Provisions of Hainan Special Economic Zone on Tourism Price Management (revised in 2116)

article 1 these provisions are formulated in accordance with the price law of the people's Republic of China, the tourism law of the people's Republic of China and other laws and regulations, and in combination with the actual conditions of this special economic zone, in order to regulate the behavior of tourism prices, maintain the order of tourism prices, protect the legitimate rights and interests of consumers and operators, promote the construction of Hainan as an international tourism island and promote the sustained and healthy development of tourism. Article 2 These Provisions shall apply to the tourism price behavior and its supervision and management activities in this Special Economic Zone.

The tourism price mentioned in these Provisions refers to the prices of catering, accommodation, transportation, sightseeing, shopping, entertainment and other elements in the tourism industry system of Hainan Special Economic Zone. Article 3 The price departments of the people's governments at or above the county level shall be responsible for the supervision and administration of tourism prices within their respective administrative areas. Other relevant departments of the people's governments at or above the county level shall be responsible for the supervision and administration of tourism prices within the scope of their respective duties. Article 4 The management forms of tourist prices are government-fixed, government-guided and market-regulated:

(1) Tickets for tourist attractions built with public resources, places for sightseeing and vehicles in the scenic spots and other separately charged items shall be subject to government-fixed or government-guided prices; Tickets for scenic spots that are not built with public resources, and other items that are charged separately for scenic spots, places of sightseeing and means of transportation in the scenic spots shall be subject to market-adjusted prices.

(2) The prices of special tourism projects such as large-scale performing arts, yachting, diving, rafting, adventure, water and air entertainment and sightseeing shall be subject to market adjustment.

(3) The room price of tourist hotels is subject to market adjustment. During major holidays and major events, government-guided prices can be implemented.

(4) the price of road tourist passenger transport shall be guided by the government.

the specific price forms and pricing authority of other tourism-related goods or services shall be implemented in accordance with the Price Law of the People's Republic of China and other relevant laws and regulations. Article 5 Tourism prices subject to government pricing and government-guided price management shall be included in the pricing catalogue of this province, and the competent pricing department of the provincial people's government shall formulate specific management measures, pricing mechanism, cost supervision and examination rules, and standardize pricing behaviors and procedures.

the tourism price subject to government pricing and government-guided price management shall be set reasonably according to the social average cost of tourism goods or services, market supply and demand, social affordability, quality grade, resource and environmental benefits and requirements of sustainable development, and adjusted in a timely manner according to the prescribed pricing authority and procedures. Consumers, operators, industry organizations, etc. can put forward adjustment suggestions on government pricing and government-guided prices.

when setting or raising prices, the competent price department of the provincial people's government and the people's governments of cities, counties and autonomous counties shall conduct investigations or conduct cost supervision and examination in accordance with the pricing elements specified in the preceding paragraph, hold hearings, solicit opinions from tourists, business operators and relevant parties, and demonstrate its necessity and feasibility.

the competent price department of the provincial people's government and the people's governments of cities, counties and autonomous counties shall, according to the needs of their work, timely evaluate the tourism prices subject to government pricing and government-guided price management. Article 6 Consumers, business operators, trade organizations, etc. who have objections to the tourism prices set by the price department of the provincial people's government or the people's governments of cities, counties and autonomous counties may apply to the price department of the provincial people's government or the people's governments of cities, counties and autonomous counties for re-verification. The competent price department of the provincial people's government or the people's government of a city, county or autonomous county shall give a reply within 15 working days from the date of receiving the application. Decided not to adjust, explain the reasons in writing; If it is considered that it can be adjusted, it shall be adjusted according to legal procedures. Article 7 The prices of tickets for tourist attractions, places of sightseeing and means of transportation in the scenic spots subject to government pricing and government-guided price management shall be formulated and adjusted by the price department of the provincial people's government or the people's governments of cities, counties and autonomous counties in accordance with the principle of hierarchical management.

the pricing department of the provincial people's government shall be responsible for the formulation and adjustment of the prices of tickets for tourist attractions above p>4A level (inclusive) and other items to be charged separately.

the people's governments of the cities, counties and autonomous counties where they are located shall be responsible for the formulation and adjustment of the prices of tickets for tourist attractions below p>3A level, as well as the fees charged separately for scenic spots and means of transportation. Article 8 The competent price department of the provincial people's government and the people's governments of cities, counties and autonomous counties shall formulate the prices of tickets for tourist attractions and places and means of transportation in the scenic spots that are subject to government pricing and government-guided price management, and shall distinguish different situations, implement classified pricing, maintain high quality and good price, and maintain a reasonable price comparison.

the ticket prices of tourist attractions built with public resources should be set according to the principle of being conducive to the effective utilization and reasonable protection of resources and embodying public welfare. The use of public * * * resources for the construction of tourist attractions, shall not increase prices in disguised form by adding additional fees and other means; If the investment cost of the project charged separately has been recovered, the price shall be reduced or the fee shall be cancelled accordingly.

Ticket prices for memorial halls, museums, exhibition halls and patriotic education demonstration bases shall be set according to the principle of fully embodying public welfare; If it is invested by the government, it shall be free of charge. Urban leisure parks invested by the government are open free of charge. Article 9 The competent price department of the provincial people's government and the people's governments of cities, counties and autonomous counties shall, according to the changes of seasonal passenger flow, scientifically formulate the ticket price policies for tourist attractions in light and peak seasons that are subject to government pricing and government-guided price management.

tourist attractions that implement market-regulated price management are encouraged to implement the ticket price policy in light and peak seasons according to seasonal passenger flow changes.
