The Measures for the Administration of Kitchen Wastes in Hubei Province have been considered and adopted at the executive meeting of the provincial government on 20 19 12 16, and are hereby promulgated, and shall come into force as of March 1 2020.

In the process of putting, collecting, transporting and disposing of kitchen waste, the following acts shall not be carried out:

Mixing kitchen waste with other domestic waste;

Dumping and throwing kitchen waste at will;

Using kitchen waste as raw material to produce and process edible oil and other foods;

Directly eat kitchen garbage to feed pigs;

Other acts prohibited by laws and regulations.

Information such as inspection and punishment in the process of putting, collecting, transporting and disposing of kitchen waste shall be included in credit management in accordance with relevant regulations.

_ Contents of punishment

Without the establishment of kitchen waste generation, collection, transportation and disposal ledger, the kitchen waste management department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of 1000 yuan or more and 10000 yuan or less shall be imposed.

Mixing kitchen waste with other domestic waste, the kitchen waste management department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 3,000 yuan from 500 yuan shall be imposed; If the circumstances are serious, a fine of not less than 3,000 yuan but not more than 5,000 yuan shall be imposed.

If the kitchen waste is directly used for feeding pigs, the competent agricultural and rural departments of the people's governments at or above the county level shall order it to stop the illegal act and may impose a fine of not less than 5,000 yuan but not more than 20,000 yuan; If the circumstances are serious, a fine of not less than twenty thousand yuan but not more than fifty thousand yuan shall be imposed.

Article 1 In order to strengthen the management of kitchen waste, ensure food safety, and promote the resource utilization and harmless treatment of kitchen waste, these measures are formulated according to the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Law of the People's Republic of China on the Promotion of Circular Economy and other laws and regulations, and combined with the actual situation of this province.

Article 2 These Measures shall apply to the centralized management of kitchen waste, as well as the activities of putting, collecting, transporting and disposing of kitchen waste within the administrative region of this province.

The term "kitchen waste" as mentioned in these Measures refers to the kitchen waste and waste edible oil produced by units and individual industrial and commercial households engaged in catering services, collective feeding and other activities in the process of production and operation.

Article 3 The management of kitchen waste shall follow the principles of reduction, recycling and harmlessness, and implement classified delivery, unified collection, professional transportation and centralized disposal.

Article 4 The competent department of housing and urban construction of the provincial people's government is responsible for the supervision and management of kitchen waste in the whole province, and the working departments determined by the people's governments at the city and county levels with districts are specifically responsible for the management of kitchen waste within their respective administrative areas.

The administrative departments of development and reform, finance, agriculture and rural areas, ecological environment, market supervision and management at or above the county level shall, within the scope of their respective functions and duties, do a good job in the management of kitchen waste.

Article 5 The people's governments at or above the county level shall include the funds for centralized management of kitchen waste into the fiscal budget at the corresponding level.

Article 6 The kitchen waste belongs to domestic waste, and the garbage discharge charging system shall be implemented according to law.

Article 7 The provincial people's government shall reward the units and individuals that have made remarkable achievements in the harmless treatment and resource utilization of kitchen waste.

Article 8 A kitchen waste generating unit shall be equipped with a special collection container for kitchen waste that meets the standards, and separate kitchen waste from non-kitchen waste, and keep the collection container closed, intact and clean.

Article 9 A kitchen waste generating unit shall establish a kitchen waste generating ledger, and record the type, quantity, destination and other information of kitchen waste in detail.

Article 10 The kitchen waste generating unit shall agree on the collection and transportation time and frequency with the collection and transportation unit, and send the kitchen waste to the designated place through special collection containers, which will be collected and transported by the collection and transportation unit in a unified way.

Eleventh the use of kitchen waste disposal equipment for on-site disposal shall ensure the safe and normal operation of equipment, technology and disposal. The management department of kitchen waste shall regularly check its disposal.

Article 12 Units engaged in the collection and transportation of kitchen waste shall collect and transport kitchen waste within a specified time in accordance with the environmental sanitation operation standards, and transport the collected kitchen waste to the kitchen waste disposal site.

Thirteenth vehicles used to collect and transport kitchen waste should be fully enclosed special vehicles, to ensure airtight, intact and clean, and spray the name of the collection and transportation unit and related identification marks.

No kitchen waste shall be leaked or scattered during transportation.

Article 14 Units engaged in the collection and transportation of kitchen waste shall establish a ledger for the collection and transportation of kitchen waste, record the source, type, quantity, destination and other information of kitchen waste in detail, and report to the local kitchen waste management department regularly.

Article 15 Units engaged in the disposal of kitchen waste shall dispose of kitchen waste in strict accordance with technical standards, take effective pollution prevention measures, strengthen the monitoring of the discharged characteristic pollutants, and ensure that the discharged wastewater, waste gas and waste residue meet the environmental protection discharge standards.

Article 16 Where a unit engaged in the disposal of kitchen waste finds that the pollutant discharge exceeds the standard, it shall take timely measures to prevent or reduce the pollution, analyze the reasons and report to the competent administrative department of ecological environment.

Article 17 Units engaged in the disposal of kitchen waste shall, in accordance with the relevant provisions of the state and safety technical specifications, be equipped with managers and operators, formulate management systems and emergency plans for emergencies, and ensure the safe operation of disposal facilities.

Article 18 Units engaged in the disposal of kitchen waste shall establish a ledger for the disposal of kitchen waste, record the source, type, quantity and disposal method of kitchen waste in detail, and the quantity and destination of products produced, and report to the local kitchen waste management department on a regular basis.

Nineteenth in the process of food waste delivery, collection, transportation and disposal, the following acts shall not be implemented:

Mixing kitchen waste with other domestic waste;

Article 20 Where a unit engaged in the collection, transportation and disposal of kitchen waste needs to suspend the collection, transportation and disposal due to the maintenance and adjustment of facilities, it shall report to the local kitchen waste management department 15 in advance and submit an emergency disposal plan for collection, transportation and disposal; If the collection, transportation and disposal are suspended due to unexpected reasons, it shall immediately report to the local kitchen waste management department and take emergency measures.

Article 21 The management department of kitchen waste shall establish an information disclosure mechanism for kitchen waste management, and release the collection, transportation and disposal of kitchen waste to the society.

Twenty-second kitchen waste management departments have the right to take the following measures in the supervision and inspection of kitchen waste generation, transportation, collection and disposal activities:

Consult and copy relevant documents and materials;

Require the units and individuals being inspected to make explanations on relevant issues;

Enter the site for inspection;

Ordering relevant units and individuals to correct illegal acts.

Article 27 Anyone who, in violation of the provisions of Item (5) of Article 19 of these Measures, directly uses kitchen waste to feed pigs shall be ordered by the competent agricultural and rural department of the people's government at or above the county level to stop the illegal act and may be fined between 5,000 yuan and 20,000 yuan; If the circumstances are serious, a fine of not less than twenty thousand yuan but not more than fifty thousand yuan shall be imposed.

Twenty-eighth state organs and their staff in the management of kitchen waste abuse their powers, neglect their duties, engage in malpractices for selfish ends, shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-ninth cities divided into districts may refer to these measures and formulate measures for the management of kitchen waste within their respective administrative areas.
