Market supervision, urban management, urban and rural planning, urban and rural construction, housing security and other relevant departments shall perform their respective duties within the scope of supervision and management responsibility for the prevention and control of oily smoke pollution in the catering industry. Article 5 Any unit or individual has the right to complain and report to the competent ecological environment department for violation of these regulations. After receiving the complaints and reports, the competent ecological environment department shall promptly handle the complaints and reports, and inform the complainant or informer of the results. Article 6 The catering operators are the main body responsible for the prevention and control of oily smoke pollution in the catering industry, and shall prevent and reduce oily smoke pollution in accordance with relevant laws and regulations, and accept the supervision and management of the relevant departments. Article VII catering business projects should be in accordance with the technical specifications for environmental protection of the catering industry site selection.
It is prohibited to build, reconstruct or expand new catering business projects that produce oil smoke in residential buildings, commercial and residential complexes that are not equipped with a special flue, and commercial and residential complexes that are adjacent to the commercial floors of the residential floors.
Construction units of new construction, alteration and expansion of oil smoke-generating catering projects outside the prohibited scope of the preceding paragraph shall make an online record of the environmental impact registration form of the construction project, and shall be responsible for the truthfulness, accuracy and completeness of the content of the record.
The catering business projects that have been established within the prohibited scope before the implementation of these regulations shall be rectified within a specified period. Specific measures shall be formulated by the municipal people's government. Large-scale catering business projects greater than 90%;
(c) scientific and reasonable installation of exhaust fans, blowers and other noise-generating equipment, sound insulation and noise reduction measures, regular maintenance. Noise generated by the operation of equipment should comply with national and local emission standards. Catering operators should be normal use of oil smoke purification facilities, or entrusted to a professional organization to clean and maintain the oil smoke purification facilities. Smoke emissions should be in line with national and local emission standards, without any smoke purification facilities shall not be discharged.
Catering fumes shall not be discharged through the urban public **** storm water or sewage pipes and other facilities. Article 11 No unit or individual shall barbecue food in the open air in areas prohibited by the local people's government, or provide sites for barbecuing food in the open air. Article XII departments with supervisory and management responsibilities shall produce catering fumes pollution of illegal information in the national enterprise credit information publicity system, credit China (Heilongjiang) and other platforms. Article XIII violation of the provisions of Article 7, paragraph 2 of these regulations, in residential buildings, not supporting the establishment of a special flue of commercial and residential complexes, commercial and residential complexes and residential floors adjacent to the commercial floors of the new construction, alteration, expansion of the production of oily fumes of the catering industry business projects, by the competent departments of the ecological environment and ordered to make corrections; refusal to make corrections, shall be closed down and impose a fine of 50,000 yuan or more than 100,000 yuan or less.
Violation of the provisions of Article 7, paragraph 3 of these regulations, catering project construction unit has not been filed in accordance with the law of the environmental impact of the construction project registration form, the competent department of ecological environment shall order the filing of a fine of more than one thousand yuan 50,000 yuan. Article 14 violation of the provisions of Article 10, paragraph 1 (a), (b) and paragraph 2 of these regulations, not in accordance with the provisions of the installation of oil smoke purification facilities, not normal use of oil smoke purification facilities or without any oil smoke purification facilities to purify the oil smoke emissions, exceeding the emission standards for the emission of oil smoke, by the competent department of ecological environment and ordered to make corrections, and impose a fine of more than 5,000 yuan of less than 50,000 yuan; refusal to make corrections, and ordered to cease business rectification.
In violation of the provisions of Article 10, paragraph 1 (c) of these Regulations, the noise generated by the oil smoke purification equipment of the catering business project exceeds the national and local noise emission standards, the competent department of ecological and environmental affairs shall order rectification and impose a fine of not less than five thousand yuan and not more than fifty thousand yuan.
In violation of the provisions of the third paragraph of Article 10 of these Regulations, the discharge of oily fumes into the urban public **** rainwater or sewage pipes and other facilities, the competent department of ecological environment shall order the cessation of the illegal behavior, and the restoration of the original state or the adoption of other remedial measures, and shall give a warning; if no remedial measures are taken after the expiration of the time limit, or if the situation results in serious consequences, the unit shall be subjected to a fine of not less than 100,000 yuan to not more than 300,000 yuan, and the individual shall be subjected to a fine of not less Above 100,000 yuan fine; caused losses, according to the law to bear the responsibility for compensation.
