative and the person in charge after the column of "legal representative (person in charge)" in the application form, and fill in the name of the legal representative for legal persons; For individual industrial and commercial households, fill in the owner's name; If it is a branch of a legal person or other organization, fill in the name of the person in charge.
(5) All application materials submitted shall be stamped with the official seal of the company or the riding seal page by page (the applicant has no official seal to sign).
Tip: About the applicant
Where a food business operator conceals the real situation or provides false materials to apply for a food business license, the local food and drug supervision and administration department at or above the county level shall give a warning. A food business operator may not apply for a food business license again within 1 year.
If a food business operator obtains a food business license by cheating, bribery or other improper means, the food and drug supervision and administration department that originally issued the license shall revoke the license and impose a fine of 1 10,000 yuan but not more than 30,000 yuan. Food business operators shall not apply for a food business license again within 3 years.
A food business operator whose business license has been revoked, its legal representative, the directly responsible person in charge and other directly responsible personnel shall not apply for a food production and operation license, engage in food production and operation management, or serve as food safety management personnel of food production and operation enterprises within five years from the date of making the punishment decision.
