article 1 these regulations are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the regulations on the administration of city appearance and environmental sanitation in Zhejiang province and other relevant laws and regulations, with a view to strengthening the management of kitchen waste, promoting the harmless treatment and resource utilization of kitchen waste, maintaining environmental sanitation, and ensuring food safety and public health. Article 2 The term "kitchen waste" as mentioned in these Regulations refers to food residues and waste edible oils and fats produced by units (including individual industrial and commercial households) engaged in catering services, collective feeding and food production and processing.
Waste edible oils and fats refer to animal and vegetable oils and various oil-water mixtures that can no longer be eaten. Article 3 These Regulations shall apply to the delivery, collection, transportation, disposal and related management activities of kitchen waste in urban built-up areas within the administrative area of this Municipality.
the people's governments at or above the county level have designated and announced the areas where urbanization management is implemented, and the delivery, collection, transportation and disposal of kitchen waste can be carried out in accordance with the provisions of these regulations. Article 4 The people's governments of cities and counties (cities, districts) shall be responsible for the leadership, organization and coordination of the management of kitchen waste within their respective administrative areas.
the people's governments of cities and counties (cities, districts) should formulate policies conducive to the management and comprehensive utilization of kitchen waste, establish a linkage mechanism of information sharing and law enforcement, and improve the scientific level of kitchen waste management.
The Administrative Committee of Quzhou Green Industry Cluster and the Administrative Committee of the West District of the city are responsible for the management of kitchen waste within their respective jurisdictions in accordance with their prescribed duties.
township (town) people's governments and sub-district offices are responsible for the management of kitchen waste within their respective jurisdictions in accordance with the regulations of county (city, district) people's governments. Article 5 The competent administrative department of environmental sanitation shall be responsible for the supervision and management of the delivery, collection, transportation and disposal of kitchen waste.
the comprehensive administrative law enforcement department is responsible for investigating and dealing with the illegal acts in the delivery, collection, transportation and disposal of kitchen waste, unless it is specially stipulated in these regulations.
the market supervision and management department is responsible for investigating and dealing with illegal activities of producing and processing food with kitchen waste as raw materials.
relevant departments such as environmental protection, public security, development and reform, finance, planning, letter and information, health, agriculture, water conservancy, transportation, commerce, tourism, education, and government affairs should do a good job in the management of kitchen waste according to their respective responsibilities. Article 6 The catering service industry association shall strengthen industry self-discipline, standardize industry behaviors, and popularize technologies and methods to reduce the generation of kitchen waste.
the news media should carry out public welfare publicity on the laws and regulations on the management of kitchen waste and related knowledge. Article 7 The competent administrative department of environmental sanitation shall, jointly with comprehensive administrative law enforcement, market supervision and management, environmental protection and other departments, improve relevant data and information, establish a comprehensive information platform for kitchen waste management, and announce the collection, transportation and disposal of kitchen waste to the public every quarter. Article 8 The competent administrative department of environmental sanitation shall establish the daily supervision and management system of kitchen waste, be responsible for the collection, transportation, disposal license, filing and business guidance of kitchen waste, and formulate the assessment methods for the collection, transportation and disposal units of kitchen waste.
the competent administrative department of environmental sanitation shall formulate an emergency plan for the collection, transportation and disposal of kitchen waste and establish an emergency mechanism. Article 9 The competent administrative department of environmental sanitation shall, jointly with the local sub-district offices and township (town) people's governments, determine the place where the kitchen waste collection containers are put in the small catering concentrated areas. Article 11 When issuing a food business license, the market supervision and management department shall inform the kitchen waste generating unit to put the kitchen waste separately and hand it over to the collection and transportation unit for unified collection and transportation, and supervise it in daily supervision. Eleventh engaged in food waste collection, transportation and disposal activities should have the corresponding conditions. The competent administrative department of environmental sanitation shall determine the collection, transportation and disposal units of kitchen waste through bidding and franchising. No unit or individual may engage in the collection, transportation and disposal of kitchen waste without authorization.
those who, in violation of the provisions of the preceding paragraph, engage in the collection, transportation and disposal of kitchen waste without authorization shall be ordered by the comprehensive administrative law enforcement department to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than three thousand yuan but not more than ten thousand yuan shall be imposed; If the circumstances are serious, a fine of not less than ten thousand yuan but not more than thirty thousand yuan shall be imposed. Article 12 A kitchen waste generating unit shall abide by the following provisions:
(1) Reduce the amount of kitchen waste by improving processing technology;
(2) Pay the domestic garbage disposal fee according to the standard;
(3) If the kitchen waste is generated for the first time, inform the county (city, district) environmental sanitation administrative department of the type, quantity and generation time of the kitchen waste ten days in advance; Termination of kitchen waste, five days in advance to the county (city, district) environmental health administrative departments to inform;
(4) delivering the kitchen waste according to the location, time and frequency agreed with the kitchen waste collection and transportation unit;
(5) put the kitchen waste into the special collection container provided by the collection and transportation unit, and keep it intact and sealed and the surrounding environment clean and tidy;
(6) establish a ledger for recording the generation and destination of kitchen waste;
(7) Other requirements stipulated by laws and regulations. Thirteenth kitchen waste generating units prohibit the following acts:
(1) failing to store kitchen waste in an airtight way;
(2) Dumping, scattering or stacking kitchen waste at will;
(3) handing over the kitchen waste to units and individuals other than those specified in Article 11 of these regulations for collection, transportation and disposal;
(4) other prohibited acts as stipulated by laws and regulations.
in violation of the provisions of the first paragraph of this article, the kitchen waste is not stored in a sealed manner, and the comprehensive administrative law enforcement department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than fifty yuan but not more than five hundred yuan shall be imposed.
anyone who, in violation of the provisions of item 2 of paragraph 1 of this article, dumps, scatters or piles kitchen waste at will shall be ordered by the comprehensive administrative law enforcement department to make corrections within a time limit and be fined between 5,111 yuan and 51,111 yuan.
in violation of the provisions of item 3 of the first paragraph of this article, the comprehensive administrative law enforcement department shall order it to make corrections within a time limit if it is handed over to units and individuals other than those specified in Article 11 of these regulations for collection, transportation and disposal of kitchen waste; If no correction is made within the time limit, a fine of two thousand yuan or more and five thousand yuan or less shall be imposed; If the circumstances are serious, a fine of not less than 5,111 yuan but not more than 21,111 yuan shall be imposed.
