Enterprise legal person, partnership enterprise, sole proprietorship enterprise, individual industrial and commercial households, etc., take the subject specified in the business license as the applicant.
Article 11 An application for a food production license shall be made according to the following food categories: processed food, edible oil, grease and its products, condiments, meat products, dairy products, beverages, convenience foods, biscuits, canned food, frozen drinks, frozen foods, potatoes and puffed foods, candy products, tea and related products, alcohol, vegetable products, fruit products, roasted seeds and nuts, egg products, cocoa and roasted coffee. Starch and starch products, cakes, bean products, bee products, health foods, formula foods for special medical purposes, infant formula foods, special dietary foods, other foods, etc.
China food and drug administration can adjust food categories according to the needs of supervision and management.
Article 12 To apply for a food production license, the following conditions shall be met:
(1) Having places suitable for the processing of food raw materials and the processing, packaging and storage of food, keeping the environment of the places clean and tidy, and keeping a prescribed distance from toxic and harmful places and other pollution sources.
(2) Having production equipment or facilities suitable for the variety and quantity of food produced, and having corresponding equipment or facilities for disinfection, changing clothes, washing, lighting, lighting, ventilation, anticorrosion, dust prevention, fly prevention, rodent prevention, insect prevention, washing, wastewater treatment and garbage and waste storage; If the production process of health food has pretreatment procedures such as raw material extraction and purification, it is necessary to have raw material pretreatment equipment or facilities suitable for the variety and quantity of production.
(3) Having full-time or part-time food safety management personnel and rules and regulations to ensure food safety.
(4) It has a reasonable equipment layout and technological process, so as to prevent cross-contamination between foods to be processed and directly imported foods, raw materials and finished products, and to prevent foods from contacting toxic and unclean substances.
(5) Other conditions stipulated by laws and regulations.
Article 13 To apply for a food production license, the following materials shall be submitted to the local food and drug supervision and administration department at or above the county level where the applicant is located:
(1) An application for food production license;
(2) A copy of the business license;
(3) the plan of the food production and processing place and its surrounding environment, the layout plan of each functional area, the layout plan of process equipment and the process flow chart of food production;
(4) List of major equipment and facilities for food production;
(five) rules and regulations to ensure food safety, such as incoming inspection records, production process control, ex-factory inspection records, food safety self-inspection, health management of employees, recall of unsafe food, and handling of food safety accidents.
Where the applicant entrusts others to apply for food production license, the agent shall submit the power of attorney and the identity certificate of the agent.
