Article 26 of the newly revised Consumer Law stipulates that business operators shall not make unfair and unreasonable provisions to consumers, such as excluding or restricting consumers' rights, reducing or exempting business operators' responsibilities, and aggravating consumers' responsibilities, by means of format clauses, notices, statements, shop notices, etc., and shall not use format clauses and technical means to force transactions. Format clauses, notices, statements, shop notices, etc. contain the contents listed in the preceding paragraph, and their contents are invalid. It is particularly emphasized here that the Supreme People's Court clearly pointed out in the judicial interpretation that "it is forbidden to bring your own drinks" and "the minimum consumption in private rooms" are unfair and unreasonable provisions made by catering operators to increase consumers' responsibilities by taking advantage of their dominant position, which violates relevant laws and regulations and belongs to the overlord clause. Therefore, consumers can request the relevant departments and people's courts to handle it in accordance with the above-mentioned laws and regulations.
However, despite the protection of bring-your-own drinks by law, many consumers still react, and there are still some difficulties in safeguarding rights. In addition, even if you have successfully defended your rights, it will inevitably affect your mood and spoil a wonderful dinner. Therefore, smart consumers should learn to bring their own drinks skillfully, learn to make peace with restaurants, and make consumption a win, pleasure and enjoyment, rather than disputes and lawsuits. The following are some precautions for bringing your own wine:
1. Bring a bottle of wine that is not available in the hotel you are going to, but it is very special.
2. Ask by telephone whether the restaurant accepts drinks brought by customers.
3. If the hotel acts as an agent for a certain kind of wine, it's cheaper to drink it when there are activities, and it's not bad to use the wine from the hotel.
4. Let the waiter, sommelier or chef taste your own wine, and your generosity will be appreciated by them.
5. Tip: If the restaurant allows you to bring your own drinks and the waiter enthusiastically opens the bottle for you, don't forget to tip.
