Article IX
Application for food business license, should first obtain a business license and other legal qualifications.
Enterprise corporations, partnerships, sole proprietorships, individual businesses, etc., to the business license contained in the subject as the applicant.
Organs, institutions, social organizations, private non-enterprise units, enterprises, etc. to apply for unit canteens, organs or institutions or legal person registration certificate, social organization registration certificate or business license, etc. as the applicant.
Article 10
Application for food business license, should be in accordance with the food business subject business and business project classification.
Food business subject business is divided into food sales operators, food service operators, unit canteens. Food operators to apply for operating through the network, the establishment of a central kitchen or engaged in collective meal distribution, should be marked in parentheses after the main business.
Food business program is divided into prepackaged food sales (including refrigerated and frozen food, excluding refrigerated and frozen food), bulk food sales (including refrigerated and frozen food, excluding refrigerated and frozen food), special food sales (health food, special medical use formula, infant formula milk powder, other infant formula), other types of food sales; hot food production and sale of food, cold foods Manufacture and sale of hot food products, cold food products, raw food products, confectionery products, homemade beverages, other types of food products.

The State Food and Drug Administration can be adjusted according to the supervision and management of food business project categories.
Article 11
Application for a food business license shall meet the following conditions:
(1) have with the operation of food varieties, the number of food raw materials handling and food processing, sales, storage and other places, to maintain the environment of the place is clean and tidy, and with the poisonous, hazardous places and other sources of contamination to maintain a prescribed distance;
(2) have (B) with the operation of food varieties, the number of business equipment or facilities appropriate to the operation of the corresponding disinfection, changing clothes, washing, lighting, lighting, ventilation, antiseptic, dust, fly, rodent, insect, washing, as well as the treatment of wastewater, storage of garbage and waste equipment or facilities;
(C) a full-time or part-time food safety management personnel and to ensure that the rules and regulations of food safety;
with reasonable layout of equipment and storage facilities, and to maintain a prescribed distance from toxic, harmful places and other sources of pollution;

Other conditions prescribed by laws and regulations.
Article 12
Application for food business license shall be submitted to the local food and drug supervision and management department at or above the county level where the applicant is located to submit the following materials:
(1) application for food business license;
(2) a copy of the business license or other documents certifying the qualifications of the main body;
(3) the main equipment facilities layout, operational procedures and other documents that are compatible with the food business. Layout of equipment and facilities, operating procedures and other documents;
(d) food safety self-inspection, health management of employees, purchase and inspection records, food safety accidents and other regulations to ensure food safety.
The use of vending equipment engaged in food sales, the applicant shall also submit vending equipment, product certification, the specific placement of the location, the operator's name, residence, contact information, food business license and other publicity methods.
The applicant entrusted others to apply for food business license, the agent shall submit a power of attorney and the agent's identity documents.
