Regulations of Gansu Province on Prevention and Control of Air Pollution

chapter I general provisions article 1 these regulations are formulated in accordance with the law of the people's Republic of China on environmental protection, the law of the people's Republic of China on the prevention and control of air pollution and other laws and administrative regulations in combination with the actual situation of this province in order to protect and improve the environment, prevent and control air pollution, safeguard public health, promote the construction of ecological civilization and promote sustainable economic and social development. Article 2 These Regulations shall apply to the prevention and control of air pollution and its supervision and management activities within the administrative area of this province. Article 3 The prevention and control of air pollution should aim at improving the quality of the atmospheric environment, and adhere to the principles of source control, planning first, highlighting key points, combining prevention and control, government leading, enterprises as the main body, public participation and governance by the whole people. Article 4 People's governments at all levels shall take overall responsibility for the quality of the atmospheric environment within their respective administrative areas.

the people's governments at or above the county level should incorporate the prevention and control of air pollution into the national economic and social development plan and increase financial input; Change the mode of economic development, optimize and adjust the industrial structure, energy structure, transportation structure and land use structure; Formulate and implement economic, scientific and technological policies and technical measures conducive to the prevention and control of air pollution, strictly control and plan to reduce the total emission of air pollutants, so that the quality of the atmospheric environment can meet the standards set by the state and this province and be gradually improved.

township (town) people's governments and sub-district offices shall, according to the work arrangements of the people's governments at or above the county level and relevant departments, cooperate with the prevention and control of air pollution within their respective jurisdictions; Grassroots mass autonomous organizations shall assist in the prevention and control of air pollution. Fifth provincial people's government department in charge of ecological environment is responsible for the implementation of unified supervision and management of the prevention and control of air pollution in this province.

the competent department of ecological environment of the people's government of the city (state) and its dispatched offices shall exercise unified supervision and management over the prevention and control of air pollution in the city (state) and county (city, district) respectively.

other relevant competent departments of the people's governments at or above the county level shall, within the scope of their respective duties, mainly perform the following duties of supervision and management of air pollution prevention and control:

(1) The development and reform department is responsible for optimizing the industrial and energy structure and layout adjustment, developing circular economy, energy conservation, environmental protection and clean energy industries, and determining the total coal consumption control and reduction targets.

(2) The industry and information technology department shall, jointly with relevant departments, be responsible for eliminating backward production capacity, technological upgrading and energy saving of industrial enterprises, promoting upgrading and cleaner production of industrial boilers, uniformly planning and supervising the coal trading market and centralized distribution system, and promoting the use of new energy vehicles.

(3) The housing and urban-rural construction department is responsible for supervising and managing the prevention and control of dust pollution in construction sites such as housing construction, municipal infrastructure construction and building demolition, and promoting the construction of new central heating sources and heating networks.

(4) the market supervision and management department is responsible for the supervision and management of the implementation of energy-saving and environmental protection standards for coal-fired boilers and the quality of commercial coal, vehicle refined oil and high-pollution fuel production and sales; Supervise catering service units to install oil fume filtering equipment and use clean energy.

(5) The agricultural and rural departments are responsible for guiding agricultural cleaner production and reducing the emission of air pollutants in agricultural production and operation activities.

(6) The departments of transportation and natural resources shall supervise and manage the dust pollution caused by road construction and land consolidation respectively.

(7) the traffic administrative department of the public security organ is responsible for the elimination of old motor vehicles and the supervision of vehicles with high pollutant emissions, and cooperates with relevant departments to supervise and inspect the air pollutant emissions of motor vehicles, off-road mobile machinery and high-emission motor vehicles.

the supervision and management of other air pollution prevention and control shall be implemented by the relevant departments in accordance with the relevant laws, regulations and rules and the division of responsibilities determined by the people's governments at or above the county level.

the departments of the people's governments at or above the county level that are responsible for the supervision and management of atmospheric environmental protection should perform their duties and cooperate in strict accordance with the law, strengthen the daily supervision and management of the discharge of atmospheric pollutants, and promptly stop and deal with illegal acts that pollute the atmospheric environment according to law. Sixth provincial people's government on the cities (states) to improve the quality of the atmospheric environment, the completion of key tasks of air pollution prevention and control assessment. The assessment methods shall be formulated by the provincial people's government.

the municipal (state) people's government shall decompose the objectives and tasks of air pollution prevention and control determined by the provincial people's government and carry out assessment.

the assessment results should be made public and subject to public supervision. Seventh enterprises, institutions and other producers and operators shall implement the national and provincial standards for the discharge of air pollutants, take effective measures to prevent and reduce air pollution, and bear the responsibility for the damage caused according to law.

citizens should enhance their awareness of atmospheric environmental protection, adopt a low-carbon and frugal lifestyle, and consciously fulfill their obligations of atmospheric environmental protection. Article 8 People's governments at or above the county level and their relevant departments, township (town) people's governments and sub-district offices shall carry out laws and regulations on air pollution prevention and control, publicize and educate popular science knowledge, promote public participation in atmospheric environmental protection, and create an atmosphere for the whole society to protect the atmospheric environment. Chapter II Supervision and Administration of the Prevention and Control of Air Pollution Article 9 The provincial people's government may formulate local standards for items that are not specified in the national atmospheric environmental quality standards and air pollutant discharge standards; For the projects that have been stipulated in the national atmospheric environmental quality standards and air pollutant emission standards, local standards that are stricter than the national standards can be formulated according to the actual situation of this province, and published on its website, regularly evaluated and revised in a timely manner. Local atmospheric environmental quality standards and local air pollutant emission standards shall be reported to the competent department of ecological environment and standardization of the State Council for the record.

The formulation of local atmospheric environmental quality standards should aim at ensuring public health and protecting the ecological environment, be compatible with economic and social development, and be scientific and reasonable; The formulation of local standards for the discharge of atmospheric pollutants shall be based on the quality standards of atmospheric environment and the economic and technological conditions of the country.

when formulating local atmospheric environmental quality standards and air pollutant emission standards, experts shall be organized to conduct examination and demonstration, and opinions from relevant departments, trade associations, enterprises and institutions and the public shall be solicited.
