The food and drug supervision and administration department of the people's government at or above the county level shall be responsible for the supervision and management of the production and business activities of small workshops within their respective administrative areas. ?
Health, quality and technical supervision, industry and commerce, urban management, public security and other departments shall, in accordance with their respective responsibilities, supervise and manage the production and business activities of small workshops. ?
The people's government of a township (town) and the subdistrict office shall define the organization and arrange personnel to assist the food and drug supervision and management departments in the supervision and management of small workshops within their respective jurisdictions. ? Article 4 Small workshops engaged in food production and operation shall go through industrial and commercial registration and file with the local food and drug supervision and administration department within 15 days after industrial and commercial registration. ?
Small workshops shall submit the following materials to the food and drug supervision and administration department for the record:
(1) A copy of the business license; ?
(2) The original and photocopy of the sponsor's ID card; ?
(three) the original and photocopy of the valid health certificate of the employees; ?
(four) the plan of the production and processing site and the certificate of the right to use it; ?
(five) a copy of the food safety standards (if there is no food safety standard, the requirements for food raw materials shall be provided), production process flow chart, packaging form and other processing technical specifications; ?
(6) A letter of commitment on quality and safety. ?
The food and drug supervision and administration department shall promptly announce the filing of small workshops to the public, and notify other supervision and administration departments and the township (town) people's government and sub-district offices where small workshops are located. ? Article 5 Small workshops engaged in food production and marketing activities shall meet the following requirements:
(1) There are fixed places such as food raw material handling, food production, packaging and storage that are suitable for the variety and quantity of food it produces and meet the food safety requirements. The ground and walls should be flat and hard, and easy to clean and disinfect; ?
(two) keep a safe distance from toxic and harmful places and other pollution sources, and no small workshops shall be set up within 25 meters around the pollution sources such as livestock and poultry breeding places, garbage stations, public toilets and chemical enterprises; ?
(3) Having corresponding dust-proof, rodent-proof, mosquito-proof, fly-proof, insect-proof and garbage and waste storage equipment and facilities, and being able to properly handle garbage and waste; ?
(four) the production and operation equipment, facilities, production technology and technology meet the requirements and regulations of food safety; ?
(five) the production and business operation area and the living area are separated according to the requirements of ensuring food safety; ?
(6) Having production and management personnel and management systems to ensure food safety; ?
(seven) other requirements stipulated by laws, regulations, rules and standards formulated by the state and this province. ? Article 6 Small workshops are prohibited from producing and selling the following foods:
(1) Foods produced with non-food raw materials or foods with chemicals other than food additives or other substances that may be harmful to human health; ?
(2) Foods produced from recycled foods; ?
(3) Pathogenic microorganisms, pesticide residues, veterinary drug residues, biotoxins, heavy metals and other substances harmful to human health exceed the food safety standards; ?
(four) food that is spoiled, rancid, moldy, unclean, adulterated or has abnormal sensory properties; ?
(5) Food produced by poultry, livestock, beasts and aquatic animals that have died of illness, poisoning or unknown causes; ?
(6) Food produced from meat that has not passed inspection and quarantine or is unqualified in inspection and quarantine; ?
(seven) high-risk food varieties such as infant formula food, special dietary food, formula food for special medical purposes, health food, dairy products and canned food; ?
(eight) food contaminated by packaging materials, containers, means of transport, etc. ; ?
(nine) commissioned or disguised commissioned, disguised packaging production and operation of food; ?
(ten) other foods prohibited by the state and the province. ? Seventh small workshops prohibit the production and operation of food varieties directory, formulated by the provincial food and drug supervision and management departments and announced to the public. ?
The food and drug supervision and administration departments of cities, counties and autonomous counties may, according to the results of food safety supervision and sampling inspection and food safety risk assessment, increase the varieties of food that are prohibited from being produced and operated by small workshops within their respective administrative areas, announce them to the public after approval by the local people's government, and report them to the food and drug supervision and administration department of the province for the record. ?
