1, illegally detained for more than 24 hours;

1, illegally detaining others for more than 3 times, or illegally detaining more than 3 people at a time;

3, illegal detention of others, and the implementation of binding, beating, insulting and other acts;

4, illegal detention, resulting in disability, death, mental disorders;

5. In any of the above circumstances, illegally detain others or detain others for the purpose of demanding debts;

6. The judicial personnel illegally detained an innocent person.

The act of illegally restricting the personal freedom of others refers to the act of restricting the personal freedom of others by various methods and means in violation of the law. If the circumstances are minor, it does not belong to criminal punishment. Personal freedom refers to the right of citizens to act independently according to law without being bound by others, illegally arrested or detained by state organs or police stations, illegally deprived of freedom, restricted freedom and illegally searched the body.

According to Chinese laws, anyone who illegally detains others or illegally deprives others of their personal freedom by other means shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights. Those who are beaten or insulted shall be given a heavier punishment. Whoever commits the crime mentioned in the preceding paragraph and causes serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death shall be sentenced to fixed-term imprisonment of not less than ten years. Whoever uses violence to cause disability or death shall be convicted and punished in accordance with relevant laws and regulations. Whoever illegally detains or detains another person in order to obtain debts shall be punished in accordance with the provisions of relevant laws and regulations. State functionaries who violate relevant laws and regulations by taking advantage of their functions and powers shall be given heavier punishment in accordance with the provisions of relevant laws and regulations.

Whoever commits one of the following acts shall be detained for more than 10 and less than 15, and fined for more than 500 yuan 1000 yuan; If the circumstances are relatively minor, they shall be detained for more than 5 days 10 days, and be fined between 2,000 yuan and 5,000 yuan:

(1) Organizing, coercing or tricking/kloc-people under the age of 0/6 or disabled people into performing horrible and cruel performances;

(2) forcing others to work by violence, threat or other means;

(3) Illegally restricting the personal freedom of others, illegally invading other people's houses or illegally searching other people's bodies.

The provisions of article 232 shall be convicted and punished. Whoever illegally detains another person or detains another person in order to claim debts shall be punished in accordance with the provisions of the preceding two paragraphs. Any functionary of a state organ who commits the crimes mentioned in the preceding three paragraphs by taking advantage of his power shall be given a heavier punishment in accordance with the provisions of the preceding three paragraphs.

Article 238 Whoever illegally detains others or illegally deprives others of their personal freedom by other means shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights. Whoever uses violence to cause disability or death shall be punished in accordance with Article 234 of this Law and the Law of People's Republic of China (PRC) on Public Security Administration Punishment.

Article 40 Whoever commits one of the following acts shall be detained for more than 10 and less than 15, and fined for more than 500 yuan 1000 yuan; If the circumstances are relatively minor, they shall be detained for more than 5 days 10 days, and be fined between 2,000 yuan and 5,000 yuan:
