Measures for the implementation of Gansu Province to stop profiteering
Article 1 These Measures are formulated in accordance with the Interim Provisions on Stopping profiteering approved by the State Council and issued by the State Planning Commission, and combined with the actual situation in our province. Article 2 These Measures shall apply to commodities and services that have a significant impact on the economic and social development of our province and are closely related to the lives of residents. Main categories and varieties: flour, japonica rice, edible vegetable oil, meat (pork, beef, mutton), vegetables, catering, eggs, milk, sugar, salt, soy sauce, vinegar, clothing, shoes, washing powder, soap, household appliances, medicines, fertilizers, agricultural films, pesticides, electricity for residential lighting, civil coal, liquefied petroleum gas, etc.

These Measures shall also apply to projects announced by countries other than those mentioned in the preceding paragraph to stop profiteering of goods and services. Article 3 Citizens, legal persons and other organizations engaged in production and operation and providing paid services within the administrative area of our province (hereinafter referred to as production operators) must abide by these measures. Article 4 Where the people's governments at or above the county level implement state price, price limit, maximum price limit and price supervision and examination for the goods and services specified in Article 2 of these Measures, it shall be implemented in accordance with the relevant government regulations on price management. Article 5 The price difference rate, profit rate or sales price level of goods and services independently priced by producers and operators as stipulated in Article 2 of these Measures shall not exceed the reasonable range of the average price difference rate, average profit rate or average market price of similar goods in the same region, the same period and the same grade.

The profit rate obtained by producers and operators through improving management, applying new technologies, reducing costs and improving efficiency should be protected. Article 6 The average price difference rate, average profit rate, average market price and reasonable range of commodities or services independently priced by producers and operators shall be determined and stipulated in accordance with the principles set by the state.

The average price difference rate, average profit rate, average market price and its reasonable range of japonica rice, edible vegetable oil and meat (pork, beef and mutton) in Lanzhou City (referring to Chengguan District, Qilihe District, Xigu District and Anning District) shall be determined and published by the provincial price management department. Other varieties, authorized by the provincial price management department of Lanzhou city price management department is responsible for organizing the measurement and regulation, and shall be published.

The average price difference rate, average profit rate, average market price and its reasonable range of goods or services in counties, districts and other cities outside Lanzhou City shall be determined and stipulated by the provincial price management department according to the needs, and the authorized local and municipal price management departments shall be responsible for organizing the determination and adjustment, and shall be published. Seventh producers and operators shall not violate these measures and make illegal profits by the following means:

(a) not in accordance with the provisions of the price tag or in addition to the price tag wild speculations;

(two) lied about reducing prices to make profits, or used false preferential prices, discount prices, processing prices, the lowest price and other false price information for price fraud;

(3) Producers, operators or trade organizations collude with each other to drive up prices;

(4) Forcing the counterparty to accept high prices in violation of the principles of fairness and voluntariness;

(five) take other means to cheat the price. Eighth any unit or individual has the right to complain and report the profiteering behavior of producers and operators.

Price supervision and inspection institutions at all levels and the administrative department for industry and commerce shall promptly investigate and verify the situation after accepting complaints or receiving reports, and deal with them in accordance with these measures. Ninth in violation of the provisions of article fifth and article seventh of these measures, the price supervision and inspection agencies and the administrative department for Industry and commerce shall be investigated and dealt with according to their respective responsibilities and different situations. Refuses to correct, given a warning and ordered to return the illegal income to the injured party; If the illegal income cannot be returned, it shall be confiscated; You can also impose a fine. If there is illegal income, a fine of less than 5 times the illegal income shall be imposed; If there is no illegal income, a fine of 1000 yuan may be imposed. If the circumstances are serious enough to constitute a crime, the judicial department shall investigate the criminal responsibility according to law. Article 10 Producers and business operators shall truthfully provide relevant price information. If the producers and operators do not provide relevant price certificates, the price management department can determine the average price level of similar goods and services in the local market. Eleventh localities, prefectures and cities may, in accordance with these measures, formulate detailed rules for the implementation of specific goods and services to stop profiteering. Twelfth approach by the provincial price management department and the provincial administrative department for Industry and commerce according to their respective responsibilities. The specific issues in the implementation shall be interpreted by the provincial price management department. Thirteenth these Measures shall come into force as of the date of promulgation.
