Article 1 In order to prevent pollution of the environment caused by the discharge of waste edible fats and oils from the catering industry and food processing industry, as well as secondary pollution of the environment due to improper measures in the process of collecting and treating waste fats and oils, to control the destination of waste fats and oils, to improve and protect the quality of the environment of the city, and to safeguard human health, these measures are formulated in accordance with the relevant laws and regulations, and in the light of the actual situation of the city. Article 2 The waste edible fats and oils (hereinafter referred to as waste fats and oils) referred to in the Measures refers to the catering industry and food processing industry in the process of operation of animal and plant fats and oils that can no longer be consumed, including oil and grease wastewater by the oil-water separator or grease trap separation of inedible fats and oils. Article 3 All enterprises and individual operators engaged in catering (including hotels and canteens), food processing and other discharges of waste oil and grease (hereinafter referred to as the discharging units), as well as all units and individual operators engaged in the collection, processing and treatment of waste oil and grease (hereinafter referred to as the operating units) within the administrative area of the city, are required to comply with these Measures.? Article 4 The administrative department of environmental protection of Huhhot City (hereinafter referred to as the municipal environmental protection department) is responsible for the unified supervision and management of pollution prevention and control of waste oil and grease in the city. The administrative department of environmental protection of flag county (hereinafter referred to as the environmental protection department of flag county) is responsible for the supervision and management of pollution prevention and control of waste oil and grease within its jurisdiction in accordance with the prescribed duties. The administrative departments of health, industry and commerce, public security and cityscape of the city shall, in accordance with their respective duties *** with the prevention and control of pollution of waste oil and grease.? Article 5 emissions unit shall use specially marked with "waste edible oil and grease special" containers holding waste oil and grease, and at the same time should be in accordance with the relevant state regulations, the use of oil-water separator or grease trap and other facilities, effective separation of oil and water. It is prohibited to discharge waste oil and grease and waste water containing waste oil and grease directly into the natural environment. Article 6 Discharging units must implement a declaration and registration system for the discharge of waste oil and grease, and truthfully declare the types, quantities and destinations of waste oil and grease, as well as the facilities and types of facilities to prevent pollution.? Article 7 The operating units must meet the following requirements and accept the daily supervision and management of the municipal environmental protection department:?

(1) organize the preparation of environmental impact assessment documents in accordance with the relevant provisions of the Environmental Impact Assessment Law of the People's Republic of China*** and the State;

(2) supporting the construction of environmental protection facilities must be designed at the same time as the main project, while the construction, and the same time put into operation and use;?

(3) the implementation of the monthly reporting system, the establishment of accounts, on time to collect the amount of waste oil, product oil, sales volume, sales destination truthfully reported to the municipal environmental protection department;?

(4) shall not process the oil and grease and then used or sold as edible oil and grease.? Article 8 emissions unit in violation of these measures, one of the following acts, the municipal environmental protection department shall order it to make corrections within a certain period of time, and impose a fine of 500-3000 yuan:?

(1) Failure to declare and register the discharge of waste oil and grease in accordance with the provisions;?

(2) Failure to discharge waste oil and grease in accordance with the provisions of the oil and water separator or grease trap and other facilities to effectively separate oil and water, and directly discharge waste oil and grease and wastewater containing waste oil and grease into the natural environment;?

(3) sell waste grease to units and individuals not recognized by the municipal environmental protection department.? Article 9 If an operating unit violates these Measures in any of the following acts, the municipal environmental protection department shall order it to make corrections within a certain period of time and impose a fine of RMB 2,000-5,000 yuan for those who do not have any illegal proceeds, and a fine of RMB 5,000-15,000 yuan for those who do have any illegal proceeds:?

(a) not prepared environmental impact assessment documents engaged in waste oil and grease recycling, processing;?

(ii) supporting the construction of environmental protection facilities are not put into trial operation and production at the same time as the main project;?

(C) does not implement the monthly reporting system, do not establish recycling, sales accounts;?

(4) selling waste oil and grease as edible oil and grease.? Article 10 The staff of the relevant administrative departments shall abide by the law and enforce the law impartially, neglect of duty, favoritism, solicitation and acceptance of bribes, perverting the law enforcement, by their units or higher authorities to give administrative sanctions; constitutes a crime, shall be investigated for criminal liability.? Article 11 If the parties concerned are not satisfied with the administrative penalty decision made by the relevant administrative department, they may apply for administrative reconsideration or file an administrative lawsuit according to law; if they neither apply for reconsideration nor file an administrative lawsuit nor fulfill the administrative penalty decision after the expiration of the time limit, the authority that made the penalty decision may apply to the People's Court for compulsory execution according to law. Article XII of these measures by the municipal environmental protection administrative department is responsible for the interpretation of the? Article XIII of these measures since December 15, 2004 shall come into force.
