Measures of Chongqing Municipality on the Administration of Food Safety

chapter I general provisions article 1 these measures are formulated in accordance with the food safety law of the people's Republic of China (hereinafter referred to as the food safety law), the regulations for the implementation of the food safety law of the people's Republic of China and relevant laws and regulations, and in combination with the actual situation of this municipality. Article 2 These Measures shall be observed when engaging in the production and business activities of food, food additives and food-related products and their safety supervision and management activities within the administrative area of this Municipality.

the quality and safety management of edible agricultural products shall comply with the provisions of the Law of the People's Republic of China on the Quality and Safety of Agricultural Products. However, the formulation of quality and safety standards for edible agricultural products and the publication of information on the safety of edible agricultural products shall comply with the provisions of food safety laws, regulations and rules. Article 3 Producers and operators of food, food additives and food-related products shall engage in production and business activities in accordance with laws, regulations and relevant standards, establish and improve safety management systems, ensure the safety of food, food additives and food-related products, and be responsible to the society and the public and assume social responsibilities. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall be responsible for and lead the work of food safety supervision and management, incorporate food safety into the national economic and social development plan, guarantee the funds for food safety supervision and management, establish and improve the coordination mechanism of food safety supervision and management departments and the sharing mechanism of food safety information, and incorporate food safety supervision and management into the annual work target assessment of the government.

the people's governments of cities, districts and counties (autonomous counties) set up food safety committees to uniformly organize, deploy, guide and coordinate food safety supervision and management. Article 5 The administrative department of health shall assume the responsibility of comprehensive coordination of food safety according to law, be responsible for the daily hygiene supervision and management, food safety risk monitoring, formulation of local standards for food safety, filing of enterprise standards for food safety, publication of food safety information of centralized disinfection service units for tableware, and organize the investigation and handling of major food safety accidents.

the quality supervision department shall undertake the supervision and management responsibilities of the production activities of food, food additives and food-related products according to law.

the administrative department for industry and commerce shall be responsible for the supervision and management of the circulation activities of food, food additives and food-related products according to law.

the food and drug supervision and management department shall undertake the supervision and management responsibilities of catering service activities according to law, and be responsible for guiding and supervising the supervision and management of rural family banquets.

Entry-exit inspection and quarantine institutions shall be responsible for the safety supervision and management of food, food additives and food-related products within the railway ports, shipping ports, airports with international navigation business and special customs supervision areas of this Municipality according to law.

The administrative departments of commerce and trade circulation, education, urban and rural construction, municipal administration and tourism are responsible for food safety supervision and management within their respective functions and duties. Article 6 Township people's governments and sub-district offices shall, within the scope entrusted by the food safety supervision and administration department, implement food safety supervision and administration according to law, strengthen food safety supervision and inspection, and report to the food safety supervision and administration department in a timely manner if illegal acts are found in food production and operation. Chapter ii food production and marketing section 1 general provisions article 7 food production and marketing shall meet the following requirements:

(1) toxic, harmful and easily contaminated articles shall not be produced or stored in food production and marketing places;

(2) Food production and business premises should be moisture-proof, mildew-proof, ventilated and dry, and food should be stored in categories;

(3) regularly maintain the equipment or facilities for food production and marketing, clean them in time, and keep them clean and hygienic;

(4) Food-related products shall meet the food safety requirements, be clearly marked, be used separately, be stored in a fixed location and be kept clean. Article 8 food producers and business operators shall not commit the following acts:

(1) soaking aquatic products and livestock and poultry products with non-edible chemicals;

(2) doping toxic and harmful substances such as poppy shells into food;

(3) using waste edible oil as raw material to produce edible oil. Article 9 Those engaged in food production, food circulation and catering services shall obtain food production licenses, food circulation licenses and catering service licenses according to law, and those engaged in the production and operation of specific varieties of food shall also be specially marked in the corresponding licenses according to law; Those who engage in food production, food circulation and catering service activities without permission shall be investigated and dealt with by the corresponding license management authorities.

a food producer who has obtained a food production license does not need to obtain a food circulation license to sell the food he produces in his production place, but if he sells other foods or engages in catering services in his production place, he shall obtain a food circulation license or catering service license according to law; A catering service provider who has obtained a catering service license does not need to obtain a food production and circulation license to sell food in its catering service place. Article 11 Producers of food additives and producers of food-related products subject to the administration of industrial product production license according to law shall apply to the municipal quality supervision department for industrial product production license according to law. Eleventh it is forbidden to use waste paper, waste plastics, waste rubber, waste fiber and other harmful substances as raw materials to produce food-related products such as packaging materials, containers, tools and equipment that come into direct contact with food.
