The signboard setting mentioned in these Regulations refers to the behavior of enterprises, institutions and individual industrial and commercial households to set up plaques, light boxes, neon lights and font symbols. Indicate the name, trade name, logo or building name outside the owned or leased building or within the scope of legal land use. Article 4 The comprehensive administrative law enforcement departments of cities and counties (cities, districts) shall be responsible for the supervision and management of outdoor advertisements and signboards within their respective administrative areas.
The competent departments of public security, environmental protection, urban and rural construction, urban and rural planning, transportation, market supervision and management shall, in accordance with their respective responsibilities, coordinate in the supervision and management of outdoor advertising and signboard setting.
The Town People's Government and the sub-district offices shall assist in the daily supervision and management of outdoor advertisements and signboards within their respective jurisdictions. Article 5 The people's governments of cities and counties (cities, districts) shall establish an information platform for setting up outdoor advertisements and signboards, and incorporate relevant information such as outdoor advertisement setting planning, technical specifications for setting up outdoor advertisements and signboards (hereinafter referred to as technical specifications for setting up), permission, filing and punishment into the government service system to realize information sharing. Article 6 The contents of outdoor advertisements shall conform to the provisions of relevant laws and regulations. Chapter II Planning and Standardization Article 7 The municipal comprehensive administrative law enforcement department shall, jointly with relevant departments, formulate the urban outdoor advertising plan, which shall be promulgated and implemented after being approved by the Municipal People's Government.
County (city) comprehensive administrative law enforcement departments shall, jointly with relevant departments, formulate outdoor advertising planning within their respective administrative areas, and report it to the people's government at the corresponding level for approval before promulgation and implementation.
Outdoor advertising planning in Jiaxing Port Area shall be formulated and published by Jiaxing Port Area Management Committee.
Outdoor advertising planning needs to be revised, it should be implemented in accordance with the original preparation and approval procedures. Eighth outdoor advertising planning should determine the detailed planning of outdoor advertising classification control areas and important lots and blocks, and plan an appropriate number of public service advertising spaces.
Detailed planning of outdoor advertisements in important locations and key blocks shall include the quantity, location, form and specifications of outdoor advertisements.
The setting of outdoor advertising shall conform to the planning of outdoor advertising. Ninth city comprehensive administrative law enforcement departments shall, jointly with relevant departments, formulate and set up technical specifications, which shall be promulgated and implemented after being approved according to law.
The installation of outdoor advertisements and signboards shall conform to the technical specifications for installation. Tenth outdoor advertising planning, setting technical specifications, should be taken to the public notice, hearings, symposiums, demonstration meetings and other forms, to solicit opinions from the public, relevant industry associations, experts and so on. The time limit for soliciting opinions through public announcement shall not be less than 30 days. Eleventh it is forbidden to set up outdoor advertisements in the following areas and places:
(1) Dangerous buildings and illegal buildings;
(2) the top of the building;
(3) Traffic monitoring facilities;
(four) areas and places that hinder the safe sight distance or affect the safe passage;
(five) other areas and places prohibited by the people's governments of cities and counties (cities, districts);
(six) other areas and places prohibited by laws, regulations and rules. Article 12 The assignment of the right to use municipal public resources for setting up outdoor advertisements shall conform to the planning for setting up outdoor advertisements, and shall be conducted by means of bidding and auction according to law. Chapter III Licensing and Filing Article 13 An administrative license shall be obtained from the comprehensive administrative law enforcement department for setting up large-scale outdoor advertising facilities. In accordance with the law, the administrative license shall be implemented by two or more departments respectively, and shall be handled by the comprehensive administrative law enforcement department after informing the relevant departments to put forward their opinions.
Where a relatively centralized administrative license is implemented, the administrative license shall be implemented by the department exercising the relatively centralized administrative examination and approval power.
The standards for large-scale outdoor advertisements shall be formulated by the municipal comprehensive administrative law enforcement department, and shall be promulgated and implemented after being reported and approved according to law. Article 14 To apply for permission to set up large-scale outdoor advertising facilities, the following materials shall be submitted:
(1) An application form for setting up large-scale outdoor advertising facilities;
(2) Business license or other legal and valid qualification certificates;
(3) Schematic diagram and renderings of large-scale outdoor advertising facilities;
(four) documents such as the agreement on the right to use the carrier of large outdoor advertising facilities;
(5) Other materials as prescribed by laws and regulations. Fifteenth for holding cultural, tourism, sports, public welfare activities or fairs, fairs and other needs to set up temporary large-scale outdoor advertising facilities, it should apply to the comprehensive administrative law enforcement departments for administrative license.
To apply for the establishment of temporary large-scale outdoor advertising facilities, the following materials shall be submitted:
(1) An application form for setting up temporary large-scale outdoor advertising facilities;
(2) Business license or other legal and valid qualification certificates;
(three) a written explanation of the form, scope and duration of the temporary large-scale outdoor advertising facilities;
(4) Other materials as prescribed by laws and regulations.
The comprehensive administrative law enforcement department shall make a decision on whether to approve the license within five working days from the date of acceptance.
