Legal analysis: the occurrence of food poisoning or suspected food poisoning accidents should be promptly reported to the local people's government health administrative department of the occurrence of food poisoning accidents, address, time, the number of people poisoned, suspected food and other relevant content. If the number of food poisoning accident poisoning more than 30 people, the local people's government at or above the county level health administrative department when the people's government at the same level and the higher people's government health administrative department within six hours; poisoning more than 100 people or death of more than one person, should be reported to the ministry of health within six hours, and at the same time report to the people's government at the same level and the higher people's government health administrative department.

Article 5 The unit in which the food poisoning or suspected food poisoning accident occurs and the unit that receives the food poisoning or suspected food poisoning patients for treatment shall promptly report to the administrative department of health of the local people's government the unit in which the food poisoning accident occurs, the address, the time, the number of people who have been poisoned, and the suspected food and other relevant contents.

Article 7: The health administrative department of the local people's government at or above the county level shall implement an emergency reporting system for the following food poisoning or suspected food poisoning accidents within its jurisdiction: (1) if the number of poisoned persons exceeds 30, it shall be reported to the people's government of the same level and the health administrative department of the people's government of the higher level within six hours; (2) if the number of poisoned persons exceeds 100 or if more than one person is killed, the report shall be made to the Ministry of Health within six hours. (b) if the number of poisoning exceeds 100 or more than one death, it should be reported to the Ministry of Health within 6 hours, and at the same time report to the people's government at the same level and the administrative department of health of the people's government at the higher level; (c) if the poisoning accident occurs in a school, a regional or a nationally important activity, it should be reported to the Ministry of Health within 6 hours, and at the same time report to the people's government at the same level and the administrative department of health of the people's government at the higher level; (d) other food poisoning accidents that need to be implemented in the emergency reporting system. Any unit or individual shall not interfere with the reporting of food poisoning or suspected food poisoning.
