According to the Land Management Law and the Opinions of the Ministry of Land and Resources on Strengthening the Management of Rural Homestead, the requirements and procedures for handling the rural homestead use certificate are as follows:

I. Application conditions

1 The Land Law of People's Republic of China (PRC) stipulates that "rural villagers can only own one homestead, and the area of the homestead shall not exceed the standards set by provinces, autonomous regions and municipalities directly under the Central Government". "If a rural villager sells or rents a house and then applies for a homestead, it will not be approved". The Opinions of the Ministry of Land and Resources of the State Council on Strengthening the Management of Rural Homestead stipulates that the legal provisions of "one household, one house" should be resolutely implemented. A rural villager can only own one homestead, and the area shall not exceed the standards set by provinces (autonomous regions and municipalities).

2. If the application conditions are not met, the homestead shall not be approved. Rural villagers who sell, lease or give their original houses to others before applying for homestead shall not be approved. Rural residential land can only be allocated to villagers in the village, and urban residents are not allowed to buy homesteads, peasant houses or "small property houses" in rural areas.

Second, the specific process

1. If rural villagers need to use the homestead to build houses, they must first apply to the collective economic organization, which will be approved by the villagers' meeting and posted in the collective economic organization or villagers' group.

2. If there is no objection at the expiration of the publicity period, after the review by the village committee, the local land and resources center will conduct on-the-spot investigation, sign the investigation opinions and audit opinions, report to the township (field) people's government for examination and approval, and report to the county and city land and resources bureau for examination and approval. After the homestead is approved according to law, the rural collective economic organizations or villagers' groups shall timely post the approval results.

3. If the approved homestead is not built for two years, the original approval document will be invalid.
