Regulations of Shanghai Municipality on the Administration of Dog Breeding

Article 1 These Regulations are formulated in accordance with the relevant laws and administrative regulations, combined with the actual situation of this Municipality, in order to standardize dog-raising behavior, safeguard citizens' health and personal safety, safeguard the legitimate rights and interests of dog owners, and safeguard the city appearance, environmental sanitation and social order.

Article 2 These Regulations shall apply to the breeding, management and related management activities of dogs within the administrative area of this Municipality.

Article 3 Dog management shall follow the principles of supervision by government departments, self-discipline of dog owners, participation of grass-roots organizations and public supervision.

Article 4 The municipal, district and county people's governments shall strengthen their leadership over the management of dog-raising. The people's governments at the municipal, district and county levels shall establish a dog-raising management coordination body with the participation of public security, veterinary medicine, urban management and law enforcement, industrial and commercial administration, housing security, housing management, health and other departments, organize, guide and supervise dog-raising management, and coordinate and solve major problems in dog-raising management.

Article 5 The municipal public security department is the competent department of dog management in this Municipality. The district and county public security departments are responsible for the dog management and related punishment within their respective jurisdictions. The dog shelter set up by the municipal public security department is responsible for the reception, claim and adoption of dogs.

The veterinary administrative department shall be responsible for the epidemic prevention of canine rabies, and guide the supervising agencies for animal health to implement relevant management and punishment.

Urban management law enforcement departments are responsible for investigating and dealing with the behaviors that affect the city appearance and environmental sanitation in the process of dog management in urbanized areas.

The administrative department for industry and commerce is responsible for the supervision and management of dog business activities.

Housing security, housing management, health, finance, price and other relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in dog management.

Township and town people's governments and sub-district offices shall cooperate with relevant administrative departments to do a good job in dog management.

Article 6 Dog owners shall keep dogs in accordance with the law and in a civilized manner, and shall not harm the legitimate rights and interests of others.

Article 7 People's governments at all levels and relevant departments shall, through various forms, carry out publicity and education on keeping dogs in accordance with the law, keeping dogs in a civilized manner, preventing rabies, and living in harmony between humans and animals.

News media such as radio, television, newspapers, websites, etc. should strengthen social morality education and dog-raising knowledge propaganda, and guide dog owners to form good dog-raising habits.

Eighth residents' committees, villagers' committees, owners' committees and property service enterprises shall assist the relevant administrative departments to carry out the publicity of raising dogs in accordance with the law and civilization, and guide and urge dog owners to abide by the code of conduct for raising dogs.

Ninth to encourage relevant industry associations, animal protection organizations and other social groups to participate in dog management activities. Dog registration

Article 10 This Municipality shall implement compulsory rabies immunization for dogs according to law. If the dog is born for three months, the dog breeder shall, in accordance with the provisions of these regulations, send the raised dog to the place designated by the veterinary administrative department to receive rabies immunization and implant electronic identification.

The veterinary administrative department shall set up rabies immunization spots in accordance with the principle of reasonable layout and convenient vaccination. Pet clinics recognized by the veterinary authorities can carry out rabies vaccination, and the confirmation letter of the veterinary authorities should be hung in a prominent position in their business premises.

Dogs receive rabies immunization at the place designated by the veterinary administrative department, and the veterinary administrative department shall issue rabies immunization certificates to the dog owners.

Eleventh the implementation of dog registration system and annual inspection system in this Municipality. If a dog has been kept for three months, it shall be registered by the dog owner.

Dogs that have not been registered for three months shall not be kept.

This Municipality shall take measures to gradually realize the dog rabies vaccination, dog registration and annual inspection in the same place.

Twelfth individuals should have full capacity for civil conduct, and have a fixed residence in this city.

Individuals who keep dogs in urbanized areas are limited to one per household.

It is forbidden for individuals to keep strong dogs.

Thirteenth units need to raise dogs because of work, shall meet the following conditions:

(a) there are dog cages, kennels and fences and other captive facilities;

(2) having full-time personnel to look after dogs;

(three) a sound dog safety management system;

(four) the location of the unit is outside the office building and residential area.

Fourteenth dog owners should go to the institutions designated by the district and county public security departments of their residences or units for dog registration and annual inspection.

If an individual raises a dog, the following materials shall be provided:

(1) Personal identification;

(2) Real estate license or house lease certificate;

(3) proof of rabies immunity in dogs.

Dog units shall provide the following materials:

(a) the organization code certificate of the unit;

(two) the identity certificate of the legal representative of the unit;

(three) the dog safety management system;

(four) the identity certificate of the special person who takes care of the dog;

(five) proof of the unit kennel;

(6) Proof of rabies immunity in dogs.

Fifteenth district and county public security departments shall conduct an audit within ten working days from the date of receiving the application materials for dog registration. Meet the conditions, to be registered, issued a "dog registration certificate" and a dog license; Do not meet the conditions, not to register and explain the reasons.

Article 16 In case of any change in the domicile or unit domicile of a dog breeder, the dog breeder shall, within 15 days from the date of change, go through the change formalities with the dog registration certificate at the designated institution of the district or county public security department of the current domicile or unit domicile.

Seventeenth in any of the following circumstances, dog owners should hold the "dog registration certificate" to the original accreditation body for cancellation procedures:

(1) If the dog is dead or missing, it shall be handled within 15 days from the date of death or missing;

(two) to give up raising dogs, it shall be handled within fifteen days from the date of sending them to others for breeding or to the dog shelter.

If the dog immunization period has passed and the dog owner fails to send the dog to the designated place of the veterinary administrative department to receive rabies immunization, the public security department shall cancel the dog registration certificate.

Eighteenth "dog registration certificate", dog license is damaged or lost, dog owners can apply to the accreditation body for a replacement.

If the dog's electronic logo is damaged or lost, the dog owner can apply for replanting at the implantation site.

Article 19 The public security department shall establish a dog management information system and an electronic file for dog management, share information on registration, immunization and supervision with the veterinary supervisor, urban management and law enforcement, industrial and commercial administration, health and other departments, and provide relevant management and service information to the public.

Dog management electronic files record the following information:

(a) the name and domicile of the dog owner or the name and domicile of the unit;

(2) Vaccine, breed, date of birth, main physical characteristics and photos of dogs;

(three) the record of administrative punishment for violating the provisions on dog management;

(four) the issuance, alteration, cancellation and withdrawal of the relevant licenses for dog registration;

(5) Other information that needs to be recorded.

Twentieth dog owners should bear the costs of rabies immunization, electronic identification, relevant documents and management services. The specific cost standard of rabies immunization and electronic identification shall be approved by the municipal price department, and the specific cost standard of relevant documents and management service fees shall be approved by the municipal price department in conjunction with the municipal finance department and announced to the public.

The collection and use of management service fees shall be announced to the public regularly. Code of conduct for raising dogs

Twenty-first dog owners should abide by the relevant laws, regulations and rules, respect social morality, abide by public order, and must not interfere with the normal life of others, damage environmental sanitation and public facilities, and must not abuse the dogs they raise.

Twenty-second dog owners carrying dogs out shall comply with the following provisions:

(1) Hanging dog tags for dogs;

(two) for the dog leash, leash length shall not exceed two meters, consciously tighten the leash in crowded places;

(3) Wear muzzle only for large dogs;

(four) take the elevator or go up and down the stairs, avoid the peak hours and take the initiative to avoid others;

(five) the strong dogs kept by the unit need to leave the breeding place only because of immunization, diagnosis and treatment, etc., and put them in the dog cage;

(six) immediately remove the feces excreted by dogs.

Article 23 Dogs are prohibited from entering office buildings, schools, hospitals, stadiums, museums, libraries, cultural and entertainment venues, waiting rooms (airplanes, ships), restaurants, shopping malls, hotels and other places, and taking public transportation such as buses, trams and rail transit.

Managers of places other than those specified in the preceding paragraph may decide whether to allow dogs to enter the places they manage. Dogs are forbidden to enter, and obvious no-entry signs are set up.

If you take a taxi with a dog, you should get the consent of the taxi driver.

Residents' committees, villagers' committees and owners' committees may, in accordance with relevant conventions or statutes, designate public areas where dogs are prohibited from entering residential areas.

Blind people carrying guide dogs are not restricted by the provisions of this article.

Twenty-fourth dog barking affects the normal life of others, the dog owner should take measures to stop it.

Twenty-fifth dog owners shall not drive or let dogs intimidate or hurt others.

If a dog hurts others, the dog owner shall immediately send the injured person to a medical institution for diagnosis and treatment, and advance the medical expenses.

Encourage dog owners to take out dog liability insurance.

Article 26 Where a dog gives birth to a puppy in an urbanized area, the dog owner shall deliver the over-limit dog to other individuals and units that meet the conditions stipulated in Articles 12 and 13 of these regulations or to a dog shelter within three months after the puppy is born.

Encourage dog owners to neuter their dogs. Dog owners who sterilize their dogs will be charged a management service fee by half with the certificate of dog sterilization.

Article 27 If a dog owner gives up raising a dog or fails to apply for dog registration because he does not meet the conditions, he shall send the dog to other individuals and units that meet the conditions stipulated in Articles 12 and 13 of these regulations for feeding or send it to a dog shelter.

Dog owners are not allowed to abandon dogs.

Article 28 If a dog owner finds that his dog is infected or suspected to be infected with rabies, he shall immediately take isolation and other control measures, and report to the competent veterinary department, the supervising agency for animal health or the prevention and control agency for animal diseases, which shall handle the matter in accordance with the relevant provisions of the state.

Twenty-ninth dogs died in the process of feeding, dog owners should be in accordance with the relevant provisions of animal epidemic prevention, the dog body will be sent to the designated harmless treatment sites.

If a dog is found dead by an animal clinic, the animal clinic shall, in accordance with the relevant provisions of animal epidemic prevention, send the dog's body to the designated harmless treatment place.

Dog owners and animal clinics are not allowed to bury or discard dog carcasses by themselves.

Thirtieth residents' committees, villagers' committees and owners' committees may, through residents' meetings, villagers' meetings and owners' meetings, formulate conventions or articles of association on dog management in their residential areas, and organize their implementation and supervise their implementation. Dog owners shall abide by the convention or statute.

Thirty-first to encourage dog-related industry associations, animal protection organizations and other social organizations to formulate industry norms, carry out publicity and education, and assist relevant management departments to carry out dog management activities.

Encourage volunteer organizations and volunteers to participate in dog management activities.

Any unit or individual has the right to criticize, dissuade, report and complain about illegal dog-raising behavior. The relevant administrative departments shall promptly handle reports and complaints from units and individuals. Acceptance, Claim and Adoption of Dogs

Thirty-second dog shelters set up in this Municipality are responsible for accommodating the following dogs:

(1) lost dog;

(2) stray dogs;

(3) Dogs sent by dog owners;

(four) because the dog owner violates the provisions of these regulations.

Thirty-third lost dogs registered according to law, the dog shelter shall notify the dog owner to claim it within three working days from the date of receiving the dog.

Dog owners shall, within five days from the date of receiving the notice, claim it at the dog shelter.

Article 34 stray dogs, dogs sent by dog owners, dogs taken in by dog owners in violation of the provisions of these regulations, or dogs unclaimed within the time limit, have passed the quarantine inspection by institutions designated by the veterinary administrative department, and individuals or units that meet the conditions stipulated in Articles 12 and 13 of these regulations can adopt them.

Dogs that have been confirmed to be adopted have not received rabies immunization, and should receive rabies immunization and implant electronic signs in accordance with the provisions of Article 10 of these regulations.

If the dog is confirmed to be brought, the dog owner shall register the dog in the dog shelter.

Thirty-fifth dogs that have not been adopted within thirty days from the date of acceptance are regarded as ownerless dogs, and shall be handled by the dog acceptance institution in accordance with the relevant provisions of the state and this Municipality.

Thirty-sixth relevant industry associations, animal protection organizations and other social organizations may raise and collect dogs with the approval of the municipal public security department, and the dogs raised and adopted shall not be used for business activities. Public security departments can provide support by purchasing services and perform their supervisory duties. Dog management

Article 37 Anyone who runs a dog breeding place and engages in dog diagnosis and treatment activities shall apply to the local agricultural department in accordance with the relevant provisions on animal epidemic prevention, and obtain the certificate of animal epidemic prevention conditions and the license for animal diagnosis and treatment respectively, and apply for registration with the administrative department for industry and commerce by virtue of the certificate of animal epidemic prevention conditions and the license for animal diagnosis and treatment.

Without permission, dog breeding, diagnosis and treatment activities shall not be carried out.

Article 38 Anyone who engages in the sales and business activities of dogs shall go through the industrial and commercial registration formalities according to law, and shall go to the district or county animal health supervision institution of his domicile for the record within five days after receiving the business license.

Before the dog is sold, it shall report to the supervising agency for animal health for inspection on the basis of the proof of animal epidemic prevention conditions, industrial and commercial registration certificate and relevant immunization certificate. Only after passing the quarantine inspection and obtaining the quarantine certificate can it be sold.

Dogs that have not been vaccinated against rabies for more than three months are prohibited from being sold.

Thirty-ninth engaged in business dog foster care, beauty and other activities, operators should take measures to prevent dogs from disturbing the people and destroying environmental sanitation.

Article 40 Where large-scale activities such as dog exhibitions, performances and competitions are held, the organizers shall go through the relevant formalities in accordance with the relevant provisions of the state and this Municipality, and file with the district and county animal health supervision institutions before the activities are held, and provide the dog quarantine certificate. Legal liability

Forty-first in violation of the provisions of Article 10 of these regulations, dogs that have not been vaccinated against rabies for three months shall be ordered by the supervising agency for animal health to make corrections and given a warning; Those who refuse to make corrections shall be handled by the supervising agency for animal health on their behalf, and the required handling expenses shall be borne by the violator, and a fine of less than 1,000 yuan may be imposed.

Forty-second in violation of the provisions of article eleventh of this Ordinance, raising dogs without registration and annual inspection, the public security department shall order them to make corrections within a time limit; If no correction is made within the time limit, the unit shall be fined between 1000 yuan and 5,000 yuan, and the individual shall be fined between 200 yuan and 1000 yuan, and the dog owners shall be urged to register and conduct annual inspection within the prescribed time limit. If the registration and annual inspection are not completed within the time limit, the dogs will be taken in.

In violation of the provisions of Article 26, paragraph 1, and Article 27, paragraph 1, of these regulations, dogs are not sent to other individuals or units for breeding or dog shelters, and the public security department shall order them to make corrections and refuse to make corrections.

In violation of the provisions of the third paragraph of Article 12 of these regulations, individuals who raise strong dogs shall be taken in by the public security department.

Forty-third in violation of the first, second and third provisions of article twenty-second, the public security department shall order it to make corrections, and may impose a fine of twenty yuan or more and two hundred yuan or less.

In violation of the provisions of the fourth paragraph of article twenty-second, the realty service enterprise shall be discouraged, and the residents' committees, villagers' committees and owners' committees may criticize and educate them.

In violation of the provisions of the fifth paragraph of article twenty-second, the public security department shall order it to make corrections, and may impose a fine of not less than five hundred yuan but not more than two thousand yuan.

In violation of the provisions of the sixth paragraph of article twenty-second, the urban management law enforcement department shall order it to make corrections; Refuses to correct, at more than twenty yuan to two hundred yuan fine.

Article 44 Whoever, in violation of the provisions of the first paragraph of Article 23 of these regulations, brings a dog into a forbidden place or public transport and refuses to listen to dissuasion, shall be ordered by the public security department to make corrections, and may be fined from 20 yuan to 200 yuan.

Forty-fifth in violation of the provisions of article twenty-fourth, barking affects the normal life of others, by the public security department warning; If no correction is made after warning, a fine ranging from 200 yuan to 500 yuan shall be imposed.

Forty-sixth in violation of the provisions of the first paragraph of article twenty-fifth, dog owners let their dogs intimidate others, the public security department shall impose a fine of more than 200 yuan and less than 500 yuan. Dog owners who bring dogs to harm others shall be detained by the public security department for more than five days and less than ten days, and shall be fined more than two hundred yuan and less than five hundred yuan; If the circumstances are minor, they shall be detained for not more than five days or fined not more than five hundred yuan; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.

In violation of the provisions of the second paragraph of Article 25 of these regulations, if the injured person is not immediately sent to a medical institution for diagnosis and treatment and medical expenses are paid in advance, the public security department shall revoke the dog-raising registration certificate, take in the dog, impose a fine of more than 1,000 yuan to 5,000 yuan on the unit, and impose a fine of more than 500 yuan to 1,000 yuan on the individual.

If a dog hurts others more than twice or hurts more than two people at a time, the public security department shall revoke the dog-raising registration certificate and take in the dog.

Article 47 Whoever, in violation of the provisions of the second paragraph of Article 27 of these regulations, abandons a dog shall be fined more than 2,000 yuan from 500 yuan by the public security department, and the dog registration certificate shall be revoked to accommodate the dog. Dog owners shall not apply for dog registration certificate within five years.

Forty-eighth in violation of the provisions of article twenty-eighth, the supervising agency for animal health shall order it to make corrections, deal with it according to law, and may impose a fine of not less than three hundred yuan but not more than three thousand yuan.

Article 49 If, in violation of the provisions of Article 29 of these regulations, the dead dogs that need to be treated harmlessly are not sent to the designated harmless treatment places for treatment, the supervising agency for animal health shall order them to be treated harmlessly; Refused to carry out harmless treatment, by the animal health supervision institutions to deal with, and may impose a fine of more than 3000 yuan in 300 yuan.

The littering of dog carcasses shall be ordered by the urban management law enforcement department to make corrections, and individuals shall be fined from 20 yuan to 200 yuan, and units shall be fined from 5,000 yuan to 50,000 yuan.

Fiftieth in violation of the provisions of the provisions of article thirty-seventh, without obtaining the certificate of animal epidemic prevention conditions without opening a dog breeding place, the supervising agency for animal health shall order it to make corrections and impose a fine of not less than one thousand yuan but not more than ten thousand yuan; If the circumstances are serious, a fine of 1 10,000 yuan or more and10,000 yuan or less shall be imposed.

Those who engage in dog diagnosis and treatment activities without obtaining the animal diagnosis and treatment license shall be ordered by the supervising agency for animal health to stop the diagnosis and treatment activities and confiscate the illegal income; If the illegal income is more than 30 thousand yuan, a fine of more than one time and less than three times the illegal income shall be imposed; Illegal income 1 10,000 yuan but not more than 30,000 yuan shall be fined 1 10,000 yuan and not more than 30,000 yuan; If there is no illegal income or the illegal income is less than 1 10,000 yuan, a fine of more than 3,000 yuan 1 10,000 yuan will be imposed.

Article 51 Whoever, in violation of the provisions of the second paragraph of Article 38 of these regulations, sells dogs without quarantine certificates shall be ordered by the supervising agency for animal health to make corrections, and a fine of 500 yuan shall be imposed for each dog sold without quarantine certificates.

Fifty-second in violation of the provisions of article thirty-ninth, dog nuisance, shall be ordered by the public security department to make corrections; Refuses to correct, and impose a fine of more than 200 yuan and less than 500 yuan.

In violation of the provisions of article thirty-ninth, dumping garbage, sewage, feces and other wastes, destroying environmental sanitation, the urban management law enforcement department shall order it to make corrections and impose a fine of not less than 5,000 yuan but not more than 50,000 yuan.

Article 53 Anyone who violates the provisions of the first paragraph of Article 38 and Article 40 of these regulations and fails to go through the filing formalities in accordance with the provisions shall be fined between 1,000 yuan and 3,000 yuan by the supervising agency for animal health, and between 500 yuan and 1,000 yuan for individuals.

Article 54 In violation of the provisions of Article 40 of these regulations, if dogs participating in exhibitions, performances and competitions are not accompanied by quarantine certificates, the supervising agency for animal health shall order them to make corrections and impose a fine of not less than 1,000 yuan but not more than 3,000 yuan.

Article 55 If raising a dog affects the lives of others and causes damage to others, the infringed may apply to a mediation organization for mediation or bring a lawsuit to a people's court according to law.

Article 56 If the administrative department in charge of dog management and its staff abuse their powers, neglect their duties, engage in malpractices for selfish ends or fail to perform their duties in accordance with the provisions of these Regulations, they shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. supplementary terms

Article 57 Dog owners mentioned in these Regulations refer to individuals or units that raise dogs.

The term "urbanized areas" as mentioned in these Regulations refers to the central cities, new towns and new towns as defined in the Regulations of Shanghai Municipality on Urban and Rural Planning.

Fifty-eighth the list of strong dogs shall be determined by the municipal public security department in conjunction with the municipal veterinary administrative department and relevant industry associations, and shall be announced to the public.

Fifty-ninth military dogs, police dogs and special dogs in zoos, scientific research institutions and other units shall be managed in accordance with the relevant provisions of the state.

Before the implementation of these regulations, dogs that have been registered according to law shall continue to be valid.

Article 61 These Regulations shall come into force as of May 1 1.
