article 1 in order to strengthen the management of kitchen waste, ensure food safety and improve the level of urban environmental sanitation, these measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this municipality. Article 2 These Measures shall apply to the collection, removal, treatment, supervision and management of kitchen waste within the administrative area of this Municipality. Article 3 The term "kitchen waste" as mentioned in these Measures refers to food waste, expired food and food residues produced after on-site consumption, including waste edible oil and kitchen waste.
the term "waste edible oils and fats" as mentioned in these measures refers to the mixture of animal and vegetable oils and waste edible oil and water that can no longer be eaten.
the term "kitchen waste" as mentioned in these measures refers to other kitchen waste except waste edible oil. Article 4 The municipal and district people's governments shall organize relevant departments to carry out publicity work on the management of kitchen waste, encourage and support the development of kitchen waste treatment technology and the construction of facilities, and advocate the resource utilization of kitchen waste.
kitchen waste that cannot be recycled should be handed over to the garbage sanitary landfill for harmless treatment.
it is forbidden to use kitchen waste and its processed products as raw materials to produce and process food. It is forbidden to use kitchen waste without harmless treatment to raise livestock and poultry. Article 5 the municipal urban management department (hereinafter referred to as the municipal competent department) is responsible for the unified management of kitchen waste in the whole city, and its main responsibilities are as follows:
(1) to formulate management measures for kitchen waste and organize their implementation;
(2) to guide, coordinate, supervise and inspect the management of kitchen waste in each district;
(3) issuing permits for the removal and disposal of municipal solid waste and transportation vehicles for municipal solid waste;
(4) supervise and manage the operation and use of kitchen waste treatment facilities;
(5) investigate and deal with illegal discharge, removal and disposal of kitchen waste. Article 6 the district urban management department (hereinafter referred to as the district competent department) is responsible for the daily management of kitchen waste within its jurisdiction, and its main responsibilities are as follows:
(1) implementing the management measures of kitchen waste formulated by the municipal competent department;
(2) supervise and inspect the generation, collection and removal of kitchen waste, and track and manage the whole process;
(3) Be responsible for the filing of kitchen waste production, removal contract, joint list and statistical table;
(4) investigate and deal with illegal discharge, removal and disposal of kitchen waste. Article 7 The quality and technical supervision and management department shall be responsible for the supervision and management of food production and processing, strengthen inspection and testing means, and investigate and deal with illegal acts of food production and processing with kitchen waste as raw materials according to law.
the administrative department for industry and commerce is responsible for the supervision and management of food circulation, implementing the system of obtaining certificates and tickets for market access, and investigating and punishing illegal acts of selling fake and shoddy edible oils and fats according to law.
the health administration department is responsible for the supervision and management of food consumption, and investigates and deals with illegal acts of making food with kitchen waste as raw materials according to law.
the environmental protection department is responsible for the supervision and management of pollution prevention measures of kitchen waste generating and processing units.
the agricultural management department is responsible for the supervision and management of livestock and poultry production sites, and investigates and deals with illegal acts of raising livestock and poultry with kitchen waste that has not been treated harmlessly according to law.
the water department is responsible for the supervision and management of the drainage permit, and investigates and deals with the discharge of kitchen waste in violation of the drainage permit according to law. Article 8 Units engaged in the business of food waste removal and transportation shall apply to the municipal competent department in accordance with the relevant provisions, and obtain the license of urban domestic waste removal and transportation permit. Article 9 Units engaged in the business treatment of kitchen waste shall apply to the municipal competent department in accordance with the relevant provisions and obtain the license for the treatment of urban domestic waste. Tenth kitchen waste generating units are responsible for the collection, removal and disposal of kitchen waste. Article 11 The kitchen waste generating unit shall make statistics on the amount of kitchen waste generated, deliver the kitchen waste to the licensed removal unit for removal and sign a removal contract. Twelfth kitchen waste generating units shall report the amount of kitchen waste and the removal contract to the local district competent department for the record and obtain a receipt. Where the record items are changed, the change procedures shall be handled within 5 working days from the date of change.
when handling the annual examination of the pollutant discharge permit, hygiene permit and other relevant certificates, the kitchen waste generating unit shall issue a receipt for the record of the removal contract to the environmental protection and health departments. Thirteenth kitchen waste generating units shall collect kitchen waste separately from other municipal solid waste. The collection container shall be kept intact and sealed, and marked with the words "kitchen waste collection container".
it is forbidden to directly discharge kitchen waste into the drainage pipeline or dump, scatter or pile it up at will. Article 14 The kitchen waste removal unit shall remove the kitchen waste to the kitchen waste treatment unit or garbage sanitary landfill for treatment, and abide by the following provisions:
(1) Remove the kitchen waste from the kitchen waste generation unit at least once a day (including legal holidays);
(2) Separate collection and removal of kitchen waste and other municipal solid waste;
(3) The transportation shall be completely sealed, and it shall not drip or scatter during transportation, and shall not be stored naked during transshipment;
(4) The appearance of the means of transport shall be kept clean and tidy, and the prescribed signs shall be painted. Article 15 When kitchen waste treatment units and garbage sanitary landfills engage in kitchen waste treatment activities, they shall abide by the following provisions:
(1) If the treatment facilities need to be suspended for normal maintenance, they shall report to the municipal competent department in writing 15 days in advance;
(2) Set up and regularly test and maintain the garbage metering system;
(3) set up safety institutions and full-time safety management personnel, improve and implement the safety management system, equip with safety facilities, and formulate safety emergency plans to ensure the safe operation of treatment facilities;
(4) In accordance with the relevant provisions of the state and this Municipality on environmental protection, effective pollution prevention measures shall be taken during the treatment;
(5) If microbial agents are used to treat kitchen waste, they shall be used in accordance with the relevant provisions of the state and take corresponding safety control measures;
(6) The products produced shall meet the quality standards.
