Article 1 In order to severely punish criminal activities such as smuggling, trafficking, transporting, manufacturing drugs and illegally planting drug plants, illegal acts of taking or injecting drugs are prohibited, to protect citizens' physical and mental health, to maintain social order and to ensure the smooth progress of socialist construction, in accordance with the Criminal Law of the People's Republic of China (hereinafter referred to as the Criminal Law) and the Decision of the National People's Congress Standing Committee (NPCSC) on Drug Control (hereinafter referred to as the Drug Control) Article 2 Drugs mentioned in these Regulations refer to opium, heroin, methamphetamine (ice), morphine, marijuana, cocaine and other narcotic drugs and psychotropic drugs that can make people addicted to drugs as stipulated by the state. Article 3 These Regulations shall apply to the drug control work within the administrative area of this Municipality. Article 4 Anti-drug work shall be carried out by combining specialized organs with the masses, combining investigation with prevention, and combining punishment with education. Fifth people's governments at all levels shall lead and coordinate the drug control work in their respective jurisdictions. The public security organ is the administrative department in charge of drug control. Article 6 Public security organs, procuratorial organs, judicial organs and judicial administrative departments shall conscientiously perform their respective statutory duties and severely punish drug crimes.

Article 7 The funds needed for drug control work shall be included in the financial budget by the people's governments at all levels and used for special purposes. Article 8 Whoever commits any of the following acts shall be investigated for criminal responsibility by judicial organs in accordance with the provisions of the Criminal Law:

(1) Smuggling, selling, transporting or manufacturing drugs;

(2) illegally possessing more than 211 grams of opium, more than 11 grams of heroin or methamphetamine, or other drugs in large quantities;

(3) harboring criminals who smuggle, sell, transport or manufacture drugs, hiding, transferring or concealing drugs or property obtained from crimes for criminals;

(4) illegally transporting or carrying acetic anhydride, ether, chloroform or other raw materials or preparations used for the manufacture of drugs into or out of the country, or illegally buying or selling the above-mentioned articles in China;

(5) illegally planting more than 511 opium poppy plants or a large number of other original drug plants, or illegally planting opium poppy, cannabis and other original drug plants and planting them after being treated by public security organs or resisting eradication,

(6) illegally buying, selling, transporting, carrying or holding a large number of seeds or seedlings of the original drug plants such as opium poppy that have not been inactivated;

(7) forcing, luring, abetting or deceiving others to take or inject drugs;

(8) allowing others to take or inject drugs;

(9) Those who are engaged in the production, transportation, management and use of narcotic drugs and psychotropic drugs under state control in accordance with the law, in violation of state regulations, provide narcotic drugs and psychotropic drugs under state control that can make people addicted to drugs to criminals who smuggle and sell drugs or to people who take or inject drugs. Article 9 Whoever illegally possesses less than 211 grams of opium, less than 11 grams of heroin or methamphetamine or other small amounts of drugs, or illegally cultivates less than 511 opium poppies or other original plants with small quantities of drugs shall be punished by the public security organs in accordance with the provisions of the Decision on Drug Control. Article 11 Whoever illegally buys, sells, transports, carries or holds the seeds or seedlings of the original plants of drugs such as opium poppy that have not been inactivated in small quantities shall be confiscated by the public security organs and their illegal income, and shall be fined not less than 3,111 yuan but not more than 11,111 yuan. Article 11 Anyone who illegally transports, buys, sells, stores or uses poppy shells shall be confiscated by the public security organ in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security, and shall be detained for not more than 15 days, and may be fined not more than 3,111 yuan.

If the circumstances are serious, it shall be ordered to stop production and business. Twelfth hotels, entertainment, catering services, transportation and other units and housing tenants, should strengthen the management of their own units or places, as one of the management responsibilities. Those who fail to report to the public security organs and take measures to stop the illegal and criminal activities of drugs in their own units or places shall be fined by the public security organs from 11,111 yuan to 111,111 yuan, and the persons in charge and the persons directly responsible shall be fined from 1,111 yuan. If the circumstances are serious, they shall be ordered to rectify within a time limit or suspend business for rectification. Thirteenth pharmaceutical production and sales departments and medical units should strictly implement the "Measures for the Administration of Narcotic Drugs" and "Measures for the Administration of Psychotropic Drugs" of the State Council, and it is strictly forbidden for any unit or individual to illegally produce, trade and use narcotic drugs and psychotropic drugs under state control.
