Chapter I General Provisions
Article 3 The hidden danger of production safety accidents mentioned in these Provisions (hereinafter referred to as the hidden danger of accidents) refers to the fact that production and business operation entities violate the provisions of laws, regulations, rules, standards, rules and safety production management systems, or there are dangerous things that may lead to accidents, unsafe behaviors of people and management defects in production and business operation activities due to other factors.
Accidents are divided into general accidents and major accidents. General accident hidden danger refers to the hidden danger that is less harmful and difficult to rectify, and can be rectified and eliminated immediately after being discovered. Major accident hidden danger refers to the hidden danger that is harmful and difficult to rectify, and should be completely or partially stopped, and can only be eliminated after a certain period of rectification, or the hidden danger that is difficult to eliminate by the production and business operation entity itself due to external factors.
Article 4 Production and business operation entities shall establish and improve the system of investigation and management of hidden dangers of accidents.
The main person in charge of the production and business operation entity is fully responsible for the investigation and management of hidden dangers of accidents in this unit.
Fifth safety supervision departments at all levels shall, in accordance with their duties, implement comprehensive supervision and management of the investigation and management of hidden dangers of accidents in production and business units within their respective jurisdictions; The relevant departments of the people's governments at all levels shall, within the scope of their respective duties, supervise and manage the investigation and management of hidden dangers of accidents in production and business units according to law.
Article 6 Any unit or individual shall have the right to report to the safety supervision department and relevant departments when discovering hidden dangers of accidents.
After receiving the report of accident hidden danger, the safety supervision department shall immediately organize verification and investigate and handle it according to the division of responsibilities; If it is found that the reported accident hidden danger should be handled by other relevant departments, it should be immediately transferred to the relevant departments and recorded for future reference.
Chapter II Responsibilities of Production and Business Units
Seventh production and business units shall engage in production and business activities in accordance with the requirements of laws, regulations, rules, standards and regulations. It is strictly forbidden to engage in illegal production and business activities.
Eighth production and business units are responsible for the investigation, management and prevention of hidden dangers of accidents.
Production and business units shall establish and improve the system of investigation and management, filing and monitoring of hidden dangers of accidents, and gradually establish and implement the responsibility system for investigation and management of hidden dangers from the main person in charge to each employee.
Ninth production and business units shall ensure the funds needed for the investigation and management of hidden dangers of accidents, and establish a system for the use of special funds.
Article 10 Production and business operation entities shall regularly organize safety production management personnel, engineering and technical personnel and other relevant personnel to investigate the hidden dangers of accidents in their own units. The hidden dangers of accidents identified shall be registered according to the level of hidden dangers of accidents, and the information files of hidden dangers of accidents shall be established, and monitoring and management shall be implemented according to the division of responsibilities.
Eleventh production and business units shall establish a system of reporting and rewarding hidden dangers of accidents, encourage and mobilize employees to find and eliminate hidden dangers of accidents, and encourage the public to report. The meritorious personnel who discover, eliminate and report hidden dangers of accidents shall be given material rewards and recognition.
Article 12 Where a production and business operation entity contracts out or rents out production and business operation projects, sites and equipment, it shall sign a safety production management agreement with the contracting-out or leasing unit, and specify in the agreement the management responsibilities of all parties in the investigation, treatment, prevention and control of hidden dangers of accidents. The production and business operation entities shall be responsible for the unified coordination, supervision and management of the investigation and management of hidden dangers of accidents of contracting and leasing units.
Thirteenth safety supervision departments and relevant departments of the supervision and inspection personnel to perform their duties of supervision and inspection of hidden dangers of accidents in accordance with the law, the production and business operation entities shall actively cooperate, and shall not refuse or obstruct.
Article 14 The production and business operation entities shall make statistical analysis on the investigation and management of hidden dangers of accidents in their own units on a quarterly and annual basis, and submit written statistical analysis forms to the safety supervision departments and relevant departments before the next quarter 15 and the next quarter 1 respectively. The statistical analysis form shall be signed by the main person in charge of the production and business operation entity.
For major accidents, the production and business operation entity shall report to the safety supervision department and relevant departments in a timely manner in addition to submitting them in accordance with the provisions of the preceding paragraph. The contents of the major accident hidden danger report shall include:
(a) the current situation of hidden dangers and their causes;
(two) analysis of the degree of harm and the difficulty of rectification;
(3) hidden danger management plan.
Fifteenth for general accidents, production and business units (workshops, factories, teams, etc.). ) The person in charge or relevant personnel shall immediately organize rectification.
For major accidents, the main person in charge of the production and business operation entity shall organize the formulation and implementation of the accident hidden danger control plan. Major accident hidden danger management plan shall include the following contents:
(a) the objectives and tasks of governance;
(2) Methods and measures adopted;
(three) the implementation of funds and materials;
(four) institutions and personnel responsible for governance;
(five) the time limit and requirements of governance;
(6) Safety measures and emergency plans.
Sixteenth production and business units in the process of accident hidden danger management, should take corresponding safety precautions to prevent accidents. If safety cannot be guaranteed before or during the elimination of hidden dangers of accidents, workers should be evacuated from dangerous areas, other people who may be harmed should be evacuated, warning signs should be set up, and production and business should be suspended temporarily; Maintenance should be strengthened for related production, storage devices, facilities and equipment that are difficult to stop production or use temporarily to prevent accidents.
Seventeenth production and business units should strengthen the prevention of natural disasters. The hidden dangers that may lead to accidents and disasters due to natural disasters shall be investigated and dealt with in accordance with the requirements of relevant laws, regulations, standards and these Provisions, and reliable preventive measures shall be taken to formulate emergency plans. After receiving the relevant natural disaster forecast, it shall promptly issue an early warning notice to the subordinate units; When natural disasters may endanger the safety of production and business units and personnel, safety measures such as evacuating personnel, stopping operations and strengthening monitoring should be taken and reported to the local people's government and its relevant departments in a timely manner.
Article 18 Where the local people's government, the safety supervision department and the relevant departments are listed for supervision and ordered to suspend production or business for treatment in whole or in part, after the treatment, the qualified production and business operation units shall organize their own technicians and experts to evaluate the treatment of major accident hazards; Other production and business units shall entrust a safety evaluation institution with corresponding qualifications to evaluate the management of major accidents.
If the treatment meets the conditions for safe production, the production and business operation entity shall submit a written application for resuming production to the safety supervision department and relevant departments, and the production and business operation can be resumed only after examination and approval by the safety supervision department and relevant departments. The application report shall include the governance plan, the project and the evaluation report issued by the safety evaluation agency.
