City real estate management department is responsible for the safety management of housing use in this area in accordance with the division of responsibilities.
Construction, planning, land and resources, education, health, sports, culture, transportation, commerce, tourism, production safety supervision and other departments are responsible for the safety management of housing use within their respective responsibilities. Article 6 The municipal and urban people's governments shall include the funds for housing use safety management in the financial budget to ensure the needs of housing use safety management. Seventh real estate management departments should strengthen the supervision and inspection of housing safety, improve the housing safety management system and disaster emergency rescue plan.
Education, health, sports, culture, transportation, commerce, tourism and other departments should organize personnel to regularly check the safety of buildings in schools, kindergartens, hospitals, stadiums, cultural and entertainment places, stations, shopping malls, hotels, restaurants and other public places.
Urban real estate management departments and neighborhood offices, and township (town) people's governments shall organize personnel to conduct emergency safety inspections on houses affected by natural disasters such as earthquakes, floods, landslides, ground subsidence or explosions. Eighth real estate management departments should establish housing safety management files. Housing safety management files shall include the following contents:
(a) the basic situation of the house;
(two) housing construction information and completion acceptance information;
(3) Records of house repair, maintenance and reinforcement;
(four) the records of the house use safety inspection, safety appraisal and termite control.
The real estate management department shall gradually establish a housing use safety management information system, and incorporate the housing use safety into information management.
If the real estate management department needs to extract and copy relevant information for the establishment of housing safety management files, the relevant units and individuals shall cooperate. Ninth housing property units, property services companies should carry out inspection and maintenance of houses and their attachments, do a good job in housing safety inspection records and keep them for a long time. Tenth any unit or individual has the right to complain and report violations of the safety of housing use. After receiving complaints and reports, the real estate management department of the city where the house is located shall promptly investigate and deal with them. Chapter II Structural Safety of Houses Article 11 Owners and users of houses shall correctly use houses according to their designed structures and uses, ensure the structural safety of houses, and shall not affect the use safety of adjacent houses. Twelfth housing owners are the first responsible person for the safety of housing use. During the use of the house, no one shall engage in the following acts without authorization:
(a) demolition or partial demolition of building foundations, walls, columns, beams, floors and other components with load-bearing functions;
(two) add doors and windows on the load-bearing wall or expand the original size of doors and windows on the load-bearing wall;
(three) digging holes in the wall of the cantilever balcony or the load-bearing wall of the cantilever stairs;
(4) adding doors and windows on the non-load-bearing external wall;
(five) change the purpose of housing planning and design;
(six) more than the design standards or norms to increase the load of floors, roofs and balconies;
(7) Changing rooms or balconies without waterproof function into bathrooms and kitchens;
(eight) digging the underground foundation of the house, building underground facilities or reducing the indoor ground elevation of the house;
(nine) the demolition of housing * * * part;
(ten) installation of facilities and equipment that affect the safety of building structures;
(eleven) the demolition of schools, kindergartens, hospitals, stadiums, cultural and entertainment venues, stations, shopping malls, hotels, restaurants and other public places with overall earthquake-resistant and fire-proof functions;
(twelve) other acts that endanger the safety of housing use as stipulated by laws, regulations and rules.
If the owner or user of the house really needs to carry out the acts listed in the preceding paragraph, he shall obtain the design documents issued by the original design unit of the house or the design unit with corresponding qualification grade; If there is no design document, it shall provide the feasibility plan issued by the legally established housing safety appraisal institution, and go through the relevant formalities in the planning, construction and other departments. Within thirty days after the completion of the project, the design documents issued by the design unit, the feasibility plan issued by the housing safety appraisal institution, the completion acceptance data and other materials shall be reported to the urban real estate management department where the house is located for the record.
