The main person in charge of the people's governments at all levels is the first person in charge of production safety in their respective administrative areas, and bears overall leadership responsibility for production safety in their respective administrative areas; Other responsible persons have relevant leadership responsibilities for safety production within their respective responsibilities. Article 5 People's governments at all levels, neighborhood offices, development zone management agencies and other agencies of the people's governments shall establish and improve the coordination mechanism for production safety, and set up a production safety committee, with the principal responsible person as the director of the production safety committee and other responsible persons as the deputy directors of the production safety committee. Article 6 The safety production supervision and management department of the people's government at or above the county level shall implement comprehensive supervision and management of safety production and assume the responsibilities of the office of the safety production committee of the people's government at the same level.
The relevant departments of the people's governments at or above the county level shall, within the scope of their respective duties, supervise and manage the work of production safety in related industries and fields.
Departments responsible for the supervision and administration of production safety and departments responsible for the supervision and administration of production safety in related industries and fields are collectively referred to as departments responsible for the supervision and administration of production safety. Article 7 The agencies of people's governments such as township people's governments, sub-district offices, development zone management agencies, etc. shall, in accordance with their duties, strengthen the supervision and inspection of production safety of production and business units within their respective administrative areas, and assist the relevant departments of the people's governments at higher levels to perform their duties of supervision and management of production safety according to law; If hidden dangers of accidents or illegal acts are found, they should be urged to correct them and report to the relevant departments, and the departments responsible for the supervision and administration of production safety should deal with them in time. Article 8 The people's governments at or above the county level shall increase the capital investment in the infrastructure of production safety, support the research, popularization and application of advanced technologies of production safety, and encourage enterprises to carry out technological innovation of production safety. Ninth institutions engaged in technical services for production safety shall engage in technical and management services for production safety according to law, and be responsible for the service results according to law.
Departments responsible for the supervision and administration of production safety shall strengthen the supervision and administration of technical service institutions for production safety. Tenth people's governments at all levels and their relevant departments should strengthen the publicity and education of safety production laws, regulations and safety production knowledge, promote the construction of safety culture, carry out accident warning education activities, and enhance the safety awareness of the whole society.
Radio, television, newspapers, Internet and other media should carry out public welfare publicity and education on production safety, report on production safety, and supervise the work of production safety by public opinion.
The administrative department of education shall incorporate safety education into the teaching plan, and universities, primary and secondary schools shall regularly carry out safety education and emergency drills to popularize safety knowledge. Article 11 People's governments at all levels and their relevant departments, production and business units shall commend and reward the units and individuals that have made remarkable achievements in improving the conditions for safe production, promoting the construction of safety culture, preventing production safety accidents, participating in emergency rescue, researching and popularizing the science and technology for safe production, and supervising and managing safety production.
The meritorious personnel who report the hidden dangers of major accidents or report the illegal activities in production safety shall be protected and rewarded. Chapter II Safety in Production of Production and Business Units Section 1 General Provisions Article 12 Units engaged in production and business activities shall meet the following conditions for safety in production:
(a) to obtain the corresponding license according to law;
(2) Having rules and regulations and operating procedures to ensure safety in production;
(three) the establishment of production safety management institutions or equipped with production safety management personnel according to law;
(four) the main person in charge and the safety production management personnel have the knowledge and management ability of safety production that are suitable for their production and business activities;
(five) the main person in charge of mines, metal smelting, construction, road transport and the production, operation and storage of dangerous goods and the safety production management personnel shall pass the examination;
(six) special operations personnel in accordance with the relevant provisions of the state to obtain the corresponding qualifications;
(seven) employees have received education and training in production safety;
(eight) the production and business premises, equipment, facilities and production technology comply with the provisions of laws and regulations on safety in production and national standards or industry standards;
(nine) to equip employees with labor protection articles that meet the national standards or industry standards;
(ten) to carry out occupational health examination at least once a year for employees engaged in operations with occupational hazards;
(eleven) other conditions for safe production as stipulated by laws, regulations, national standards and industry standards.
