Regulations of Wuzhou Municipality on the Administration of Farmers' Markets

chapter I general provisions article 1 in order to standardize the operation order of farmers' markets, protect the legitimate rights and interests of farmers' market promoters, operators and consumers, strengthen the planning, construction, supervision and management of farmers' markets, and promote the healthy development of farmers' markets, these regulations are formulated in accordance with the urban and rural planning law of the people's Republic of China, the regulations on the administration of commodity trading markets in Guangxi Zhuang autonomous region and other relevant laws and regulations, and in combination with the actual situation of this municipality. Article 2 These Regulations shall apply to the planning, construction, operation and management, and law enforcement supervision of farmers' markets in urban built-up areas and towns built-up areas where the people's governments of counties (cities) are located within the administrative area of this Municipality. Article 3 The meanings of the following terms in these Regulations:

The term "farmers' market" as mentioned in these Regulations refers to the spot market with market name, fixed place and facilities, where operators enter the market to operate, and the farmers' market promoters engage in business service management and conduct centralized and open trading of agricultural products and agricultural and sideline products.

the farmers' market promoters mentioned in these regulations refer to natural persons, legal persons and unincorporated organizations that invest in the establishment or management of farmers' markets.

the floor operators mentioned in these regulations refer to natural persons, legal persons and unincorporated organizations that enter the farmer's market to engage in business activities.

the term "farmers in their own producing areas" as mentioned in these regulations refers to farmers who sell their own agricultural products in the designated areas of the farmers' market. Article 4 The construction and management of farmers' markets shall follow the principles of unified leadership, scientific planning, territorial management, graded responsibility and division of labor and cooperation. Fifth city and county (city, district) people's government is responsible for organizing and leading, coordinating the supervision and management of farmers' markets.

township people's governments and sub-district offices shall assist relevant departments to supervise and manage farmers' markets, guide farmers' market promoters and market operators to strengthen self-management and urge them to fulfill their legal obligations. Article 6 The market supervision and management department is the competent department of the farmer's market and is responsible for the comprehensive supervision and management of the farmer's market.

the competent agricultural and rural authorities are responsible for supervising and enforcing the conditions of animal epidemic prevention in farmers' markets.

the health department is responsible for the supervision and inspection of disease vector prevention and control in the farmer's market.

the urban management department is responsible for the supervision and management of the city appearance and environmental sanitation around the farmers' market.

Public security, natural resources, housing and urban construction, commerce, emergency management, forestry and other departments shall, according to their respective responsibilities, do a good job in the supervision and management of farmers' markets. Seventh city and county (city, district) people's governments shall formulate relevant policies, increase financial input, support and promote the construction and upgrading of farmers' markets. Chapter II Planning and Construction Article 8 The municipal, county (city) people's governments shall make a scientific layout when drawing up the land spatial planning, so as to reserve space for the construction of farmers' markets.

the municipal and county (city) market supervision and management departments shall, jointly with the departments of public security, natural resources, ecological environment, housing and urban construction, agriculture and rural areas, commerce, emergency management, urban management, etc., organize the preparation of special plans for farmers' markets, which will be incorporated into the land and space planning after being approved by the people's government at the corresponding level. Article 9 Where there is a planned land for farmers' markets in the land space planning, it shall be specified in the regulatory detailed planning.

when examining and approving the master plan of detailed planning, the competent department of urban and rural planning shall specify the building scale, land area and land location of the farmers' market. Tenth farmers' market operators and floor operators shall not change the use of farmers' market without authorization. Eleventh city and county (city, district) people's governments shall guide all kinds of investors to build and transform the farmers' market in accordance with the special planning of the farmers' market. Twelfth municipal market supervision and management departments shall, jointly with public security, natural resources, ecological environment, housing and urban construction, agriculture and rural areas, commerce, emergency management, urban management and other departments, formulate standards for the construction of farmers' markets and report them to the Municipal People's Government for approval and implementation. Thirteenth new construction, renovation and expansion of farmers' markets, farmers' markets should meet the special planning and construction standards.

after the completion of the new construction, reconstruction and expansion of the farmer's market, the market supervision and management department shall organize the departments of natural resources, housing and urban and rural construction to accept it, and it can only be delivered for use after passing the acceptance. Fourteenth farmers' market operators need to suspend the operation of the farmers' market as a whole due to market upgrading and facilities maintenance, etc., and shall publicize it to the public 31 days in advance, except for force majeure emergencies.

if a farmer's market promoter needs to terminate the operation of the farmer's market, it shall notify the market supervision and management department and the floor operators in writing three months in advance. Fifteenth city built-up area, county (city) people's government is located in the town built-up area, in principle, no temporary farmers' market shall be set up.

if it is really necessary to set up a temporary farmer's market due to the lack of outlets in the farmer's market, the urban built-up area of this city shall be applied by the urban people's government, and the municipal market supervision and management department shall organize public security, natural resources, ecological environment, housing and urban construction, agriculture and rural areas, commerce, emergency management, urban management and other departments to demonstrate and pass before it can be set up; The town built-up area where the county (city) people's government is located shall be applied by the town people's government, and the county (city) market supervision and management department shall organize public security, natural resources, ecological environment, housing and urban construction, agriculture and rural areas, commerce, emergency management, urban management and other departments to demonstrate and pass before it can be established. Article 16 If the farmers' market built before the implementation of these Regulations does not meet the standards for the construction of farmers' markets, the farmers' market promoters shall carry out transformation or reconstruction in accordance with the standards for the construction of farmers' markets, and the people's governments of cities and counties (cities, districts) shall give rewards or financial support.
