The Law of the People's Republic of China on the Protection of the Yangtze River
Article 5: The relevant departments of the State Council and the people's governments at the provincial level in the Yangtze River basin are responsible for the implementation of the decisions of the National Coordination Mechanism for the Yangtze River Basin, and are responsible for the work related to the protection of the Yangtze River in accordance with their respective division of responsibilities.
Local people's governments at all levels in the Yangtze River Basin shall implement the responsibilities of ecological environmental protection and restoration, promoting rational and efficient utilization of resources, optimizing industrial structure and layout, and maintaining ecological security in the Yangtze River Basin in their respective administrative areas.
Chiefs of rivers and lakes at all levels in the Yangtze River Basin are responsible for work related to the protection of the Yangtze River.
Article 6: Relevant localities in the Yangtze River Basin shall, as needed, establish a collaborative mechanism in the formulation of local laws and governmental regulations, planning, supervision and law enforcement, etc., in order to collaborate in the promotion of ecological environment protection and restoration in the Yangtze River Basin.
The Fisheries Law of the People's Republic of China
Article 21 The State shall take measures in the areas of finance, credit and taxation to encourage and support the development of the distant-water fishing industry, and shall arrange for inland-water and offshore fishing forces in accordance with the harvestable amount of fishery resources.
Article 22 The State determines the total harvestable amount of fishery resources and implements a system of fishing limits based on the principle that the amount of harvest is less than the growth of fishery resources. The competent department of fisheries administration under the State Council is responsible for organizing surveys and assessments of fishery resources to provide a scientific basis for the implementation of the fishing quota system. The total amount of fishing quota for the People's Republic of China*** and domestic seas, territorial seas, exclusive economic zones and other jurisdictional waters shall be determined by the competent department of fisheries administration under the State Council, and reported to the State Council for approval before being broken down and distributed by level; the total amount of fishing quota for important rivers and lakes determined by the State shall be determined by the people's governments of the provinces, autonomous regions, and centrally administered municipalities directly under the Central Government concerned or through negotiation, and shall be broken down and distributed by level. The allocation of the total amount of fishing quota shall reflect the principles of fairness and justice, and the allocation method and the results of the allocation must be disclosed to the public and be subject to supervision.
The fishery administrative department of the State Council and the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government of the fishery administrative department shall strengthen the supervision and inspection of the implementation of the fishing quota system, more than the higher level of the fishing quota issued by the target, it shall be in the following year in the fishing quota indicator to be reduced.
