Provisions on the Supervision and Administration of Food Hygiene at Entry-Exit Ports Chapter II Licensing Administration of Food Production and Business Units
Article 6 Food production and business operation entities shall accept the health supervision of the local inspection and quarantine institutions when building, expanding or rebuilding.

Article 7 Before engaging in port food production and business operation activities, food production and business operation entities shall apply to the local inspection and quarantine institution for the Hygiene Permit for People's Republic of China (PRC) Frontier Port Food Production and Business Operation Entities (hereinafter referred to as the Hygiene Permit, see Annex 1).

Article 8 A food production and business operation entity applying for a hygiene license shall meet the following hygiene conditions:

(1) Having business premises, sanitary environment, sanitary facilities and equipment suitable for food production and business activities;

(2) The catering industry shall formulate operational norms that meet the hygiene and safety requirements of catering processing operations, as well as management systems and responsibility systems to ensure the quality of catering processing operations;

(3) Having a sound health management organization and system;

(four) employees have no infectious diseases that hinder food hygiene and safety;

(five) employees have the common sense of food hygiene and safety that is suitable for their food production and operation.

Article 9 When applying for a hygiene license, a food production and business operation entity shall submit the following materials to the inspection and quarantine institution:

(1) An application for hygiene license;

(2) A copy of the business license (submitted after receiving it);

(three) the internal health management organization, system and organization;

(four) the health certificate of employees and the certificate of health knowledge training;

(five) the plan of the production and business premises and the production process flow chart;

(six) the composition of raw materials, production equipment information, sanitary facilities and product packaging materials;

(seven) food production units to submit production water hygiene inspection report;

(eight) product hygiene standards, product identification, product hygiene inspection results and safety and health control measures;

(9) Other relevant materials that need to be submitted.

Article 10 The inspection and quarantine institution shall examine the application materials as required, determine whether the materials are complete and meet the requirements of relevant regulations, make a decision on acceptance or rejection, and issue a written certificate. If the submitted materials are incomplete or irregular, the applicant shall be informed to make corrections on the spot or within 5 days after acceptance. Fails to inform, since the date of receipt of the application materials is accepted.

After accepting an application from a food production and business operation entity, the inspection and quarantine institution shall examine the application materials and conduct on-site hygiene license evaluation and quantitative scoring in accordance with the provisions of the AQSIQ.

The inspection and quarantine institution shall, according to the results of material review, on-site evaluation and scoring, make a decision on whether to approve or disapprove the food production and business operation entity within 20 days from the date of acceptance (except that the on-site evaluation time does not exceed 1 month at the longest), and issue or serve the hygiene license to the applicant within 10 days from the date of making the decision.

The health permit is valid for 1 year. Where a food production and business operation entity needs to extend the validity period of the hygiene license, it shall apply to the inspection and quarantine institution within 30 days before the expiration of the validity period of the hygiene license.

Article 11 During the validity period of the hygiene license, when a food production and business operation entity changes its production and business operation project, legal person, name change, relocation, reconstruction, expansion or new project, it shall report to the inspection and quarantine institution that made the hygiene license decision.

Article 12 Where a food production and business operation entity suspends its business, it shall go through the cancellation procedures at the inspection and quarantine institution that made the decision on hygiene license and return the hygiene license.

Thirteenth food production and business units to provide food and food products to food production and business units in different places, can hold a valid hygiene license to the local inspection and quarantine institutions for the record.
