Article 1 Definitions of terms in this contract

1. Travel agency refers to an enterprise as a legal person that has obtained the Travel Agency Business License and the Business License of Enterprise as a Legal Person and is engaged in tourism business.

2. Tourists refer to mainland residents or groups who have signed domestic tourism contracts with travel agencies and participated in domestic tourism activities.

3. Domestic tourism service refers to the travel agency organizing tourists to travel in the People's Republic of China (excluding Hongkong, Macau and Taiwan Province), booking public transportation tickets and arranging catering, accommodation, sightseeing and other service activities in accordance with the Travel Agency Regulations and other laws and regulations.

4. Travel expenses refer to the expenses paid by tourists to travel agencies for purchasing domestic travel services.

Travel expenses include:

(1) transportation expenses;

(2) accommodation fee;

(3) meals (excluding drinks);

(4) The first entrance fee for scenic spots arranged by the travel agency;

(5) other items arranged in the itinerary;

(6) tour guide service fees and other service fees of travel agencies (including destination pick-up travel agencies).

Travel expenses do not include:

(1) Personal travel insurance expenses insured by tourists;

(2) The contract stipulates that tourists need to pay for the items separately;

(3) The expenses paid by the travel agency are not stipulated in the contract, including but not limited to the expenses required for non-contractual activities outside the itinerary and the expenses incurred during the self-arranged activities;

(4) The personal expenses of tourists during the trip include but not limited to non-free meals on transportation, overweight luggage, laundry, telephone, drinks and alcohol during the stay, personal entertainment expenses, medical expenses for personal injuries, expenses and rewards for finding personal lost items, and compensation expenses caused by personal reasons.

5. Shopping places refer to the places arranged in the Travel Schedule, which are dedicated to or mainly engaged in shopping.

6. Free activities refer to the free activities arranged in the Travel Schedule.

7. The period of self-arranged activities refers to the period of free activities arranged in the Travel Schedule, the period when tourists do not participate in travel activities, the period when tourists leave the accommodation facilities before and after the daily trip, and the period when tourists leave the group temporarily with the consent of the tour guide.

8. Travel agency liability insurance refers to the insurance whose subject matter is the compensation liability that the travel agency should bear for tourists and the personnel appointed by it to provide services for tourists according to law because of the tourism activities organized by it.

9. Personal travel insurance insured by tourists refers to short-term insurance purchased by tourists themselves or through insurance agencies such as travel agencies, air ticket agents and scenic spots, with their own life, body, property or related interests as the insurance subject, including but not limited to aviation accident insurance, travel accident insurance, emergency rescue insurance and special project accident insurance.

11, leaving the group refers to the behavior of group tourists who do not complete the agreed itinerary with the group with the consent of the tour guide.

12. Transfer tour refers to the behavior that a travel agency obtains the written consent of tourists and transfers tourists to domestic travel teams organized by other travel agencies before departure, because the number of tour groups is less than the number of tour groups.

13. Grouping refers to the behavior of a travel agency, with the consent of tourists when signing a contract, to form a group with tourists recruited by other travel agencies to arrange tourism services in a unified way on the premise of ensuring that the promised service content and standards remain unchanged.

14. Force majeure refers to unforeseeable, unavoidable and insurmountable objective circumstances, including but not limited to those caused by natural and social reasons, such as natural disasters, wars, terrorist activities, turmoil, riots, strikes, public health emergencies and government actions.

15. Accidents refer to incidents caused by accidental factors other than the parties' intention or negligence, including but not limited to traffic jams caused by major protocol activities, delayed train flights and temporary closure of scenic spots.

16. Business loss fee refers to the economic loss caused by tourists leaving the group before departure. Including the cost of flying (car, boat) and other means of transportation (including reservation money), hotel accommodation (including reservation money), per capita car rental for sightseeing cars and other actual expenses that have occurred.

17, Golden Week, refers to the three-day statutory holidays, such as Spring Festival and "Eleventh", which are connected with the public holidays before and after to form a public holiday which is usually seven days. Article 2 Travel itinerary

The travel agency shall provide a Travel Itinerary with a group number (hereinafter referred to as "travel itinerary"), which shall be an integral part of this contract after being confirmed by both parties' signatures or seals. "travel itinerary" should clearly explain the following contents:

(1) the starting point, passing place, destination, route travel time and specific arrangements of the tourist itinerary (calculated by natural days, including flight time by plane, car, boat, etc., and less than 24 hours are counted as one day);

(2) the name, address, contact person and telephone number of the destination travel agency;

(3) transportation service arrangement and its standard (specify the information such as transportation, grade, departure time and whether it is necessary to transfer);

(4) Accommodation service arrangement and its standard (specify the name, location and star rating of the accommodation hotel, and indicate whether the non-star hotels have air conditioning, hot water, separate toilets and other related service facilities);

(5) dining (breakfast and dinner) service arrangement and its standards (specify the frequency, place and standard of dining);

(6) the specific content and time of the tour items arranged by the travel agency (make clear the contents of the tour route, including the names of the scenic spots and the tour items, and the minimum stay time of the scenic spots);

(7) Time and frequency of free activities;

(8) shopping arrangements (the number of shopping trips arranged by the travel agency shall not exceed half of the number of days of the trip, and the name of the shopping place, the maximum stay time and the main commodities shall be listed at the same time);

(9) entertainment activities arranged by the itinerary (specify the time, place and project content of entertainment activities);

(11) Additional paid items (If there are any arrangements, the travel agency shall provide the tourists with the List of Additional Paid Items at the time of signing the contract, indicating the price of the additional paid items, the transportation expenses and tour guide service fees for participating in the additional paid items, etc., which will be voluntarily selected by the tourists and signed and confirmed as an integral part of this contract; Items paid separately should be based on the principle of not affecting the original planned itinerary);

The terms in travel itinerary must be accurate and clear, and there should be no uncertain terms such as "quasi × star", "luxury", "for reference only", "subject to ××" and "at the same level as ××" in indicating the service standard.

tourists should carefully read the terms of this contract, the travel itinerary and the list of items to be paid separately. after tourists understand the terms of this contract and relevant annexes, travel agencies and tourists should sign a written contract.

Article 4 Travel advertisements and promotional materials

Travel advertisements and promotional materials of travel agencies shall follow the principle of honesty and credit, and those whose contents conform to the provisions of the Contract Law of the People's Republic of China shall be regarded as an integral part of this contract and binding on both travel agencies and tourists.

article 5 effectiveness of the contract

this contract is made in duplicate, one for each party, with the same legal effect, and shall come into effect as of the date of signature or seal by both parties. Article 6 Rights of travel agencies

1. Decide whether to accept tourists to sign up for tours according to their physical health and related conditions;

2. Verify the relevant information provided by tourists;

3. Collect the full travel expenses from tourists according to the contract;

4. In case of emergency, the tourism team can take emergency measures and ask the tourists to cooperate;

5. Refuse the unreasonable demands put forward by tourists beyond the contract.

Article 7 Obligations of travel agencies

1. Provide services for tourists according to the contents and standards agreed in the contract and the travel itinerary;

2. Before leaving the group, truthfully inform the specific itinerary and related specific matters, including but not limited to the important regulations, customs and habits of the tourist destination, safety measures and emergency contact information;

3. according to the contract, arrange certified tour guides for the tourism team in accordance with the regulations on the administration of tour guides;

4. Keep all kinds of documents submitted by tourists properly;

5. issue a security card written in a fixed format and filled in by tourists, which contains personal information (including the name, blood type and emergency contact information of tourists);

6. Make real explanations and clear warnings to tourists about matters that may endanger the personal and property safety of tourists, and take reasonable and necessary measures to prevent the harm. When the personal and property rights and interests of tourists are damaged, they should take reasonable and necessary protection and rescue measures to prevent the loss of personal and property rights and interests of tourists from expanding;

7. Insure travel agency liability insurance in accordance with relevant laws and regulations;

8. Prompt tourists to buy personal travel insurance;

9. Shopping and other paid items shall be arranged according to the contract, and tourists shall not be forced to shop or participate in other paid items in disguise;

11. If the goods purchased by tourists at the shopping place arranged by travel itinerary are fake and shoddy goods, the travel agency shall actively assist the tourists to make claims. If the tourists cannot get compensation from the shopping place more than 61 days after the date of claim, the travel agency shall pay in advance;

11. Provide tourists with legal travel expense invoices;

12. Keep the personal information of tourists confidential according to law;

13. Actively coordinate and handle tourists' complaints during the travel itinerary, and take appropriate measures to prevent the loss from expanding when disputes arise;

14. In case of leaving the group by means of group work, the travel agency that signed the contract will still bear the responsibilities and obligations stipulated in this contract.

Article 8 Tourists' Rights

1. Require travel agencies to honor travel itinerary services in accordance with the contract and travel itinerary;

2. Refuse to transfer or join a group without prior consultation, and to arrange shopping and other paid items outside the contract;

3. Ask the travel agency to issue an invoice when paying the travel expenses;

4. Complain to the tourism, industry and commerce departments or ask the travel agency for assistance in claiming compensation when the legitimate rights and interests are damaged;

5. Other rights granted to consumers by the Consumer Protection Law of the People's Republic of China and relevant laws and regulations.

Article 9 Obligations of Tourists

1. Fill in the Tourism Registration Form, tourist safety protection card and other contents truthfully, and take responsibility for the contents filled in, and truthfully inform the travel agency staff of the personal health information related to tourism activities, and the contact information provided must be frequently used or can be contacted in time;

2. Pay the travel expenses according to the contract;

3. Accomplish the tour with the tour group according to the contract, cooperate with the unified management of tour guides, and take measures to prevent the loss from expanding in case of unexpected events;

4. Abide by national and local laws, regulations and relevant regulations, and do not engage in illegal activities, pornography, gambling and drug-related activities during travel;

5. Abide by public order and social morality, and respect local ethnic customs; Respect the personality of tourism service personnel, behave in a civilized manner, do not scribble on landscapes and buildings, and do not spit or litter;

6. Take good care of your luggage, especially valuables;

7. Disputes arising during the trip shall be settled on the principle of equal consultation, appropriate measures shall be taken to prevent the loss from expanding, and the trip shall not be delayed or the group will leave by refusing to board the plane (car or boat);

8. During the self-arranged activities, you should choose the activities within the scope of your own risk control and be responsible for your own safety;

9. When the legitimate rights and interests are damaged and the travel agency is required to assist in claiming compensation, provide legal and valid credentials. Article 11 Modification of the Contract

1. The travel agency and the tourists can modify the contents of this contract through consultation, but it shall be signed by both parties in writing. The increased travel expenses and losses caused to the other party shall be borne by the party proposing the change; The travel agency shall refund the tourists the travel expenses thus reduced.

2. If the contract cannot be performed or continues to be performed due to force majeure or unexpected events, the travel agency may change the corresponding contents after obtaining the consent of more than 51% of the members of the travel team. If it is impossible to solicit opinions due to an emergency or the consent of more than 51% of the members cannot be obtained after soliciting opinions, the travel agency may decide to change the contents, but it shall provide necessary proof for the decision made.

3. In case of force majeure or unexpected events before the trip, both parties can cancel the trip or postpone the trip through consultation. If the itinerary is cancelled, the travel agency will refund the travel expenses to the tourists in full. Travel expenses, if any, shall be reasonably shared by both parties after consultation.

4. if the contract cannot be continued due to force majeure during the trip, the travel agency will refund the unused travel expenses to the tourists after implementing the changes as agreed in paragraph 2 of this article, and the increased travel expenses shall be reasonably shared by both parties through consultation.

5. in case of unexpected events during the trip, the travel agency will refund the unused travel expenses to the tourists after implementing the changes as agreed in paragraph 2 of this article, so the increased travel expenses will be borne by the party proposing the changes (but the beneficiary will bear the expenses due to emergency avoidance).

Article 11 Assignment of the Contract

With the written consent of the travel agency, a tourist may assign his rights and obligations under the contract to a third person who meets the travel conditions, so the increased expenses shall be borne by the tourist, and the reduced expenses shall be returned to the tourist.

article 12 arrangements for not forming a tour group

when the number of tour groups of travel agencies is less than the number of tour groups, tourists can make an agreement with the travel agency in article 22 of this contract on the following arrangements.

1. Transfer to a tour group: On the premise of ensuring that the promised service content and standard will not be lowered, the travel agency can transfer the tourists to the tour groups formed by other travel agencies with the prior written consent of the tourists, and take responsibility for the behavior of the travel agency that has been transferred out of the tour group in violation of this contract before making compensation. The rights and obligations of this contract shall be terminated if the tourist and the travel agency that has been transferred out of the group sign a separate contract.

2. Postpone the outbound tour and change the route for outbound tour: With the written consent of the tourists, the travel agency can postpone the outbound tour or change other routes for outbound tour, and re-sign the travel contract when necessary, so the increased expenses will be borne by the tourists, and the reduced expenses will be refunded by the travel agency. Thirteenth do not agree to the termination of the contract of transferring the tour group, postponing the tour group and changing the tour route

If the number of tour groups is less than that of the tour group, the tourists neither agree to the transfer of the tour group, nor agree to postpone and change the tour route, it will be regarded as the termination of the contract by the travel agency, and it will be handled according to the relevant agreements in Article 14 and Article 16, paragraph 1 of this contract.

Article 14 Termination of the Contract before the trip

Tourists and travel agencies can propose to terminate the contract in writing before the trip. If the termination of the contract is proposed more than 7 days before departure (calculated by the difference between the departure date and the natural date of arrival of the notice of termination, the same below), both parties shall not be liable for breach of contract. If the travel agency proposes to terminate the contract, it will refund the travel expenses in full; Tourists propose to terminate the contract, and if they have incurred travel expenses, they shall deduct them.
