2. Working people are not considered illegal, but the employer is illegal to employ child labor (except for special cases such as arts and culture, sports and so on as stipulated by the law), and the employer is subject to punishment;
3. Article 15 of the Labor Law of the People's Republic of China*** and the State of China stipulates that, "It is forbidden for an employer to employ a minors under the age of sixteen."
Article 2 of the Regulations on the Prohibition of the Use of Child Labor (State Council Decree No. 364) stipulates, "State organs, social organizations, enterprises and institutions, private non-enterprise units or individual industrial and commercial households shall not employ minors under the age of 16." The above two laws are prohibited line provisions, then the employer once the violation, will certainly incur certain legal consequences.
