Measures of Shanghai Municipality on Implementing People's Republic of China (PRC) Food Safety Law
Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Food Safety Law of People's Republic of China (PRC) (hereinafter referred to as the Food Safety Law), the Regulations for the Implementation of the Food Safety Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 Food producers and operators shall engage in production and operation in accordance with laws, regulations and food safety standards, establish and improve the food safety management system, be responsible for their production and operation and public food safety, accept social supervision and assume social responsibilities. Article 3 The municipal, district and county people's governments shall be responsible for, lead, organize and coordinate the work of food safety supervision and management within their respective administrative areas, establish and improve the overall working mechanism of food safety supervision and management, lead and guide food safety emergency disposal, improve and implement the responsibility system of food safety supervision and management, assess and evaluate food safety supervision and management departments, strengthen the capacity building of food safety supervision and management, and provide guarantee for food safety supervision and management.

The municipal, district and county people's governments shall set up food safety committees to undertake the following duties:

(a) research and deployment, overall guidance of food safety work;

(two) put forward policies and measures for food safety supervision and management;

(three) to supervise the implementation of food safety supervision and management responsibilities;

(4) Organizing the investigation and handling of major food safety accidents;

(five) to study, coordinate and decide on the regulatory responsibilities of the relevant departments;

(six) other duties granted by the municipal, district and county people's governments.

The Food Safety Committee has an office to undertake the daily work of the Committee.

Township and town people's governments and sub-district offices shall, in accordance with these measures and the provisions of the Municipal People's government, do a good job in food safety supervision and management. Article 4 The food and drug supervision and administration department shall be responsible for comprehensive coordination of food safety, food safety risk assessment, formulation of local food safety standards, release of food safety information, investigation and handling of major food safety accidents, and supervision and management of catering service activities.

The quality and technical supervision department is responsible for the supervision and management of food production activities.

The administrative department for industry and commerce is responsible for the supervision and management of food circulation activities.

Agriculture and other departments are responsible for the supervision and management of the quality and safety of edible agricultural products according to the provisions of relevant laws and regulations.

Urban management administrative law enforcement, health, commerce, entry-exit inspection and quarantine departments should do a good job in food safety supervision and management within the scope of their respective duties.

The specific responsibilities of food and drug supervision and management, quality and technical supervision, industry and commerce administration, agriculture and other departments in food safety supervision and management shall be determined by the Municipal People's Government and announced to the public. Article 5 Departments such as food and drug supervision and administration, quality and technical supervision, industry and commerce administration, agriculture, entry-exit inspection and quarantine shall strengthen communication and cooperate closely, exercise their functions and powers according to their respective duties and assume responsibilities. Article 6 Food industry associations shall strengthen industry self-discipline, guide food producers and operators to produce and operate according to law, promote the construction of industry integrity, publicize and popularize food safety knowledge, and put forward opinions and suggestions for the government to improve the food safety management system. Article 7 Social organizations and grass-roots mass autonomous organizations are encouraged to popularize food safety laws and regulations, food safety standards and knowledge, and conduct social supervision on food safety.

Radio, television, newspapers, websites and other news media should carry out public welfare publicity on food safety laws and regulations, food safety standards and knowledge, report food safety information in a timely, comprehensive and accurate manner, and conduct public opinion supervision on violations of food safety laws and regulations. Chapter II General Provisions Article 8 The municipal food and drug supervision and administration department shall, jointly with the municipal departments of quality and technical supervision, industrial and commercial administration and health, strengthen the capacity building of food safety risk monitoring and risk assessment according to the needs of the state and this Municipality, and establish and improve the food safety risk monitoring and risk assessment system. Article 9 The municipal food and drug supervision and administration department shall, according to the national food safety risk monitoring plan and the actual situation, organize the municipal departments of quality and technical supervision, industry and commerce administration, agriculture, health and entry-exit inspection and quarantine to formulate and implement the food safety risk monitoring plan of this Municipality.

Food and drug supervision and management, quality and technical supervision, industry and commerce administration, agriculture, health, entry-exit inspection and quarantine departments shall carry out food safety risk monitoring according to their respective responsibilities and program requirements.

The municipal food and drug supervision and administration department shall collect and summarize the risk monitoring data and analysis results, and notify other relevant departments. Article 10 The municipal food and drug supervision and administration department shall, according to the requirements of national food safety risk assessment, be responsible for organizing food safety risk assessment in this Municipality, and set up a municipal food safety risk assessment expert committee composed of experts in medicine, agriculture, food and nutrition to conduct food safety risk assessment.

The results of food safety risk assessment should be used as the basis for carrying out food safety supervision and management, formulating and revising local food safety standards, and issuing food safety risk warnings.
