Article 2 These Measures shall apply to the prevention and control of environmental pollution by solid waste within the administrative area of this province.

These Measures shall apply to the prevention and control of environmental pollution by solid wastes generated in the sea and moved to land. Article 3 People's governments at or above the county level shall formulate targets and measures for the prevention and control of environmental pollution by fixed waste within their administrative areas, incorporate them into environmental protection plans, gradually increase financial input, and be responsible for organizing their implementation.

people's governments at or above the county level shall take measures to encourage and support units that produce solid waste to research, popularize and apply new processes and technologies, reduce the output of solid waste and improve the recycling rate of solid waste.

the municipal people's government should incorporate the construction of facilities and places for centralized storage and disposal of solid waste into the urban construction plan, and build facilities and places for centralized storage and disposal of solid waste that are suitable for urban development. Article 4 The competent administrative department of environmental protection of the people's governments at or above the county level shall exercise unified supervision and management over the prevention and control of environmental pollution by solid waste within their respective administrative areas.

the city appearance and environmental sanitation administrative department of the people's government at or above the county level is responsible for the supervision and management of the cleaning, collection, storage, transportation and disposal of municipal solid waste.

the relevant departments of the people's governments at or above the county level shall supervise and manage the prevention and control of environmental pollution by solid waste within their respective responsibilities. Chapter II Supervision and Management of the Prevention and Control of Environmental Pollution by Solid Waste Article 5 The provincial environmental protection administrative department shall, jointly with relevant departments, formulate technical specifications for the prevention and control of environmental pollution by solid waste according to the needs of social development and economic and technical conditions, and submit them to the provincial people's government for approval before implementation. Article 6 The monitoring of environmental pollution by solid waste shall be undertaken by the environmental monitoring institutions affiliated to the administrative department of environmental protection of the people's governments at or above the county level or the monitoring institutions with corresponding qualifications. Seventh construction projects that produce industrial solid waste or hazardous waste and storage, utilization and disposal of solid waste must comply with the provisions of the state and this province on environmental protection management of construction projects and conduct environmental impact assessment.

for the construction of hazardous waste generation, storage, utilization and disposal projects, an environmental risk assessment chapter must be set in the environmental impact assessment. Article 8 To build production and processing projects with imported solid wastes as raw materials, environmental risks in the process of storage, transportation and utilization of imported solid wastes must be evaluated. Without environmental risk assessment, the relevant departments shall not approve the construction of the project.

if the environmental impact assessment report or environmental risk assessment report is not submitted to the competent administrative department of environmental protection for examination and approval in accordance with the procedures prescribed by the state, the relevant examination and approval authorities shall not approve the construction of the construction project. Article 9 Environmental risk assessment shall be organized and implemented by units with environmental risk assessment qualifications. Without the qualification of environmental risk assessment, environmental risk assessment activities shall not be carried out. Article 11 Before a construction project that produces industrial solid waste, hazardous waste and stores, utilizes and disposes solid waste is put into production and use, the construction unit must apply to the competent administrative department of environmental protection that originally examined and approved the environmental impact assessment report or environmental risk assessment report for acceptance. Qualified acceptance, issued a certificate; Without experience or unqualified acceptance, it shall not be put into production or use. Eleventh units that produce industrial solid waste or hazardous waste must declare and register according to law. After the declaration and registration, if there are major changes in the types and quantities of the original application for registration, it is necessary to apply to the original declaration and registration authority for registration of change fifteen days in advance; If the discharge of industrial solid waste or hazardous waste has changed significantly due to sudden reasons, it must be reported to the competent administrative department of environmental protection within 12 hours after the change. Article 12 The construction of facilities and sites for the prevention and control of environmental pollution by solid waste shall conform to the relevant national construction standards and norms, and can only be put into use after passing the acceptance by the competent administrative department of environmental protection.

the competent administrative department of environmental protection and the competent administrative department of city appearance and environmental sanitation shall supervise the construction and operation of facilities and places for the prevention and control of environmental pollution by solid waste within their respective functions and duties. Thirteenth provincial environmental protection administrative department in conjunction with the provincial quality and technical supervision department is responsible for organizing the use of solid waste pollution prevention and control equipment performance recognition.

no unit or individual may produce, sell or use unauthorized solid waste pollution prevention and control equipment. Chapter III General Provisions for the Prevention and Control of Environmental Pollution by Solid Waste Article 14 The competent administrative department of environmental protection of the people's government at or above the county level shall order the units that produce solid waste that can be used by themselves, but do not use it and do not provide it to others for use, or provide it to the units that have the conditions for use free of charge. Fifteenth it is forbidden to transfer solid waste to units without pollution prevention facilities and places for collection, transportation, storage, utilization and disposal.

if the solid waste is transferred to a unit with pollution prevention facilities and places for collection, transportation, storage, utilization and disposal, the rights and obligations of both parties in the prevention and control of solid waste pollution must be clearly defined.
