Only houses that have all five certificates and have passed the comprehensive completion inspection of the community can apply for a real estate certificate. New houses usually get the real estate certificate in three months, and after the transfer of second-hand houses, they get the real estate certificate in about one month.
According to the provisions of the "Regulations on the Administration of Sales of Commercial Houses", real estate development enterprises shall, within 90 days from the date of delivery of commercial houses for use, submit the information required to register the ownership of the houses to the real estate administrative department where the houses are located.
The real estate development enterprise shall assist the buyer of commercial housing to handle the land use right change and house ownership registration procedures. Due to the developer's reasons, the house buyer fails to obtain the real estate certificate within the time limit stipulated in the contract; or the pre-purchaser of the off-plan house has 90 days from the date of delivery of the house.
If the buyer of a completed commercial house fails to obtain a real estate certificate within 90 days from the date of signing the contract, the developer shall bear liability for breach of contract.
