(Ministry of Health Decree No. 73)
Article 1 In order to strengthen the management of new varieties of food additives, these measures are formulated in accordance with the relevant provisions of the Food Safety Law and the Regulations for the Implementation of the Food Safety Law.
Article 2 New varieties of food additives refers to:
(a) not included in the national food safety standards for food additives
(b) not included in the Ministry of Health announcement of the permitted use of varieties of food additives
(c) expanding the scope of use or dosage of varieties of food additives.
Article 3 of the food additives should be technically necessary and proven safe and reliable through risk assessment.
Article 4 The use of food additives shall comply with the following requirements:
(1) should not mask food spoilage
(2) should not mask the food itself or the quality of the processing defects
(3) not to adulteration, adulteration, forgery for the purpose of food additives
(4) should not reduce the nutritional value of the food itself
(4) should not reduce the food itself. Nutritional value of the food itself
(v) The amount used in the food should be as low as possible in order to achieve the desired effect
(vi) Processing aids for the food industry should be removed before the final product is made, except for those where there are provisions for permissible residual amounts.
Article 5 The Ministry of Health is responsible for the examination and licensing of new varieties of food additives, and organizes the development of new varieties of food additives for technical evaluation and review of specifications.
Article 6 The unit or individual applying for the production, operation, use or import of new varieties of food additives (hereinafter referred to as the applicant) shall submit an application for authorization of new varieties of food additives and submit the following materials:
(1) the common name of the additives, the classification of their functions, the dosage and the scope of use
(2) information or documents proving that it is technologically necessary and that the use of the effect of the Information or documents
(C) the quality specifications of food additives, production processes and test methods, food in the additive test methods or related information
(D) safety assessment materials, including production of raw materials or sources, chemical structure and physical properties, production processes, toxicological safety evaluation information or test reports, quality specifications test report
(E) labels, instructions and food additives product samples
(F) other countries (regions), international organizations allow the production and use of information that contributes to the safety assessment.
Applications for food additive varieties to expand the scope of use or dosage can be exempted from the submission of the materials in the fourth paragraph of the preceding subparagraph, but the technical evaluation requires additional provision of the exception.
Article VII Application for the first import of new varieties of food additives, in addition to the submission of the materials provided for in Article 6, the following materials shall also be submitted:
(a) the exporting country (region) of the relevant departments or agencies to allow the production or sale of the additives in the country (region) of the supporting materials
(b) the country where the producer is located (region) of the relevant agencies or organizations Producers issued by the review or certification of the materials.
Article VIII The applicant shall truthfully submit the relevant materials, reflect the true situation, and is responsible for the authenticity of the content of the application materials, bear the legal consequences.
Article IX The applicant shall indicate in the materials submitted by the applicant in the first paragraph of Article 6 of the first item, the second item, the third item of the material does not involve commercial secrets, can be disclosed to the community.
New varieties of food additives technically necessary and the use of the effect and other circumstances, should be open to the public for comments, while seeking quality supervision, industry and commerce administration, food and drug supervision and management, industry and information technology, commerce and other relevant departments and relevant industry organizations.
There are significant differences of opinion, or involving significant interests, a hearing can be held to hear the views.

Article 10 The Ministry of Health shall, within 60 days after acceptance of the organization's medical, agricultural, food, nutrition, technology and other aspects of the experts on the new varieties of food additives technically necessary and safety assessment of the information to carry out a technical review, and to make a technical assessment of the conclusions. Technical review of the need to supplement the relevant information, the applicant should be notified in a timely manner, the applicant should be in accordance with the requirements of timely supplementation of relevant materials.
When necessary, can organize experts on the development of new varieties of food additives and production site verification, evaluation.
The need to verify the relevant information and test results of the test, the test items, test batches, test methods and other requirements should be informed of the applicant. Safety verification test should be certified in the inspection agency to obtain qualifications. No national standards for food safety testing methods, should be the first test method for verification.
Article XI of the administrative licensing of new varieties of food additives in accordance with the "Administrative Licensing Law" and "Health Administrative Licensing Measures" and other relevant provisions.
Article XII According to the conclusion of the technical review, the Ministry of Health decided to grant licenses to new varieties of food additives that are technically necessary and meet the requirements of food safety, and include them in the list of food additives permitted to be used and published.
Those that lack technical necessity and do not meet the food safety requirements shall not be licensed and the reasons shall be stated in writing.
The discovery of non-food chemical substances that may be added to food or other substances hazardous to human health, in accordance with Article 49 of the Regulations for the Implementation of the Food Safety Law.
Article 13 The Ministry of Health, based on the technical necessity and the results of food safety risk assessment, will announce the varieties of permitted food additives, the scope of use, the dosage in accordance with the procedures of the national standards for food safety, the development and publication of the national standards for food safety.
Article 14 of the following circumstances, the Ministry of Health shall promptly organize a reassessment of food additives:
(a) the results of scientific research or evidence indicating that the safety of food additives may be problematic
(b) no longer technically necessary.
The Ministry of Health may announce the revocation of approved food additive varieties or the revision of their scope of use and dosage if it is re-examined that they do not meet the food safety requirements.
Article 15 These Measures shall come into force on the date of publication. Since April 2011, according to the unified deployment of the State Council, all regions and departments concerned have been carrying out special work to crack down on illegal food additives and abuse of food additives, and have achieved phased results.
As of July, agriculture, industry and commerce, quality inspection, food and drug supervision and other departments at all levels have continuously stepped up law enforcement and inspection efforts, with a cumulative total of more than 3.54 million law enforcement personnel **** inspecting more than 5.92 million households (times) of food and food additives production and operation units, catering service units, etc., and banning and shutting down more than 4,900 serious illegal production and operation units. Public security authorities have destroyed a number of "black spots" for illegal food production, storage and processing, and have cracked more than 1,200 criminal cases involving illegal food additives, arresting more than 2,000 criminal suspects. The trial authorities have conducted public hearings and rulings on some key cases.
Regions and relevant departments have successively introduced relevant new measures and approaches to continuously improve the long-term mechanism of food safety supervision. The Ministry of Health has formulated the General Principles for Compounding Food Additives (GB26687-2011), revised the Standard for the Use of Food Additives (GB2760-2011), and published six batches of 64 non-food substances that may be illegally added to the "black list ". Beijing Municipality has set up food and drug case investigation squadrons in nine public security bureaus under its jurisdiction, which are specifically responsible for combating food and drug safety crimes; Shanghai, Zhejiang, Yunnan and other places have included food safety work in the performance appraisal of leading cadres, which further strengthens the leadership responsibility of the government; Ningxia has realized the registration and filing of all food additives production and use enterprises in the whole region, so as to make the supervision work further down to earth; Shaanxi, Sichuan and other places to vigorously implement the mass reward reporting system, and actively encourage social supervision; Jilin in the province to hire 10,000 food safety volunteer supervisors, all-round supervision of the sale and use of food and food additives and other behaviors; Xiamen City, to carry out the work of food safety supervision and corrective work, and vigorously promote the implementation of the duties of the government regulatory departments.
According to the deployment of the regions, the relevant departments will continue to carry out in-depth crackdown on illegal food additives and the abuse of food additives, and resolutely punish criminals, to protect the people's dietary safety.
Achievement
Specialized rectification work has been solidly promoted. To date, public security organs nationwide*** have cracked more than 1,200 cases of illegal food additives and arrested more than 2,000 suspects, achieving significant results. Among them, in the "Lean Meat Extract" battle, 120 cases were detected in various places***, more than 980 people involved were arrested, and a large number of finished products of "Lean Meat Extract" were seized; all the 5 plasticizer cases investigated in Guangdong were detected, and 16 suspects were arrested***; Shenyang public security organs organized a fight against illegal food additives, and more than 2,000 suspects were arrested, with significant achievements. In Guangdong, all five plasticizer cases were solved, and 16 suspects were arrested; in Shenyang, the public security authorities organized the elimination of a number of black dens of "problem bean sprouts", seized more than 40 tons of "problem bean sprouts", and criminally detained 12 illegal processors. The relevant local people's courts have publicly tried and sentenced a number of cases of crimes against food safety, and a number of criminals have been brought to justice.
Monitoring and sampling efforts are increasing. The Ministry of Agriculture has carried out routine monitoring and census on the quality and safety of agricultural products, and implemented six monitoring programs on pesticide residues, veterinary drug residues, feed and feed additives, "lean meat extract", aquatic products and raw milk, which have basically covered the major production areas, sales areas and large varieties of agricultural products. The Ministry of Health has improved the 2011 National Food Safety Risk Monitoring Program and strengthened the monitoring of illegal additives and food additives that are easy to abuse. The industry and commerce departments have strengthened the combination of sample testing and rapid testing, utilizing existing rapid testing facilities and equipment to increase the testing of illegal additives such as industrial coloring agents, "lean meat extract" and melamine, and have taken 31,711 samples of food and food additives for testing. Quality inspection departments to further increase the risk of food production monitoring, improve the frequency of sampling, to expand the scope of sampling. So far, *** risk monitoring of 42,456 food samples such as dairy products; *** sampling of 93,993 samples from 53,804 food production enterprises, sampling of 8,078 batches of samples from 2,332 food additives production enterprises. The Food and Drug Administration has listed homemade hotpot base, homemade beverages and homemade seasonings as compulsory varieties for national food safety supervision and sampling in food service, and further increased sampling efforts. The construction of the standard system has been accelerated. The Ministry of Health published the newly revised "Standards for the Use of Food Additives", covering 2314 kinds of common food additives, food processing aids and food spices***, stipulating the use of the limit, scope and principles; newly formulated and published the "General Rules for Compounding Food Additives" to fill the gaps in the standards for compounded food additives; published 102 new product standards for food additives; and in conjunction with the Food and Drug In conjunction with the Food and Drug Administration (FDA), the Ministry of Agriculture (MOA) is studying and formulating regulations on the use of food additives in the food service sector, and has further strengthened management measures. The Ministry of Agriculture is currently soliciting opinions on the 1,828 maximum residue limits for 195 pesticides in agricultural products and food, and is also speeding up the process of cleaning up the standards for agricultural and veterinary drug residue detection methods. The Ministry of Agriculture is now drafting the "supervision and management regulations on pork and pork products", which will further improve the regulatory system of "lean meat".
China's supervisory power has been continuously strengthened. The Ministry of Agriculture has strengthened the construction of township agricultural product quality and safety supervision and public ****service organizations, and specifically issued opinions to further clarify the construction goals, tasks and requirements, and to comprehensively enhance the grassroots supervisory capacity. General Administration for Industry and Commerce to strengthen the grass-roots food safety supervision team building, strengthen education and training to improve grass-roots law enforcement level. The General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) has put forward the work requirements of "one transformation and five enhancements", focusing on strengthening grass-roots supervisory capacity building and improving the effectiveness of food safety supervision. The public security authorities have strengthened their professional crackdown forces, and public security authorities in Beijing, Chongqing, Liaoning and Hunan have set up teams to investigate food safety cases. Various regions have also explored many good ways to strengthen rural food safety supervision, such as Gansu Province in the implementation of the province's "a special three members", (i.e., township food safety supervision specialists and village food safety coordinators, information officers, liaison officers) system, Liaoyuan City, Jilin Province, in the townships, villages, Tuen Mun three levels of the establishment of social supervisory teams to further improve the rural food safety supervision network, and effectively strengthen the rural food safety supervision network, and effectively strengthen the food safety investigation team.
