Regulations of Guangdong Province on Food Safety

chapter I general provisions article 1 these regulations are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this province in order to improve the food safety guarantee system, clarify food safety responsibilities, strengthen food safety supervision and management, and ensure human health and life safety. Article 2 These Regulations shall apply to food production, sale, catering business and its supervision and management within the administrative area of this province.

the production activities such as planting and breeding of primary agricultural products and their supervision and management shall be implemented in accordance with the Law of the People's Republic of China on the Quality and Safety of Agricultural Products and other laws and regulations.

The production and sales of food additives, food packaging materials and containers, tools and equipment for food, the production, operation, supervision and management of alcohol and salt, and the supervision and management of pig slaughter shall be implemented in accordance with the relevant provisions of the state and the province.

the supervision and administration of food import and export shall be carried out in accordance with the relevant provisions of the state. Article 3 The people's governments at or above the county level shall take overall responsibility for food safety supervision and management within their respective administrative areas, lead and coordinate food safety supervision and management within their respective administrative areas, and establish and improve the coordination mechanism and responsibility system for food safety supervision and management.

people's governments at or above the county level should incorporate food safety into the national economic and social development plan at the corresponding level, gradually increase financial input, strengthen the construction of food safety supervision and management facilities, enrich the food safety supervision and management team, and improve the ability and level of supervision and management. Article 4 The department responsible for the comprehensive supervision of food safety as determined by the provincial people's government (hereinafter referred to as the department responsible for the comprehensive supervision of food safety) is responsible for the comprehensive supervision, organization and coordination of food safety work.

the administrative departments of agriculture, marine and fishery, quality and technical supervision, health, industry and commerce, food and drug of the people's governments at or above the county level (hereinafter referred to as the food safety supervision and management departments) shall supervise and manage the food production, sales and catering business activities according to these regulations and the responsibilities determined by the provincial people's government.

the provincial people's government can adjust the responsibilities of the food safety supervision and management department and the department responsible for comprehensive food safety supervision according to law.

the provincial people's government shall promptly announce to the public the specific responsibilities of the food safety supervision and management department and the department responsible for comprehensive food safety supervision. Article 5 The supervisory organs of the people's governments at or above the county level shall supervise and inspect the implementation of these Regulations by the departments responsible for comprehensive food safety supervision and the food safety supervision and management departments. Article 6 Food producers, sellers and catering operators are the first responsible persons for food safety. They must engage in production and business activities according to law and be responsible for the food safety they produce, sell and provide. Article 7 People's governments at all levels shall encourage and support scientific research institutions, institutions of higher learning and food producers and operators to carry out research on food safety science, technology and application, adopt advanced technologies and management norms, improve food processing technology and improve food safety. Eighth people's governments at all levels and their relevant administrative departments shall strengthen the publicity and education of food safety laws and regulations and food safety knowledge.

enterprises, institutions, people's organizations and social organizations shall publicize and popularize food safety laws and regulations and food safety knowledge.

Radio stations, TV stations, newspapers, Internet sites and other media should broadcast or publish food safety laws and regulations and public service advertisements in accordance with relevant requirements to publicize food safety knowledge. Article 9 Consumers should enhance food safety awareness and self-protection ability, develop healthy eating habits, and do not buy or eat unsafe food.

consumer associations and other consumer organizations should safeguard the legitimate rights and interests of consumers according to law.

relevant food industry associations should establish industry norms, organize credit construction, implement industry self-discipline management and provide services for their members. Article 11 Any individual or unit has the right to complain and report violations of food safety laws and regulations, to obtain information about food safety from the food safety supervision and administration department, and to put forward opinions or suggestions on food safety supervision and administration. Chapter II Food Production, Sales and Catering Business Section 1 General Provisions Article 11 Organizations and individuals engaged in food production, sales and catering business shall obtain licenses in accordance with the conditions and procedures prescribed by laws and administrative regulations. The license shall be hung in a prominent position in its production and business premises.

the food produced and sold by food producers, sellers and catering operators shall conform to the national, industrial and local standards of food, and shall not produce or sell food prohibited by laws and regulations. Twelfth engaged in food production, sales and catering business, should have the place (factory), facilities, sanitary environment and other conditions stipulated by laws and regulations, and establish and improve the food safety management system. Thirteenth food or its packaging should be labeled according to law. Food packaging labels and instructions shall meet the requirements of laws, regulations, rules and mandatory standards.

the name and address of the producer, the name of the food, the date of production, the shelf life, the storage conditions, the additives used, the ingredient list or ingredient list, the bar code of the goods and the implementation standards should be marked on the packaging of prepackaged foods.

in the production and sale of bulk food, the food name, main ingredients, production date, shelf life and the name and address of the food producer should be marked in a prominent position on the outer packaging or container.

the food entrusted for production shall be marked with the name, address and license number of the entrusted producer.

Food packaging labels and instructions shall not express or imply the function of preventing and treating diseases; Non-health food shall not express or imply health care function.
