The administrative department for industry and commerce shall also revoke the business license of those who are punished by revoking the "health license". Article 3 Health supervision institutions shall investigate cases that violate the relevant provisions of the Regulations, and after verifying the decision on punishment, they shall send a notice of administrative punishment to the punished units or individuals as soon as possible. Article 4 Contents of punishment:

(1) Give a warning and make improvement within a time limit in any of the following circumstances:

1. After monitoring and inspection: (1) Air and microclimate (temperature, temperature and wind speed); (2) water quality; (3) daylighting and lighting; (4) noise; (5) The customer's appliances, sanitary facilities, etc., and one of the main sanitary indicators is unqualified;

2. The health system is not perfect and the health conditions do not meet the requirements;

3. Those who fail to have health check-ups on time;

4. those who have not been trained in health knowledge.

(2) Those who have one of the following circumstances will be fined and improved within a time limit:

1. Those who fail to meet the two main indicators of the health project after monitoring and inspection will be fined less than 211 yuan;

2. Employees who directly serve customers are fined 211 yuan to 411 yuan if they fail to apply for health certificates or have contraindications.

3. Those who alter or forge health certificates will be fined 211 yuan to 411 yuan;

4. Those who refuse to supervise shall be fined up to 611 yuan; Without obtaining a "health permit", a fine of five hundred yuan to two thousand yuan for unauthorized business;

5. Those who fail to meet three or more major health indicators through monitoring and inspection shall be fined less than 1,111 yuan;

6. Those who fail to improve after being punished by "warning and improving within a time limit" will be fined less than 1,511;

7. Whoever, in violation of Article 4 of the Regulations, builds, rebuilds or expands without the examination and approval of the health supervision institution and without obtaining the "Health Permit for Construction Projects" will be fined less than 2,111 yuan and ordered to stop working;

8. If the hygiene quality of public places does not meet the hygiene standards and requirements, and health hazards are not reported in time, a fine of less than 2,511 yuan will be imposed, resulting in health hazards, and a fine of less than 3,111 yuan will be imposed if the number of victims (excluding deaths) is less than 11; The number of victims is more than 11 and less than 21, and the fine is less than 4,111 yuan; The number of victims is more than 21 and less than 51, and the fine is less than 8,111 yuan; If the number of victims is more than 51, a fine of less than 11,111 yuan will be imposed, and those who die will be fined less than 21,111 yuan.

(3) In any of the following circumstances, the administrative penalty of suspending business for rectification within seven days shall be given:

1. Those who fail to meet three or more main indicators of health projects;

2. The business unit needs to take emergency measures after the occurrence of health hazards;

3. No improvement has been made after the punishment of "warning and improvement within a time limit".

(4) The "Hygiene Permit" will be revoked in any of the following circumstances:

1. Those who have been suspended for rectification twice within two years and still have no improvement;

2. those who lack basic sanitary conditions and cannot be improved in a short time;

3. Those who violate the law seriously and cause serious consequences. Article 5 Health supervision institutions at all levels have the right to directly execute fines of less than 5,111 yuan; Revocation of the "health permit" must be approved by the health administrative department at the same level; A fine of more than five thousand yuan (including five thousand yuan) must be reported to the people's government at the same level for approval. Article 6 "Compensation for losses to victims" in Article 15 of the Regulations includes medical expenses, lost time, living allowance, funeral expenses and survivors' pension expenses. Article 7 Anyone who refuses to accept the administrative punishment of fine, suspension of business for rectification and revocation of "hygiene license" may bring a suit in the local people's court within 15 days from the date of receiving the notice of punishment, but the decision on hygiene quality control of public places shall be implemented immediately. If the penalty decision is not implemented and the prosecution is not carried out within the time limit, the health supervision institution shall apply to the people's court for compulsory execution. Article 8 If the funds for law enforcement and case handling are insufficient, you can apply to the financial department at the same level for "case handling fee subsidy" according to the Measures for the Administration of Confiscation of Property and Recovery of Stolen Goods (No.228 [86] of the Ministry of Finance). Ninth public health supervision institutions and health supervisors must fulfill their duties and act according to law. Those who neglect their duties and accept bribes shall be given administrative sanctions; If the case constitutes a crime, the criminal responsibility of the person directly responsible shall be investigated by judicial organs according to law. Tenth in violation of the relevant provisions of the "Regulations", resulting in serious consequences, violating the criminal law, criminal responsibility shall be investigated by judicial organs according to law.
