Article 1 (Purpose and Basis)

Article 2 (Scope of Application)

These Measures shall apply to the generation, collection, transportation, disposal of kitchen waste oil and grease and its related supervision and management activities in the administrative area of the city.

Article III (Definitions)

The kitchen waste oil and grease referred to in these measures refers to the daily life of residents in addition to the catering service (including units of food, hereinafter collectively referred to as "catering service"), food production and processing, as well as food ready for sale and other activities generated by the waste edible animal and vegetable fats and oils and wastewater containing edible animal and vegetable fats and oils. Article IV (management)

The municipal greening and municipal administration is responsible for the collection and transportation of kitchen waste oil and grease, disposal of supervision and management work. The municipal food safety coordination body is responsible for the city's kitchen waste grease disposal management of cross-sectoral coordination.

Article V (the main responsibility of the unit)

The city engaged in food service, food production and processing, as well as food ready for sale and other activities, the generation of kitchen waste oil and grease business units (including individual businesses, hereinafter collectively referred to as "generated units") and engaged in kitchen waste oil and grease collection and disposal activities are the unit. Article 6 (source reduction, resource utilization and integrated management)

Article VII (collection and transportation of units to determine)

District (county) greening and cityscape administration should be based on the number of food waste grease generated in the area under their jurisdiction, through bidding and tendering, to determine the unit engaged in the jurisdiction of the collection and transportation of food waste grease activities, and announced to the community.

In accordance with the provisions of the preceding paragraph to determine the unit can not meet the demand for food waste grease collection and transportation in the area under their jurisdiction, the district (county) greening and cityscape administrative departments should be increased in accordance with the procedures set out in the preceding paragraph.

Prohibit any unit or individual engaged in unauthorized collection and transportation of kitchen waste oil and grease activities.

Article VIII (collection and transportation unit bidding program and bidding requirements)

District (county) greening and city administration shall organize the preparation of collection and transportation unit bidding program, clear collection and transportation unit of the number and conditions, scope of services, service period and other matters, and reported to the municipal greening and city administration department for review and implementation.

The collection and transportation unit shall meet the following requirements:

(a) with enterprise legal personality, the registered capital shall not be less than RMB 5 million.

Article IX (the determination of disposal units)

Article X (disposal unit bidding requirements)

Article XI (directed collection and transportation)

Article 12 (directed disposal)

The collection and transportation unit shall be sent to the disposal unit identified in paragraph 1 of Article 9 of these Measures disposal of kitchen waste oil and grease, and disposal contract with the disposal unit. Article XIII (contract filing)

Article XIV (generation unit declaration)

Article XV (generation unit of the facilities set up requirements)

Article XVI (collection and use of generating units required)

Generating units should maintain the collection of kitchen waste oil and grease containers and oil-water separators in good condition and normal use.

Generating units shall collect kitchen waste oil and grease separately, and shall not mix kitchen waste oil and grease with other domestic garbage such as kitchen garbage or bare storage.

Article 17 (collection and transportation of joint bill)

Generating units to the collection and transportation of kitchen waste oil and grease delivery unit, should be delivered to the kitchen waste oil and grease type and quantity to be confirmed, and with the collection and transportation of the unit in the municipal greening and cityscape administrative department of the prescribed format of kitchen waste oil and grease collection and transportation services joint bill (hereinafter referred to as "collection and transportation of joint bill") on the signature. Article 18 (collection and transportation requirements)

Article 19 (collection and transportation personnel requirements)

Collection and transportation personnel engaged in the collection and transportation of kitchen waste oil and grease operations, should be in accordance with the requirements of the Municipal Environmental Sanitation Industry Association, wearing a uniform work clothing, and wearing identification tags.

The collection and transportation personnel should participate in the City Environmental Sanitation Industry Association organized training and passed the examination.

Article 20 (storage, preliminary processing site requirements)

The collection and transportation of kitchen waste oil and grease vehicles into the storage, preliminary processing site, the collection and transportation unit should be recorded in the collection and transportation of kitchen waste oil and grease types and quantities and vehicles actually collected and transported kitchen waste oil and grease types and quantities for verification.

Article 21 (disposal unit)

The collection unit to the disposal unit to send the kitchen waste oil and grease, should be sent to the kitchen waste oil and grease type and quantity to be confirmed, and with the disposal unit in the municipal greening and municipal administration department of the prescribed format of the kitchen waste oil and grease disposal services on the joint list of signatures and seals.

Article 22 (disposal requirements)

Disposal of waste water, waste gas, waste residue, should be consistent with national and municipal environmental protection management requirements.

Article 23 (disposal of prohibited requirements)

Disposal units shall not be disposed of kitchen waste grease or disposal does not meet the corresponding product quality standards of products to be resold or used for other purposes.

Without the consent of the municipal greening and urban management department, the disposal unit shall not be unauthorized closure, shutdown.

Article 24 (accounts and information management requirements)

Generating units, collection and transportation units and disposal units should be established to record kitchen waste oil and grease accounts, truthful records of daily delivery, collection and transportation or disposal of kitchen waste oil and grease types, quantities, time, and the name of the relevant units.

The collection unit and disposal unit shall record the contents of the previous paragraph of the record ledger as well as in accordance with the provisions of Article 22, paragraph 3 of the formation of the test, evaluation results and other information, entered into the unit's information management system, and monthly information management system to record the information sent to the greening of municipal administrative departments.

Article 25 (industry self-regulation)

The city's catering and culinary industry associations, food associations, municipal environmental sanitation industry associations should develop industry self-regulation system, urging the generation of units, collection units and disposal units to strengthen the generation of kitchen waste oil and grease, collection and disposal of activities of the management; violation of the industry's self-regulatory system of member units, you can take the appropriate self-regulatory disciplinary measures.

Article 26 (review system)

Municipalities and districts (counties) greening and city administration should be in conjunction with the Food Safety Comprehensive Coordinating Agency, food and drug supervision, quality and technical supervision, industry and commerce, environmental protection, water, public security, urban law enforcement, as well as entry-exit inspection and quarantine and other relevant administrative departments, the annual collection unit, the disposal of units engaged in the collection, disposal of kitchen waste oil and fat activities for review, and to take corresponding self-regulatory measures. Article 27 (related licensing supervision)

Article 29 (Emergency Disposal)

Article 30 (Complaint Handling)

Article 31 (unauthorized collection, disposal of treatment)

Article 32 (the generation of units of punishment)

Article 33 (penalties for collection and transportation units)

Article 34 (penalties for disposal unit)

Article 35 (penalties for violation of the account and information management requirements)

(a) violation of the provisions of Article 24 (1) of these Measures, the generating unit, collection and transportation unit, or the disposal unit did not follow the Requirements for the establishment of kitchen waste oil and grease record accounts;

(2) violation of the provisions of Article 24, paragraph 2, collection and transportation units or disposal units are not in accordance with the requirements of the information management system to report the information recorded.

Article 36 (transfer of cases)

The city's food and drug supervision, quality and technical supervision, industry and commerce, as well as entry-exit inspection and quarantine and other administrative departments found that the generation of units in violation of these measures and does not belong to the responsibilities of the department, it should be collected and evidence of material, and promptly transfer the case materials to the city law enforcement agencies.

Article 37 (administrative responsibility)

Violation of the provisions of this approach, the city and district (county) greening and city administration, urban law enforcement departments and other relevant administrative departments and their staff have one of the following behaviors, by the unit or the higher authorities in charge of the unit or higher authorities in accordance with the law on the directly responsible officers and other directly responsible personnel to be given a demerit or a major demerit. (a) illegal to determine the collection unit or disposal unit;

(b) the requirements of the provisions of this approach is not included in the relevant administrative licensing review;

(d) other Abuse of power, dereliction of duty, favoritism and malpractice.

Article 38 (the use of animals, animal products and food processing waste production of edible oil treatment)

The death of disease and corruption and deterioration of livestock and poultry and other animals and animal products, should be in accordance with the "People's Republic of China *** and the State of Animal Epidemiological Prevention Act", "Shanghai Animal Epidemiological Prevention Regulations" and other laws and regulations for the harmless treatment of edible oil shall not be used as raw materials production.

Food processing waste should be handled in accordance with the "Shanghai Kitchen Waste Disposal Management Measures" and other rules and regulations, and shall not be used as raw materials for the production of edible oil.

The city's agriculture, food and drug supervision, quality and technical supervision, industry and commerce, greening and amenities and other administrative departments shall, in accordance with the law, to strengthen the dead and rotting livestock and poultry and other animals, as well as animal products, food processing waste disposal activities of supervision and management.

Article 39 (Enforcement Date)

These Measures shall come into force on March 1, 2013 .
