Where there are no provisions in these regulations, the provisions of relevant laws and regulations shall apply. Article 3 The term "dust pollution" as mentioned in these Regulations refers to the pollution of atmospheric environment caused by particles generated in the process of construction, building demolition, public places and road cleaning, landscaping, material stacking and transportation, solid waste landfill, recycling and ground exposure. Article 4 The Municipal People's Government shall be responsible for organizing and leading the prevention and control of dust pollution in the whole city.
County (city, district) people's government is responsible for the prevention and control of dust pollution within its jurisdiction, formulate specific implementation plans according to the overall planning of dust pollution prevention and control in this Municipality, and organize their implementation.
Township people's governments and sub-district offices shall, under the guidance of the leaders of the county (city, district) people's governments and their relevant departments, organize the prevention and control of dust pollution according to the actual situation in their respective jurisdictions. Article 5 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of dust pollution.
Development and reform, industry and information technology, public security, natural resources and planning, housing and urban and rural construction, transportation, water conservancy, commerce, urban management and other relevant departments, according to their respective responsibilities, do a good job in the supervision and management of dust pollution prevention and control. Sixth departments responsible for the supervision and management of dust pollution prevention and control should make public the way of complaints and reports, accept and handle complaints and reports according to law, and keep confidential the informants.
Encourage and support citizens, legal persons and other organizations to complain and report violations of dust pollution management regulations; If the contents of the report are verified, the accepting department shall reward the informer in accordance with the relevant provisions. Seventh departments responsible for the supervision and management of dust pollution prevention and control shall supervise and inspect the work of dust pollution prevention and control according to law.
Units or individuals under inspection shall cooperate with the inspection, truthfully report the situation and provide necessary information, and shall not refuse or obstruct the supervision and inspection of law enforcement personnel.
Departments, institutions and their staff who carry out inspections shall keep business secrets for the units or individuals under inspection. Eighth construction units should be included in the cost of dust pollution prevention and control, as an uncompetitive cost into the project cost, and in the construction contract, the responsibility of the construction unit for dust pollution prevention and control should be clearly defined.
The green construction requirements for dust pollution prevention and control should be clearly defined in the bidding documents of construction projects, and the bidding source should be controlled.
For temporarily unable to start construction land, the construction unit shall cover the bare ground; If the project has not started for more than three months, dust prevention measures such as greening, paving or covering shall be taken. Ninth construction units shall formulate the implementation plan of dust pollution prevention and control, and abide by the following provisions:
(a) set up a hard enclosure or wall on the construction site, and take dustproof measures such as sprinkling water;
(2) Covering, sealing or other dust suppression measures shall be taken for stacking materials liable to generate dust pollution, construction earthwork, construction garbage and engineering muck on the construction site; The covering material meets the requirements of environmental protection; Replace the weathered and damaged dust screen in time;
(3) Vehicle washing facilities shall be provided at the exit of the construction site, and drainage and mud sedimentation facilities shall be provided. Construction vehicles are not allowed to drive on the road with mud, and construction waste and mud are not allowed to remain on the roads around the construction site and the exit;
(four) the entrance and exit of the construction site, material stacking area, material processing area, living area and main roads are hardened, supplemented by dust suppression measures such as sprinkling, spraying and washing; If it cannot be hardened due to ecological and aquaculture reasons, other effective measures shall be taken to prevent dust pollution;
(5) The joint control mechanism of supervisors, administrators and grid workers shall be implemented in the construction site, and the implementation plan of dust pollution prevention and control and the information and responsibilities of supervisors, administrators and grid workers shall be publicized in a prominent position;
(six) the construction site above designated size shall be equipped with an online monitoring system and connected with the competent department;
(seven) to take effective dust suppression measures for construction operations that are prone to dust pollution;
(eight) other dust prevention measures should be taken. Tenth buildings (structures) are demolished, in addition to complying with the relevant provisions of Article 9 of these regulations, effective dust suppression measures such as sprinkling water and spraying should be taken during demolition; After the demolition is completed, dust-proof measures such as covering and greening shall be taken for the exposed ground. Eleventh municipal public facilities, landscaping, roads and pipelines laying construction units, in addition to complying with the relevant provisions of Article 9 of these regulations, shall also comply with the following provisions:
(a) the implementation of digging, soil loading, soil piling, road cutting, rolling and other operations, continuous sprinkling and spraying dust suppression measures on the operation surface, after the completion of the operation, clean up the site in time;
(2) When excavating and backfilling in sections, dust suppression measures such as covering or sprinkling water shall be taken for the backfilling trench; Failing to backfill and cover in time;
(three) due to the requirements of engineering technical standards, it is really necessary to dry the earthwork, and it can be dried in a certain area. After drying, or when encountering dusty weather during drying, it will collect and cover in time.
