chapter I general provisions article 1 these regulations are formulated in accordance with the food safety law of the people's Republic of China and other laws and administrative regulations, and in combination with the actual situation of Gansu province, in order to standardize the production and business operations of small food workshops, small business shops and small stalls in Gansu province, strengthen food safety management, and ensure public health and life safety. Article 2 These Regulations shall apply to the production, operation, supervision and management activities of small food workshops, shops and stalls within the administrative area of this province.
the term "small food workshops" as mentioned in these regulations refers to producers and operators who have fixed production and business premises and sales areas, and whose business scale does not meet the licensing conditions of food production enterprises, and are engaged in food production, processing and sales.
the term "small food stores" as mentioned in these regulations includes small restaurants and small food outlets. Small catering refers to an operator who has a fixed store with a business area of less than 31 square meters and is engaged in catering services; A small food store refers to an individual operator who has a fixed store with an area of less than 11 square meters and is engaged in food sales.
the term "small stalls" as mentioned in these regulations refers to self-employed persons who sell food or make and sell food on the spot within a designated place and within a specified time without a fixed store. Article 3 The food and drug supervision and administration department of the people's government at or above the county level shall be responsible for the food safety supervision and administration of small food workshops, small business shops and small stalls within their respective administrative areas.
the agencies of the food and drug supervision and administration department of the people's government at the county level in townships (towns) and streets are responsible for the daily supervision and management of small food workshops, shops and stalls in their respective jurisdictions.
other relevant departments of the people's governments at or above the county level shall, according to their respective responsibilities, do a good job in the supervision, management and service of small food workshops, small business shops and small stalls. Article 4 The people's governments at or above the county level shall, in accordance with the principle of promoting healthy development and facilitating people's lives, make overall plans, build and transform centralized places and blocks suitable for the production and operation of small food workshops, shops and stalls, and build corresponding water supply and drainage and sewage facilities; Encourage and support producers and operators of small food workshops, shops and stalls to improve their production and operation conditions and technology and improve food safety through measures such as financial assistance and preferential venue rent.
township (town) people's governments and sub-district offices shall strengthen the food safety work of small food workshops, small business shops and small stalls within their respective jurisdictions, and, according to the actual situation, delimit temporary business areas and time periods for small stalls to operate, without affecting traffic safety, urban appearance and environmental sanitation and the production and life of surrounding residents, and announce them to the public. Primary and secondary schools, kindergartens around 211 meters shall not be identified as small stalls business activities area.
encourage social forces to participate in the construction of centralized business premises and blocks for small stalls, and guide centralized contiguous operation. Article 5 The food trade association shall, in accordance with the principle of active guidance and voluntary participation, attract operators of small food workshops, small business shops and small stalls to join the association, guide them to produce and operate according to law, strengthen industry self-discipline, promote the construction of integrity, and publicize and popularize food safety knowledge. Chapter II General Provisions Article 6 Small food workshops shall be subject to food production registration certificate management, small food shops shall be subject to food business registration certificate management, and small stalls shall be subject to registration card management.
food production registration certificate, food business registration certificate and registration card shall be issued by the food and drug supervision and administration department of the people's government at the county level. The registration card can also be issued by the agency entrusted by the food and drug supervision and administration department of the people's government at the county level.
the food production registration certificate and food business registration certificate are valid for three years, and the registration card is valid for one year. No fees shall be charged for issuing the registration certificate (card). Article 7 Where the applicant's information and registered items of small food workshops, shops and stalls change, it shall immediately apply to the original registration department for change, and it shall not be changed without approval.
the applicant's information mentioned in the preceding paragraph includes: the names of small food workshops, small business shops and stalls, the names of responsible persons or operators, ID numbers, nationalities, addresses, contact numbers, etc. The registered items include: production and business scope, production and business address, business time and place of small stalls, information of employees, etc.
if the registration certificate (card) needs to be renewed upon expiration, it shall apply to the original issuing department within 31 working days before expiration. Article 8 Small food workshops and small business shops shall submit the following materials when handling food production and business registration certificates (cards):
(1) an application;
(2) a copy of the applicant's identity card;
(3) a copy of the industrial and commercial business license;
(4) health examination and training certificate of employees;
(5) the legal use certificate of the production and business operation place.
applicants for small food workshops are also required to submit the floor plan of the production and processing site, the description of food varieties to be produced and processed, and the list of raw materials and food additives.
applicants for small stalls need to submit items 1, 2 and 4 of the first paragraph. Small stalls operating outside the fixed market shall also be submitted to the urban law enforcement administrative department or the stall location certificate issued by the township (town) people's government and sub-district office. Article 9 The food and drug supervision and administration department or agency of the people's government at the county level shall complete the examination within 15 working days from the date of receiving the application. Those who meet the requirements shall be registered and issued registration certificates (cards); Do not meet the conditions, not to register, and explain the reasons in writing.
if the materials submitted by the applicants for small stalls meet the requirements, registration cards shall be issued on the spot.
