(three) due to other special circumstances, issued by the military division (brigade) level units, and approved by the competent department of the people's government at or above the provincial level.

Retired soldiers resettled in different places enjoy the same resettlement treatment as retired soldiers in resettlement places.

Twelfth retired soldiers in any of the following circumstances, according to my application, can be determined by the competent department of resettlement of retired soldiers of the people's governments at or above the provincial level in accordance with the principle of benefiting the lives of retired soldiers:

Disabled by war;

Thirteenth self-employed retired soldiers shall, within 30 days from the date of being approved to retire from active service, report to the competent department of resettlement of retired soldiers of the people's government at the county level in the resettlement place with the certificate of retirement and letter of introduction.

Retired soldiers assigned to work shall report to the competent department of resettlement of retired soldiers of the people's government at the designated resettlement place with the notice of receiving resettlement, certificate of discharge from active service and letter of introduction within the specified time.

Retired soldiers who are discharged from active service or supported shall report to the competent department of resettlement of retired soldiers of the people's government at the designated resettlement place.

Fourteenth retired soldiers in the army shall, in accordance with the relevant provisions of the state archives management, hand over their files to the competent departments of the people's governments at or above the county level for the resettlement of retired soldiers.

The competent department of resettlement of retired soldiers shall issue a letter of introduction for retired soldiers when they report for duty. The public security organ shall register accounts for retired soldiers with a letter of introduction issued by the competent department of resettlement of retired soldiers.

Fifteenth retired soldiers who are self-employed and arrange jobs shall be handled by the competent department of resettlement of retired soldiers in accordance with the relevant provisions of the state archives management.

The archives of retired soldiers shall be handed over to the service management unit by the competent department of resettlement of retired soldiers in the resettlement place.

Sixteenth retired soldiers have problems related to service, and the original troops are responsible for handling them; Issues related to resettlement shall be handled by the people's government of the resettlement area.

Seventeenth retired soldiers without justifiable reasons for more than 30 days not to report in accordance with the prescribed time, as a waiver of resettlement treatment.

Chapter III Resettlement of Migrants

Independent employment

Eighteenth conscripts and noncommissioned officers who have not served in active service for 12 years are discharged from active service, and the people's government shall support their independent employment.

Nineteenth retired soldiers who are self-employed shall be paid a one-time retirement pension by the army, and the one-time retirement pension shall be specially arranged by the central finance; Local people's governments may give economic subsidies according to local actual conditions, and the standards and measures for granting economic subsidies shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

One-time retirement fees and one-time economic subsidies shall be exempted from personal income tax in accordance with state regulations.

People's governments at all levels should strengthen the guidance and services for retired soldiers to start their own businesses. Local people's governments at or above the county level shall organize job introduction, employment recommendation and special job fairs to support retired soldiers to start their own businesses.

Article 20 The state shall determine the standard of retirement fee according to the level of national economic development, the average annual wage income of state employees and the occupational particularity of military personnel, and adjust it in a timely manner. The competent department of resettlement of retired soldiers in the State Council and the relevant military departments shall be responsible for the specific work of determining and adjusting the standard of retired gold jointly with the financial department of the State Council.

Self-employed retired soldiers receive a one-time retirement pension according to their active service years. Those who have served in active service for less than 6 months shall be counted as 6 months, and those who have served in active service for more than 6 months shall be counted as 1 year.

Retired soldiers who have won honorary titles or rendered meritorious service shall be given a one-time retirement pension by the army according to the following proportions:

(a) won the honorary title of the Central Military Commission, military units, or awarded the first class merit, additional15%;

(two) awarded the second class, additional10%;

(three) awarded the third class, additional 5%.

Retired soldiers who have won honorary titles or rendered meritorious service for many times shall be given a one-time retirement pension by the army according to the proportion of the highest grade award.

Twenty-first local people's governments at or above the county level shall organize self-employed retired soldiers to participate in vocational education and skills training. Those who pass the examination shall be issued with corresponding academic certificates and vocational qualification certificates, and recommended for employment. The expenses for participating in vocational education and skills training within 0 years after retired soldiers are borne by the people's governments at or above the county level; Retired soldiers retired 1 year or more to participate in vocational education and skills training, in accordance with the relevant national policies.

The funds for vocational education and skills training of self-employed retired soldiers are included in the financial budget of the people's governments at or above the county level.

Twenty-second public employment service institutions organized by people's governments at all levels shall provide archives management, career introduction and career guidance services for retired soldiers free of charge.

The state encourages other human resources service institutions to provide free services for self-employed retired soldiers.

Twenty-third retired soldiers engaged in self-employment, in accordance with the provisions of the state to give tax incentives, small secured loans to support, to engage in low-profit projects to give financial discount. Except for industries restricted by the state, administrative fees for management, registration and license shall be exempted within 3 years from the date of first registration with the administrative department for industry and commerce.

Article 24 The State encourages employers to recruit or employ retired soldiers to engage in self-employment. Employers recruit or employ retired soldiers who are self-employed and meet the prescribed conditions, and enjoy preferential treatment such as taxation according to law.

Twenty-fifth self-employed, retired soldiers who were staff members of state organs, social organizations, enterprises and institutions before enlisting, can choose to return to work after retiring from active service, and their wages, benefits and other benefits shall not be lower than the average level of personnel with the same conditions in their own units.

Twenty-sixth rural land contracted by self-employed retired soldiers through household contract before joining the army shall not be illegally recovered or forcibly transferred during the contract period; Rural land contracted by non-family contracting methods such as bidding, auction and public consultation may be contracted by family members during the contract period; Rural contracted land is expropriated, requisitioned or occupied according to law, and enjoys the same rights as other members of rural collective economic organizations.

Self-employed retired soldiers who have settled their accounts when they leave the army and are members of rural collective economic organizations but have not contracted rural land may apply for contracting rural land, and villagers' committees or villagers' groups shall give priority to solving them.

Twenty-seventh disabled retired soldiers who have the ability to work have priority to enjoy the preferential employment policies for the disabled stipulated by the state.

Twenty-eighth self-employed retired soldiers who enter secondary vocational schools and apply for adult colleges or ordinary colleges and universities shall enjoy preferential treatment in accordance with relevant state regulations.

Retired soldiers who have been admitted to ordinary institutions of higher learning before enlisting or who are studying in ordinary institutions of higher learning are allowed to enroll or resume their studies within two years after retiring from active service, and enjoy preferential treatment such as scholarships, grants and tuition reduction and exemption in accordance with relevant state regulations. Family financial difficulties, in accordance with the relevant provisions of the state to give funding; After entering school or during the resumption of school, you can get credits directly without taking public sports, military skills, military theory and other courses; After graduation, it is preferred to participate in national defense students, rural grassroots service projects organized by the state, and selection of officers.

Twenty-ninth retired soldiers who meet one of the following conditions shall be arranged by the people's government:

(1) Non-commissioned officers have served in active service for 12 years;

(4) They are children of martyrs.

Retired soldiers who meet the conditions specified in the preceding paragraph and are in active service in hard areas and special posts shall be given priority in their work; Those who have basically lost their ability to work due to mental disorder shall be properly placed.

Retired soldiers who meet the working conditions and voluntarily choose their own employment when they retire shall be handled in accordance with the provisions of the first section of Chapter III of these Regulations.

Thirtieth the State Council retired soldiers resettlement department and the General Staff of the People's Liberation Army of China shall formulate and issue the annual resettlement plan for retired soldiers that the national people's government needs to arrange.

Thirty-first central state organs and their enterprises and institutions in Beijing shall receive the task of arranging retired soldiers, which shall be issued by the competent department of resettlement of retired soldiers in the State Council. The local people's governments at or above the county level shall, in accordance with the principle of territorial management, assign the resettlement tasks of retired soldiers to institutions directly under the central state organs and enterprises and institutions outside Beijing managed by the central state organs.

Thirty-second local people's governments at or above the county level shall, according to the number of retired soldiers who meet the working conditions and the actual situation of the employing units, assign tasks to retired soldiers and make them known to the public according to law.

Counties (cities) with heavy resettlement tasks for retired soldiers can be arranged by the people's government at the next higher level within their administrative areas as a whole.

Thirty-third local people's governments at or above the county level shall, in accordance with the principle of territorial management, resettle retired soldiers who meet the working conditions and ensure their first employment.

Thirty-fourth state organs, institutions, state-owned, state-controlled and state-owned capital-dominated enterprises should give priority to recruiting retired soldiers under the same conditions.

Article 35 The resettlement people's government shall, within six months of receiving retired soldiers, complete the resettlement task of retired soldiers this year.

During the period when retired soldiers are to be arranged to work, the people's government of the resettlement place shall pay a monthly living allowance according to the standard of not less than the local minimum living standard.

Article 36 The unit undertaking the task of arranging the work of retired soldiers shall complete the task of arranging the work of retired soldiers on time, arrange the retired soldiers to take up their posts within 0 months after the letter of introduction is issued by the competent department of resettlement of retired soldiers, and sign a labor contract or employment contract with the retired soldiers for a period of not less than 3 years according to law.

During the contract period, if the unit is closed, bankrupt or restructured according to law, the retired soldiers and other personnel of the unit shall jointly implement the relevant provisions of the state.

Units that receive retired soldiers shall give priority to retaining retired soldiers if they reduce their personnel.

Thirty-seventh retired soldiers arranged by the people's government shall, in accordance with the provisions of these regulations, calculate the length of service and the working hours to be arranged, and enjoy the wages and welfare benefits of personnel with the same conditions in their units.

Article 38 If the receiving unit fails to arrange for retired soldiers to take up their posts in accordance with the regulations, it shall pay the living expenses to the retired soldiers from the month when the letter of introduction is issued by the competent department of resettlement of retired soldiers of the local people's government, according to the standard of not less than 80% of the average salary of personnel with the same conditions in the unit, until they take up their posts.

Thirty-ninth disabled retired soldiers assigned to work shall not terminate their labor relations or personnel relations because of their disability.

Retired soldiers who are disabled due to war and work enjoy the same welfare and medical treatment as those injured in their units.

Fortieth retired soldiers who meet the conditions for arranging work and refuse to obey the arrangement of work by the people's government of the resettlement place without justifiable reasons shall be regarded as giving up the arrangement of work; If he is investigated for criminal responsibility according to law during the planned work period, his qualification for work arrangement will be cancelled.

Retirement and support

Article 41 Non-commissioned officers above the intermediate level shall be discharged from active service if they meet one of the following conditions:

(a) At least 55 years old;

(2) Having served in active service for 30 years;

(3) Disability due to war or work is rated as 1 to level 6;

(4) Having been proved by a military hospital and verified by the health department of a unit at or above the corps level, and having basically lost the ability to work due to illness.

The life, housing and medical care of retired noncommissioned officers shall be guaranteed in accordance with relevant state regulations.

Non-commissioned officers at or above the intermediate level who are disabled due to war are rated as Grade 5 to Grade 6, and I voluntarily give up the option of being retired and resettled by the people's government, which can be handled in accordance with the provisions of Section 2 of Chapter 3 of these Regulations.

Forty-second conscripts and junior non-commissioned officers who have been assessed as 1 level to level 4 disabilities are discharged from active service and are supported by the state for life.

Disabled retired soldiers supported by the state, their living, housing, medical care and other security, in accordance with the relevant provisions of the state.

State support is divided into centralized support and decentralized support.

Decentralized support for disabled ex-soldiers to buy (build) houses is based on the average price of affordable housing in resettlement counties (cities) and the construction area of 60 square meters; Areas without affordable housing are determined according to the price of ordinary commodity housing. The funds needed for purchasing (building) houses shall be specially arranged by the central finance, and the insufficient part shall be solved by the local finance. The property right of purchasing (building) houses belongs to the disabled retired soldiers who are supported by dispersion. Decentralized support for disabled retired soldiers to solve their own housing, in accordance with the above standards will be purchased (built) housing costs to me.

Article 43 Non-commissioned officers at or above the intermediate level who are disabled due to war or on duty and are assessed as 1 to level 4 disabled and voluntarily give up their retirement and resettlement may choose to be supported by the state.
