Article 2 In the administrative area of Weihai City (hereinafter referred to as this Municipality), the supervision and management of the quality inspection activities of construction projects shall abide by these Detailed Rules.
The quality inspection of construction projects referred to in these Detailed Rules (hereinafter referred to as quality inspection) means that the engineering quality inspection agency (hereinafter referred to as the inspection agency) accepts the entrustment to conduct sampling inspection on the structural safety and main functional items involving housing construction and municipal infrastructure, and witness sampling inspection on the building materials and building components entering the construction site.
Third Weihai Municipal Construction Committee (hereinafter referred to as the Municipal Construction Committee) is responsible for the supervision and management of the quality inspection activities of the city's construction projects. Municipalities (districts) construction administrative departments shall be responsible for the supervision and management of construction engineering quality inspection activities within their respective administrative areas.
Weihai Construction Engineering Quality and Cost Supervision and Management Station (hereinafter referred to as Weihai Quality Supervision Station) is responsible for the specific work of qualification examination and approval and filing of construction engineering quality inspection institutions in the whole city, and conducts supervision and inspection on inspection activities. The municipal (district) construction engineering quality supervision institution under the construction administrative department is responsible for the supervision and inspection of testing activities within its administrative area.
Article 4 A testing institution is an intermediary institution with independent legal personality. A testing institution engaged in the quality testing business specified in Annex I to these Rules shall obtain the qualification certificate issued by Shandong Construction Engineering Administration Bureau (hereinafter referred to as the Provincial Construction Administration Bureau).
The qualification of testing institutions can be divided into the qualification of special testing institutions and the qualification of witness sampling testing institutions according to the content of testing business undertaken by them (see Annex II for the qualification standards of testing institutions). A testing institution that has not obtained the corresponding qualification certificate shall not undertake the quality testing business specified in Annex 1 of these Rules.
Where an inspection unit engages in engineering quality inspection beyond the scope specified in Annex 1 of these Rules, it shall apply to Weihai Quality Supervision Station for filing. If the inspection report is not filed or fails to pass the filing, it shall not be used as the technical data for completion.
chapter two
Article 5 A testing institution applying for testing qualification shall submit the following application materials:
(1) An application form for qualification of testing institutions in triplicate;
(2) The original and photocopy of the business license;
(3) The composition of shareholders and the original and photocopy of the capital verification certificate;
(four) the original and photocopy of the metrological certification certificate corresponding to the scope of application for testing qualification;
(5) List of main testing instruments and equipment, metrological verification certificate and certificate of fixed office space;
(six) the original and photocopy of the technical personnel's professional title certificate, ID card, training certificate, labor contract and social insurance certificate;
(seven) the management system and quality control measures of testing institutions;
(8) All application materials shall be in written and electronic form.
Testing institutions that have passed the examination will be reported to the Provincial Construction Management Bureau.
Testing units applying for testing other than testing qualification shall submit filing management application materials to Weihai Quality Supervision Station with reference to the above requirements.
The metrological certification certificate of the testing institution must be exactly the same as the unit name on the industrial and commercial business license. The copy submitted by the testing institution must be stamped with the official seal of the unit.
The professional scope of technical personnel training should cover the projects for which testing institutions apply for qualification, which meets the actual needs of testing work.
The Application Form for Qualification of Testing Institutions adopts the format formulated by the Ministry of Construction. Eligible applicants can download from the website of the Ministry of Construction.
Article 6 A testing institution may apply for one or more of the four special testing qualifications listed in Annex I, with a registered capital of not less than 1 10,000 yuan. The registered capital for applying for witness sampling and testing qualification is not less than 800,000 yuan; If a testing institution applies for special testing qualification and witness sampling testing qualification at the same time, its registered capital shall not be less than 654.38 yuan+800,000 yuan.
Article 7 After accepting the application materials, the Municipal Construction Committee shall review the application materials according to the standards specified in Annex 1 2, and sign the review results on the Application Form for Qualification of Testing Institutions.
After receiving the applicant's application materials, the Municipal Construction Committee shall verify whether the results meet the standards within 20 working days, and report them to the Provincial Construction Management Bureau if they meet the standards. Do not meet the standards, it shall issue a written notice to inform the applicant.
Article 8 The qualification certificates of testing institutions shall be uniformly produced, numbered and distributed by the Provincial Construction Management Bureau, indicating the testing business scope, and divided into originals and duplicates, which have the same legal effect.
The validity period of the qualification certificate of the testing institution is 3 years. If the expiration of the qualification certificate needs to be extended, the testing institution shall apply to the Municipal Construction Committee for qualification review 60 working days before the expiration of the qualification certificate, and apply to the Provincial Construction Management Bureau for extension 30 working days after passing the review. If the qualification certificate expires without review or application for extension, it shall be deemed as giving up the qualification and shall not continue to engage in testing activities in Weihai.
If the testing institution has no one of the following acts within the validity period of the qualification certificate, when the validity period of the qualification certificate expires, the validity period of the qualification certificate will be extended for 3 years with the consent of the Provincial Construction Management Bureau, and the original examination and approval department will affix a special seal for extension on the copy of the qualification certificate.
If a testing institution commits one of the following acts within the validity period of the qualification certificate, the original examination and approval department shall not extend it. After the expiration of the validity period, the qualification certificate shall be invalidated automatically, and the qualification shall not be applied for within one year:
(a) beyond the scope of qualification to engage in testing activities;
(2) Subcontracting testing business;
(three) alter, resell, lease, lend or illegally transfer the qualification certificate in other forms;
(four) not in accordance with the relevant national mandatory standards for engineering construction testing, resulting in quality and safety accidents or accidents caused losses;
(5) Forging test data and issuing false test reports or expert conclusions;
(6) Malicious price cuts disrupt market order.
Article 9 A testing institution shall not have subordinate relations or other interest relations with administrative organs, organizations authorized by laws and regulations to manage public affairs, and design units, construction units and supervision units related to testing projects.
Chapter III Responsibilities and Obligations
Tenth testing institutions and legal representatives are responsible for the authenticity of qualification application materials, and are responsible for the integrity, accuracy and authenticity of testing reports and testing data.
Engineering quality acceptance data should be the original test report. If the original test report is lost and a copy of the test report is needed, it shall be rechecked by the original testing institution. After confirmation, it shall be signed by the quality director of the testing organization and stamped with the special seal for testing.
Eleventh no unit or individual may alter, resell, lease, lend or illegally transfer the qualification certificate in other forms.
If the testing organization changes its name, address, legal representative and technical person in charge, it shall notify Weihai Construction Committee within 1 month, and go through the change formalities with the original examination and approval authority within 3 months.
In the event of reorganization, division or merger of testing institutions, the testing qualification shall be re-approved in accordance with the application and approval procedures stipulated in these Rules.
If the testing institution is dissolved, it shall return the qualification certificate to the original issuing authority for cancellation within one month.
Twelfth testing institutions shall establish separate accounts for unqualified projects and report to the engineering quality supervision institutions where the projects are located every month. The testing institution shall, within 24 hours, report the behaviors of the construction unit, supervision unit and construction unit found in the testing process in violation of relevant laws and regulations and mandatory standards for engineering construction, and the unqualified results related to structural safety testing to the construction administrative department where the project is located.
Thirteenth testing institutions shall establish a testing information management system, and the mechanical properties of concrete, cement and steel bars must be automatically collected, and networked with local engineering quality supervision stations and Weihai quality supervision stations to realize data sharing.
Weihai Quality Supervision Station should be able to inquire about the qualification of testing institutions, basic information of management manual, testing scope and items of qualification management, testing scope and items of filing management, supervision and inspection, comparison test, bad behavior record, Shandong Province measurement certification and acceptance item list, testing ability analysis table, basic information of personnel management, training records, employment records, equipment management and environmental monitoring (greenhouse degree of standard curing room for cement, concrete test blocks and mortar test blocks).
Fourteenth testing institutions shall establish a file management system in accordance with the "Measures for the Administration of Quality Testing Files of Construction Projects in Shandong Province (Provisional)". Inspection contracts, waybills, original records and inspection reports are numbered uniformly every year. When filing, the consignment note, original records and inspection reports shall be filed with serial numbers and shall not be withdrawn or altered at will. The actual storage period of long-term archives shall not be shorter than 10 year, and the actual storage period of short-term archives shall not be shorter than 5 years.
The archives management of testing institutions shall implement the legal person responsibility system, and the testing institutions shall designate departments or personnel to be responsible for the archives management, so as to ensure the completeness, accuracy and safety of the archives.
Fifteenth testing institutions after the completion of testing business, should be in accordance with the written commitment or agreed time to issue a test report. If there is no commitment or agreed time, it should be issued within 4 days after accepting the entrustment (32 days for cement, 34 days for ordinary mixture ratio, 3 days for concrete admixture after standard test age and 5 days for special use). The test report shall be signed by the testing personnel, the legal representative of the testing institution or its authorized signatory, and shall take effect only after being stamped with the special seal for testing. The special seal for testing shall be numbered, formulated and issued by the Provincial Construction Management Bureau. The test report shall be filed by the construction unit after it is confirmed by the construction unit or the project supervision unit.
Article 16 No unit or individual may express or imply that testing institutions issue false testing reports, and may not tamper with or forge testing reports.
Seventeenth testing institutions should be engaged in testing activities of the technical person in charge and the test report issued by the personnel, auditors and operators to carry out relevant testing technology training. The training content mainly involves laws and regulations, professional foundation, technical standards, measurement certification and other knowledge. The training method should be combined with the actual work, pay attention to actual results, and adopt the method of entrusting professional institutions to carry out business training and testing institutions to carry out operational skills training. The Provincial Construction Management Bureau organizes a unified assessment of the training results of testing personnel, and uniformly issues and manages the Management Manual for Engineering Quality Testing Personnel. Only those who hold this manual can engage in the corresponding engineering quality inspection.
Testing personnel shall not be employed by more than two testing institutions at the same time.
Testing institutions and testing personnel shall not recommend or supervise the production of building materials, building components and equipment.
Eighteenth testing institutions in violation of laws, regulations and mandatory standards for engineering construction, causing losses to others, shall bear the corresponding liability for compensation according to law.
Article 19 If the interested parties of the test results dispute the test results, both parties shall re-examine the test results with the recognized testing institutions. If it is impossible to re-examine or the re-examination result is controversial, it shall be settled through arbitration or judicial procedures. The results of reinspection or dispute settlement shall be reported to the local construction administrative department for the record by the party proposing reinspection.
Article 20 The quality inspection business specified in Annex 1 of these Detailed Rules shall be conducted by a qualified inspection agency entrusted by the project construction unit. The construction unit shall, when handling the procedures for quality supervision of construction projects, report to the testing institutions that undertake the engineering testing business at the same time, and the projects that have not determined the testing institutions shall not go through the supervision procedures. The entrusting party and the entrusted party shall sign a written contract.
The construction unit may entrust one or more testing institutions to undertake the special testing business of the unit project; The construction unit shall not split the testing items in the special testing items and entrust them to other testing institutions.
For some testing projects with strong professionalism, large investment in testing facilities and small business volume, Weihai Quality Supervision Station will reasonably coordinate relevant parties, establish a central laboratory according to the advantages of various testing institutions, concentrate business, facilitate the enjoyment of resources, and improve the testing level of the project in the city.
Testing institutions shall not subcontract testing business.
Twenty-first testing institutions and clients shall collect and pay testing fees in accordance with relevant regulations. The testing institution shall clearly indicate the charging standards for various testing services. Don't maliciously lower the price, lower the testing standard and service level.
Twenty-second testing institutions shall establish a retention system for testing samples. Specimens that are clearly required to be retained by norms and standards shall be retained in accordance with the prescribed procedures, environment, quantity, time and requirements; If there is no clear requirement in the specifications and standards, the samples that can be repeatedly nondestructive tested shall be kept for 3 days after the sample inspection or test; Destructive samples shall be kept for 2 days after sample inspection or test. The sample retention label should be accurate, and the sample retention should have the detection bar code label.
Chapter IV Witness Detection and Remote Detection
Twenty-third construction engineering quality supervision institutions at all levels should strengthen the government supervision and management of the witness sampling quality inspection business as stipulated in Annex I to these Rules.
The project construction unit shall separate the witness sampling quality inspection business from other non-witness inspection businesses, entrust inter-agency inspection, and the engineering quality supervision institution where the project is located shall be responsible for supervising the implementation.
Twenty-fourth quality inspection samples shall be sampled in strict accordance with the relevant standards of engineering construction and the relevant provisions of the state, and shall be sampled on the spot under the supervision of the construction unit or engineering supervision unit. The witness sampling and inspection ratio of test blocks, samples and materials related to structural safety shall not be less than 30% of the number of samples specified in relevant technical standards. Units and individuals that provide quality inspection samples shall be responsible for the authenticity of the samples.
Witnesses and sampling personnel must be trained by Weihai Quality Supervision Station, pass the examination and obtain certificates before taking up their posts.
The witness shall be a person who has the knowledge of construction inspection by the project construction unit or supervision unit, and the project construction unit or supervision unit shall notify the inspection institution in writing.
The test report of witness sampling inspection shall indicate the witness's name and sampling unit, and affix the special seal for witness sampling. Witnesses and samplers are responsible for the authenticity and representativeness of the samples.
Witnesses and samplers shall strictly abide by the relevant provisions of the witness sampling system and shall not resort to deceit. If there is fraud during the year, the certificate qualification will be cancelled, and Weihai Quality Supervision Station will put it on record, and it is not allowed to engage in this work in the future. The certificates of witnesses and sampling personnel shall not be lent to others, and the qualification certificates of offenders shall be cancelled once they are found.
Twenty-fifth testing institutions shall be responsible for the quality of their testing work and testing behavior when they set up fixed branches or carry out testing activities in different places according to their business needs.
If a testing institution registered outside the province undertakes engineering quality testing projects in this city, it shall first obtain the Record Certificate of Construction Engineering Quality Testing Institutions Entering Shandong issued by the Provincial Construction Management Bureau, and then go to Weihai Quality Supervision Station for the record according to the testing projects undertaken. At the time of filing, relevant materials shall be submitted in accordance with the relevant provisions of the Measures for the Administration of Recording of Testing Institutions in Shandong Province (Provisional), and shall be responsible for the authenticity of the application materials.
Testing institutions inside and outside the province that undertake engineering quality testing projects in this Municipality shall report individual engineering testing projects to Weihai Quality Supervision Station for the record more than 7 days before undertaking the testing business of testing projects. After the completion of the single project inspection project, the filing certificate will automatically become invalid. The materials submitted for the record refer to the relevant provisions of the Measures for the Administration of Recording of Testing Institutions in Shandong Province (Provisional).
Testing business can be carried out only after filing, and relevant local regulations shall be observed. Unregistered testing institutions shall not undertake testing business in this city, and the testing report issued by them shall not be used as technical data for completion.
Twenty-sixth testing institutions in this city to carry out cross-regional witness sampling quality testing business between the urban area of this city and the three cities, must set up branches or laboratories in the location of the project, and obtain the business license of local industrial and commercial registration and the measurement certification certificate of the testing project. The testing instruments, equipment, site environment and personnel of the branch shall be suitable for the business they are engaged in. And report to Weihai Quality Supervision Station and local quality supervision department for the record.
Twenty-seventh Weihai Quality Supervision Station shall inspect the personnel situation of the filing institution and the metrological verification of instruments and equipment, and supervise and manage its testing activities; Report violations of laws, regulations and technical standards in testing activities to the provincial quality supervision station.
Chapter V Supervision and Administration
Twenty-eighth the implementation of qualification management of testing institutions, testing institutions and personnel management manual issued by the Provincial Construction Management Bureau ("Management Manual of Engineering Quality Testing Institutions" and "Management Manual of Engineering Quality Testing Personnel"). The Manual for Management of Testing Institutions and Personnel was issued by the Weihai Municipal Construction Committee to record and manage testing institutions.
Construction administrative departments at all levels shall establish records of bad behaviors of testing institutions and testing personnel in the region, and the records of bad behaviors shall record the illegal behaviors and violations of mandatory standards of testing institutions and testing personnel in the Management Manual of Engineering Quality Testing Personnel and the Management Manual of Engineering Quality Testing Institutions (in written form and in the form of electronic network), as an important basis for approving the qualification extension and filing management of testing institutions.
The Management Manual for Testing Institutions is used together with the Qualification Certificate for Construction Engineering Quality Testing, which is a supplement to the qualification management and filing management, an important basis for extending the qualification certificate of testing institutions and obtaining the qualification for filing, and an effective certificate for testing institutions to undertake business filing in different places.
Twenty-ninth Weihai Municipal Construction Committee shall, in accordance with the unified requirements of the Provincial Construction Management Bureau, organize testing institutions to carry out testing ability verification and comparison activities. Testing institutions that fail to pass the verification and comparison of testing ability shall conduct secondary verification, and if they are still unqualified, the testing work of the project shall be suspended.
Thirtieth testing institutions to obtain the qualification of testing institutions, no longer meet the corresponding qualification standards, Weihai Municipal Construction Committee will report to the Provincial Construction Management Bureau, according to the request of interested parties or according to their functions and powers, can be ordered to make corrections within a time limit; If no change is made within the time limit, the corresponding qualification certificate may be withdrawn.
Thirty-first construction administrative departments at all levels should strengthen the supervision and inspection of testing institutions, mainly to check the following contents:
(a) whether it meets the qualification standards stipulated in these rules;
(two) whether to engage in quality inspection activities beyond the scope of qualification;
(three) whether there is any act of altering, reselling, leasing, lending or illegally transferring the qualification certificate in other forms;
(four) whether the test report is signed and sealed as required, and whether the test report is true;
(five) whether the testing institution conducts testing in accordance with relevant technical standards and regulations;
(six) whether the instruments, equipment and environmental conditions meet the requirements of metrological certification;
(seven) other matters stipulated by laws and regulations.
Thirty-second construction departments and their supervision institutions have the right to take the following measures when implementing supervision and inspection:
(a) require the testing institution or the entrusting party to provide relevant documents and materials;
(two) to enter the workplace of the testing institution (including the construction site) to conduct spot checks;
(3) Organizing comparison tests to verify the detection capability of detection institutions;
(four) when it is found that there are detection behaviors that do not meet the requirements of relevant national laws, regulations and engineering construction standards, it shall be ordered to make corrections.
Thirty-third construction departments at all levels in order to collect evidence in the supervision and inspection, can take the sampling method, from the relevant samples and test data; In the case that the evidence may be lost or difficult to obtain later, with the approval of the department head, the relevant samples and inspection data can be registered and saved in advance, and a decision on handling can be made in time within 7 days. During this period, the parties concerned or relevant personnel shall not destroy or transfer relevant samples and inspection data.
Article 34 Inspectors shall conduct inspection in strict accordance with the requirements of national norms, regulations and technical standards, and shall implement the management manual system. The following behaviors of inspectors shall be recorded in the management manual. If the circumstances are serious or refuse to correct the mistakes, the management manual shall be withdrawn, and the inspector shall not continue the inspection:
(a) beyond the scope of qualification projects engaged in testing work;
(two) not according to the national and provincial technical standards for testing and serious violation of operating procedures;
(3) Forging test data and issuing false test reports;
(four) failing to participate in professional education and training as required;
(five) other acts in violation of the relevant provisions of the state, province and city.
Thirty-fifth construction administrative departments at or above the county level and their engineering quality supervision departments shall, in accordance with the provisions of the authority, deal with the problems found in the supervision and inspection and impose administrative penalties, and report to the qualification examination and approval authority in a timely manner.
Thirty-sixth construction departments at all levels and their engineering quality supervision departments shall establish a complaint acceptance and handling system, and disclose the telephone number, mailing address and e-mail address of complaints.
Any unit or individual has the right to complain to the competent department of construction if the testing institution violates the relevant national laws, regulations and engineering construction standards.
Chapter VI Punishment
Article 37 Anyone who, in violation of the provisions of these Detailed Rules, fails to obtain the corresponding qualification to undertake the testing business as stipulated in these Measures, the testing report is invalid, and the competent construction department of the local people's government at or above the county level shall order it to make corrections and impose a fine of not less than 30,000 yuan but not more than 6,543.8+0,000 yuan.
Article 38 If a testing institution conceals relevant information or provides false materials to apply for qualification, the Provincial Construction Management Bureau will not accept it or refuse the administrative license, and give it a warning, and may not apply for qualification again within 1 year.
Thirty-ninth by cheating, bribery and other improper means to obtain the qualification certificate, the provincial construction department shall revoke its qualification certificate, and shall not apply for the qualification certificate again within 3 years; And the competent department of construction of the local people's government at or above the county level shall impose a fine of more than 30,000 yuan 1 10,000 yuan; If a crime is constituted, criminal responsibility shall be investigated according to law.
Fortieth testing institutions in violation of the provisions of these rules, one of the following acts, by the local people's governments at or above the county level construction departments shall be ordered to correct, and may impose a fine of more than 30 thousand yuan 1 10 thousand yuan; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) beyond the scope of qualification to engage in testing activities;
(two) alter, resell, lease, lend or transfer the qualification certificate;
(three) the use of unqualified inspectors;
(four) failing to report the illegal acts and unqualified items found in accordance with the provisions;
(5) Failing to sign and seal the test report as required;
(six) not in accordance with the relevant national mandatory standards for engineering construction;
(seven) file management confusion, resulting in the detection data can not be traced back;
(8) Subcontracting inspection business.
Article 41 If a testing institution falsifies testing data and issues false testing reports or expert conclusions, the competent construction department at or above the county level shall give a warning and impose a fine of 30,000 yuan; If losses are caused to others, they shall be liable for compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
Forty-second in violation of the provisions of these rules, the entrusting party has one of the following acts, and the competent construction department of the local people's government at or above the county level shall order it to make corrections and impose a fine of more than 30,000 yuan 1 10,000 yuan:
(1) Entrusting a testing institution that has not obtained the corresponding qualification for testing;
(2) Express or imply that the testing institution issues a false testing report, and falsifies or forges the testing report;
(3) practicing fraud and submitting samples for inspection.
Forty-third in accordance with the provisions of these measures, the legal representative of the testing institution and other directly responsible personnel shall be fined from 5% to 10%.
Forty-fourth construction administrative departments at all levels or the staff of engineering quality supervision institutions entrusted by them shall be given administrative sanctions according to law in any of the following circumstances in quality inspection management; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(1) Issuing qualification certificates to applicants who do not meet the statutory requirements;
(2) Failing to issue a qualification certificate to an applicant who meets the statutory requirements;
(3) Failing to issue a qualification certificate to an applicant who meets the statutory requirements within the statutory time limit;
(4) taking advantage of his position to accept property or other benefits from others;
(five) failing to perform the duties of supervision and management according to law, or failing to investigate and deal with illegal acts.
Chapter VII Supplementary Provisions
Forty-fifth the original management regulations and measures are inconsistent with these rules, according to these rules.
Forty-sixth these rules shall be interpreted by the Municipal Construction Committee.
Article 47 These Rules shall come into force as of the date of promulgation.

I. Special inspection institutions and witness sampling inspection institutions shall meet the following basic conditions:
