Article 1 In order to strengthen the management of kitchen waste, improve the living environment, and ensure food safety and public health, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of Urban Appearance and Environmental Sanitation and the Regulations on the Administration of Urban and Rural Appearance and Environmental Sanitation of Hainan Province, and combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the generation, collection, transportation, disposal and related supervision and management activities of kitchen waste within the administrative area of this Municipality. Article 3 The term "kitchen waste" as mentioned in these Provisions refers to food residue, food processing waste and waste edible oil produced by catering operators and unit canteens (hereinafter referred to as kitchen waste producers) in food processing, catering service, unit feeding and other activities.

The waste edible oils and fats mentioned in the preceding paragraph refer to animal and vegetable oils and fats that can no longer be eaten and various oil-water mixtures. Article 4 The management of kitchen waste shall follow the principles of reduction, recycling and harmlessness.

Units and individuals should actively participate in the green life action, develop a civilized, healthy and environmentally friendly lifestyle, and reduce the amount of kitchen waste from the source.

Encourage and support the scientific research and process improvement of kitchen waste treatment, and promote the resource utilization and harmless treatment of kitchen waste. Article 5 The municipal and district people's governments shall strengthen the leadership, organization and coordination of the management of kitchen waste, establish a stable financial input guarantee mechanism, and incorporate relevant funds into the fiscal budget at the corresponding level.

The municipal environmental sanitation department is responsible for the supervision and management of the city's kitchen waste. The district sanitation department shall do a good job in the daily supervision and management of kitchen waste within its jurisdiction.

The competent department of ecological environment is responsible for the supervision and management of the prevention and control of environmental pollution in the process of generation, collection, transportation and disposal of kitchen waste.

Development and reform, finance, natural resources and planning, market supervision and management, tourism culture, commerce, water affairs, agriculture and rural areas, public security, comprehensive administrative law enforcement and other relevant departments shall, according to their respective functions and duties, do a good job in the supervision and management of kitchen waste.

The catering industry association shall play the role of industry self-discipline and assist relevant departments to do a good job in the supervision and management of kitchen waste.

Yucai Ecological Zone Management Committee shall determine the specific department responsible for the daily supervision and management of kitchen waste within its jurisdiction. Article 6 The Municipal People's Government and its relevant departments shall, according to the land and space planning and relevant special planning, make overall plans for the construction of kitchen waste collection, transportation and disposal facilities, and ensure the land for collection, transportation and disposal facilities. The municipal environmental sanitation department may, according to the management needs and in accordance with the provisions of laws and regulations, grant different kitchen waste collection, transportation and disposal service enterprises to operate. Article 8 The municipal environmental sanitation department may, according to the needs of economic and social development, and the franchise project suggestions put forward by relevant legal persons and other organizations, put forward the franchise implementation plan for the collection, transportation and disposal of kitchen waste.

The municipal environmental sanitation department may entrust a third-party organization with corresponding ability and experience to carry out the feasibility assessment of franchising, and improve the implementation plan of franchising for the collection, transportation and disposal of kitchen waste. Need the government to provide feasibility gap subsidies, the municipal finance department is responsible for carrying out related work.

The municipal competent department of environmental sanitation shall, jointly with relevant departments, review the implementation plan of the franchise for the collection, transportation and disposal of kitchen waste. Relevant departments shall issue written examination opinions respectively according to their duties.

The municipal competent department of environmental sanitation shall comprehensively review the written opinions of the relevant departments and report to the Municipal People's Government for approval of the implementation plan of the franchise for the collection, transportation and disposal of kitchen waste. Article 9 The municipal competent department of environmental sanitation shall, according to the approved franchise implementation plan for kitchen waste collection, transportation and disposal projects, select franchisees through competitive means such as bidding, and sign franchise agreements with franchisees selected according to law.

If a project company needs to be established, the municipal environmental sanitation department shall sign a preliminary agreement with the investors selected according to law, stipulate to register and establish the project company within the prescribed time limit, and sign a franchise agreement with the project company.

The franchise agreement shall include the project name, content, franchise mode, region, scope and duration, registered capital, investment mode and equity transfer of the project company, service quantity, quality and standard, methods, standards and adjustment procedures for determining prices and charges, government commitments and guarantees, monitoring and evaluation, performance guarantee, liability for breach of contract, etc.

If it is necessary to continue to operate after the expiration of the franchise period, the kitchen waste collection, transportation and disposal service enterprise shall apply to the municipal environmental sanitation department for extension 30 days before the expiration of the franchise period. If the municipal sanitation department agrees to extend the period after full evaluation and demonstration, it shall re-sign a franchise agreement with the kitchen waste collection, transportation and disposal service enterprise. Article 10 An enterprise engaged in the collection, transportation and disposal of kitchen waste shall obtain a license for the collection, transportation and disposal of kitchen waste according to law.

The municipal sanitation department shall issue service licenses for the collection, transportation and disposal of kitchen waste to qualified enterprises according to law, and promptly announce to the public the list of enterprises that have obtained service licenses. Article 11 An enterprise applying for a license for the collection and transportation of kitchen waste shall meet the following conditions:

(1) Having the qualification of an enterprise legal person;

(2) Having a legal road transport business license and vehicle driving license;

(3) Having a fixed office space, mechanical equipment and parking places for vehicles;

(four) equipped with special collection containers to meet the needs of kitchen waste collection and transportation;

(five) equipped with fully enclosed automatic unloading vehicles that meet the requirements of kitchen waste collection and transportation, and installed driving and loading and unloading recorders;

(six) a sound management system of technology, quality, safety and monitoring;

(seven) other conditions stipulated by laws and regulations.
