In order to implement the "General Office of the State Council forwarded to the Ministry of Construction and other departments on the engineering survey and design units of the institutional reform of a number of opinions of the notice" ( State Office of the State Council [1999] No. 101), adjust the engineering survey and design charges, standardize the engineering survey and design charges, the State Planning Commission, the Ministry of Construction formulated the "Engineering Survey and Design Charges Management Provisions" (hereinafter referred to as the "Provisions"), is hereby issued, March 1, 2002 shall come into force. The former State Price Bureau, the Ministry of Construction issued "on the release of engineering survey and engineering design charges notice" ([1992] Price and Fees No. 375) and the relevant annexes are repealed at the same time.
Prior to the implementation of these Regulations, if more than 50% of the workload of the contract for engineering survey or engineering design of the construction project has been completed, the survey and design charges shall still be implemented according to the original contract; if less than 50% of the workload of the contract for engineering survey or engineering design has been completed, the survey and design charges for the uncompleted portion of the work shall be negotiated and resolved by the contractor and the surveyor and the designer with reference to the present Regulations.

Article 1 In order to standardize the behavior of the engineering survey and design charges, and to safeguard the lawful rights and interests of the Contractor and the surveyor, the designer, in accordance with the "People's Republic of China *** and the State Price Law" and the relevant laws and regulations, the formulation of these provisions. Article 2 The provisions of this regulation and the "engineering investigation charges" and "engineering design charges", applicable to the Chinese people's *** and the State of construction projects within the scope of engineering investigation and engineering design charges.
Article 3 The contracting and contracting of engineering survey and design shall follow the principles of openness, fairness, impartiality, voluntariness and honesty and credit. Article 7 engineering investigation and engineering design fees, shall reflect the principle of quality and price. Article 8 The surveyor and designer shall, in accordance with the Provisions on the Implementation of Marking Prices for Commodities and Services, inform the contractor of the relevant service items, service contents, service quality, basis for charging, and charging standards.
Article 9 The amount of the engineering survey fee and the engineering design fee, as well as the method of payment, shall be agreed upon by the contractor, the surveyor and the designer in the Engineering Survey Contract or the Engineering Design Contract.
Article 10 The survey documents or design documents provided by the surveyor or designer shall symbolize the engineering and technical quality standards stipulated by the State and meet the content, quality and other requirements agreed in the contract. If the workload of the engineering survey or engineering design increases or the engineering survey site stops or the work is suspended due to the reasons of the contractor, the contractor shall pay the corresponding engineering survey fee or engineering design fee to the surveyor or the designer.
Article 12 of the engineering survey or engineering design quality does not meet the provisions of article 10, the surveyor or designer shall rework. Due to rework increased workload, the contractor does not pay the engineering survey or engineering design fees. Due to the surveyor or designer work errors to the contractor caused economic loss, shall bear the responsibility of compensation in accordance with the contract.
Article 13 The surveyor or designer shall not deceive the contractor or collude with the contractor to overcharge the engineering survey fee or engineering design fee by increasing the amount of engineering survey work or raising the engineering design standard.
Article XIV violation of the provisions of this regulation and the state's relevant price laws and regulations, by the competent government departments in charge of prices in accordance with the "Chinese People's **** and the State Price Law", "price violations of the provisions of the administrative penalties" shall be punished.
Article 15 These Provisions and the attached "Engineering Survey Charges" and "Engineering Design Charges" shall be interpreted by the State Development Planning Commission.
Article XVI of the provisions of this March 1, 2002 shall come into force.
Engineering Design Charges
1 General Principles
1.0.1 Engineering Design Charges refers to the charges for the services provided by the designer for the preparation of preliminary design documents, construction drawings design documents, non-standard design documents, construction drawings budget documents, and as-built drawings documents of the construction project according to the commission of the contractor.
1.0.2 Engineering design fees to take in accordance with the estimated investment in a single project of the construction project graded flat rate billing method of calculating charges. The method of calculating charges for railway engineering design is specified in the chapter on Transportation Engineering.
1.0.3 Engineering design charges are calculated in accordance with the following formula
1 Engineering design charges = engineering design charges base price × (1 ± fluctuation value)
2 Engineering design charges base price = basic design charges + other design charges
3 Basic design charges = engineering design charges base price × professional adjustment coefficient × engineering complexity adjustment factor × additional adjustment factor. Coefficient × additional adjustment factor.
1.0.4 Engineering design fee base price
Engineering design fee base price is the engineering design base fee calculated according to this fee standard. The Contractor and the Designer shall negotiate the contract amount of the Engineering Design Fee within the specified fluctuation range according to the actual situation.
1.0.5 Basic Design Charge
Basic design charge refers to the fee charged for the preparation of preliminary design documents and construction drawing design documents in the engineering design, and accordingly provide services such as designing technical submission, solving the technical problems of designing in the construction, and taking part in the trial test and acceptance of the completion of the project.
1.0.6 Other design fees
Other design fees refer to the fees charged for providing related services according to the actual needs of engineering design or the requirements of the contractor, including the overall design fee, the main body of the design coordination fee, the use of standard design and reuse of design fees, the preparation of non-standard equipment design documents, the preparation of construction budgets, the preparation of as-built drawings and so on.
1.0.7 Engineering Design Fee Billing Amount
Engineering Design Fee Billing Amount is the sum of the construction and installation cost, equipment and apparatus purchase cost and joint commissioning cost in the approved preliminary design estimate of the construction project.
Projects have the use of original equipment, to sign the engineering design contract with the current price of similar equipment as the engineering design fees billing amount; project has slow to match the equipment, but in accordance with the contract requirements to match the equipment to carry out the engineering design and achieve the installation of equipment and process conditions, with the current price of the equipment to match the billing amount of the engineering design fees; project has the introduction of equipment, in accordance with the purchase of equipment, the cost of the conversion of the f.o.b. price of equipment into the f.o.b. price, the price of the equipment. 1.0.9 Adjustment coefficients of engineering design charges
The adjustment coefficients of engineering design charges include: professional adjustment coefficient, engineering complexity adjustment coefficient and additional adjustment coefficient.

1.0.10 Non-standard equipment design charges are calculated in accordance with the following formula
Non-standard equipment design charges = non-standard equipment taxable amount x non-standard equipment design rate
Non-standard equipment taxable amount is the preliminary design estimate for non-standard equipment. The non-standard equipment design rate is found in, "Non-Standard Equipment Design Rate Table" (Exhibit III) to determine.
1.0.11 If the process design, civil as well as utility engineering design, preliminary design and construction drawing design are commissioned separately, the engineering design charge is calculated in proportion to its share of the design workload for basic services.
1.0.12 For the design projects of alteration, expansion and technological transformation, the additional adjustment coefficient is 1.1-1.4. Appropriate additional adjustment coefficients are determined according to the degree of complexity of the engineering design, and the engineering design charges are calculated.
1.0.13 Before the preliminary design, if it is necessary to prepare the overall design according to the provisions of the technical standards or at the request of the Contractor, the overall design fee shall be added according to 5% of the basic design fee of the construction project.
1.0.14 Where the engineering design of a construction project is undertaken by two or more designers, the designer who is responsible for the reasonableness and wholeness of the engineering design of the construction project shall be charged an additional fee for the coordination of the main design at the rate of 5% of the charge for the basic design of that construction project.
1.0.15 If the engineering design adopts the standard design or the reused design, the charge shall be calculated according to 30% of the basic design charge for the similar new construction project; if it is necessary to carry out the basic design afresh, the charge shall be calculated according to 40% of the basic design charge for the similar new construction project; if it is necessary to make partial modification of the original design, the engineering design charge shall be negotiated and determined by the Contractor and the designer according to the design workload.
1.0.16 For the preparation of construction drawing budget, the construction drawing budgeting fee shall be charged at 10% of the basic design fee for the construction project; for the preparation of as-built drawings, the as-built drawing preparation fee shall be charged at 8% of the basic design fee for the construction project.
1.0.17 If the designer's own patent or proprietary technology is used in the engineering design, the charges for the patent and proprietary technology shall be negotiated between the Contractor and the designer.
1.0.18 If the introduced technology in the engineering design requires the cooperation of the domestic designer in the design, or if the design needs to be carried out by the domestic designer in accordance with the overseas design procedures and technical quality requirements, the engineering design charges shall be determined by negotiation between the Contractor and the designer on the basis of the actual design workload incurred and with reference to the present standards.
1.0.19 If the design documents are provided by overseas designers and need to be examined and signed by the domestic designer in accordance with the national standards and norms, the examination and confirmation fee shall be determined by negotiation in accordance with the principle of international reciprocity or the actual workload incurred.
1.0.20 The standard number of copies of design documents provided by the designer shall be 10 copies for preliminary design and overall design, and 8 copies for construction drawings, non-standard equipment design, construction budget and as-built drawings. If the Contractor requires an increase in the number of copies of design objects, the Contractor shall separately pay the labor cost of printing the design documents. If it is necessary to purchase standard design drawings in the engineering design, the contractor shall pay the cost of purchasing drawings
1.0.21 This fee schedule does not include other service charges other than those in 1.0.1 of this General Conditions. Charges for other services shall be implemented in accordance with the provisions of the State where such charges are stipulated; where the State does not stipulate such charges, they shall be determined by negotiation between the Contractor and the Designer.
