Article 6 Units and individuals engaged in road transport must have economic and technical conditions such as equipment, facilities, funds and professionals suitable for their business types and scope. The specific conditions shall be formulated by the provincial road transport department in accordance with the relevant provisions of the state and announced to the public.
; Article 7 All units and individuals who bid for road transport for the purpose of making profits, providing transport services to the society and charging users fees must submit an application for starting business to the local road transport management institution at or above the county level with relevant proof of economic and technical conditions. After receiving the application, the road transport management institution at or above the county level shall make a reply within 21 days, and issue a road transport business license if it meets the requirements. The applicant can start business only after going through the formalities of industrial and commercial registration with the permit.
all units and individuals who own their own vehicles and have not applied for the procedures for operating road transport shall not operate road transport.
an approved road transport operator who has not been in business for more than 3 months shall be deemed to have given up his business qualification automatically.
article 8 units and individuals that temporarily engage in road transport (not exceeding 3 months) shall go through the temporary business formalities at the road transport management institution and apply for the temporary business license at the administrative department for industry and commerce.
Article 9 The provincial road transport management institution examines and approves the following applications:
(1) It is engaged in cross-provincial road passenger transport, less-than-truckload cargo transport and transport agency;
(2) Units and individuals from other provinces, autonomous regions and municipalities directly under the Central Government engage in road passenger transport and less-than-truckload cargo transport across the province, and set up transport agencies;
(3) operating a first-class automobile maintenance enterprise and a professional maintenance service station designated by an automobile manufacturer;
(4) setting up automobile driving schools (training courses) and comprehensive performance testing stations for road transport vehicles.
Chinese-foreign joint ventures or Chinese-foreign cooperative ventures engaged in road transport across the border shall be submitted to the provincial road transport authorities for examination and approval.
in addition to the above provisions, the city (administrative office) and county (city) road transport management institutions shall conduct examination and approval according to their management authority.
article 11 vehicles engaged in road transport shall have a unified sign in the designated department of vehicles, and obtain the road transport certificate of the people's Republic of China from the road transport management institution, with one vehicle and one license, which shall be carried with the vehicle.
article 11 units and individuals engaged in road transport that want to merge, split up, move and change their business scope must be approved by the road transport management institution that originally approved the opening of business, and go through the corresponding formalities at the administrative department for industry and commerce.
units and individuals engaged in road transport who want to close down or suspend business shall go through the formalities at the original road transport management institution and the original registered administrative department for industry and commerce within 31 days and 7 days before the closure, and make an announcement.
article 12 units and individuals engaged in road transport shall, according to regulations, go to the original road transport management institution for annual inspection with their business licenses and operation permits, and only those who pass the inspection can continue to operate.
