Article 2 The standardized vegetable market as mentioned in these Measures refers to a fixed place established and managed in accordance with the spirit of the municipal government's reply (Shanghai Vegetable Market Layout Planning Outline [2006] No.62) and the local standard of this Municipality, Specification for the Establishment and Management of Vegetable Markets (DB3 1/T344-2005), which specializes in staple food and other agricultural products and food retail business.
Article 3 The municipal administrative department of commerce shall, jointly with the municipal planning department, be responsible for the overall planning of the standardized vegetable market in the whole city, and be responsible for the coordination, guidance and management of the standardized vegetable market planning. The district (county) administrative department of commerce shall, jointly with the district (county) planning department, be responsible for the planning and layout of the standardized vegetable market in this region.
City industry and commerce, food and drug supervision, finance, taxation, quality and technical supervision, public security, fire protection, environmental protection, landscaping, prices, construction, transportation and other departments shall, according to their respective responsibilities, supervise and manage the standardized vegetable market according to law.
The district (county) government shall coordinate and manage the implementation, transformation and standardized operation of the standardized vegetable market in the region, and the district (county) commerce department shall be responsible for organizing the implementation of the plan.
The township (town) government and sub-district offices shall, in accordance with the principle of territorial management, manage the standardized vegetable market and the surrounding environment and order within their respective jurisdictions.
The main person in charge of the district (county) government is the first responsible person for the construction and management of standardized vegetable market. From 20 1 1, the newly-built standardized vegetable market will be built by the district (county) government.
Article 4 The district (county) government shall take the standardized vegetable market construction as a public welfare project, bring it into the category of community business management, and conduct regular research every year.
In the planning of new residential quarters, the standardized vegetable market should be defined as community public welfare supporting construction, and the district (county) government should specify the property owner, construction area and acquisition cost of the standardized vegetable market in the land transfer agreement. The state-owned company in the district (county) where the property right is entrusted is responsible for management and operation, and is included in the state-owned assets assessment system. The competent commercial departments of all districts (counties) should participate in the planning and construction of vegetable markets in newly-built residential areas.
If the property right of the vegetable market belongs to the state-owned assets system, the rate of return should be appropriately lowered when evaluating the state-owned assets.
If the property right of the vegetable market belongs to other owners, the district (county) government shall strengthen the supervision and inspection of its revenue and expenditure management.
When the market supply and demand fluctuate, if it is necessary to take control measures to stabilize the market according to regulations, appropriate subsidies should be given. The scope, objects and methods of subsidies shall be implemented in accordance with the provisions.
The district (county) government shall arrange certain funds for the construction and transformation of standardized vegetable market, the construction, operation and maintenance of traceability system, etc. Every year, it subsidizes the rent of local direct supply booths for the production and sales of green leafy vegetables. The municipal finance should also arrange certain funds to support the construction of standardized vegetable markets in districts (counties).
Fifth standardized vegetable market in principle according to the residential area of 500 meters (including 800 meters) service radius.
Each standardized vegetable market shall provide directly sold green leafy vegetables to suburban agricultural cooperatives and self-produced and self-sold business households at a ratio of not less than the number of vegetable stalls 10%.
Article 6 (1) Operators of standardized vegetable markets shall perform the following duties:
1. Hang the business license, tax registration certificate and various business licenses in a prominent position in the place, and announce the market management system, the addresses and telephone numbers of administrative supervision departments and complaint institutions.
2. Ensure that floor operators have the corresponding business qualifications.
3. Strengthen the management of food safety and business order in the venue, and do a good job in environmental sanitation in the responsible area in accordance with the Provisions of Shanghai Municipality on the Establishment of Environmental Sanitation Facilities.
4. Uniformly set up qualified measuring instruments and reinspection measuring instruments on site, manage them uniformly, proofread them regularly, and uniformly distribute the reinspection quantitative data.
5. Actively establish a food safety circulation information traceability and supervision system. Ensure traceability and supervise the normal operation of the system.
6. Timely and accurately report market monitoring data according to regulations.
7. For the main and non-staple foods traded on the floor, ask the operator for the supplier's qualification certificate, vegetable origin certificate, pesticide residue detection certificate, purchase bill (single) and other certificates in accordance with the regulations.
(two) standardized vegetable market stall operators shall perform the following duties:
1. Designate booths to operate within the venue, not across doors, and not to engage in street stall trading.
2. Keep promises, operate legally and compete fairly.
3. Hang the business license, personnel health certificate and bulletin board indicating the name, price, measurement unit and other contents in a prominent position of the booth.
4. When consumers ask for sales vouchers, they shall provide sales vouchers according to law; Where a traceability system is established, traceable sales vouchers shall be provided in accordance with regulations, and shall be subject to inspection by government regulatory authorities.
5. Strive to improve service quality and provide convenient services for consumers.
6. It is strictly forbidden to sell fake and shoddy goods, and it is strictly forbidden to hoard, dominate the market, drive up prices, and be short of weight.
7. Without the consent of the vegetable market manager, it is not allowed to sublet the booth.
Seventh to encourage large-scale, professional market management service institutions to carry out intensive management of all kinds of standardized vegetable markets, and further improve the overall management level of standardized vegetable markets.
Give play to the role of self-discipline, service and coordination of trade associations.
Eighth standardized vegetable market construction and management work into the annual assessment of governments at all levels.
The district (county) government shall regularly commend and reward the units and individuals that have made remarkable achievements in the planning, construction and management of standardized vegetable markets.
