Regulations of Tongliao Municipality on Prevention and Control of Air Pollution
Chapter I General Provisions Article 1 In order to protect and improve the atmospheric environment, prevent and control atmospheric pollution, safeguard public health, promote the construction of ecological civilization and promote the sustainable development of economy and society, in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Law on Prevention and Control of Air Pollution of People's Republic of China (PRC), the Regulations on Prevention and Control of Air Pollution of Inner Mongolia Autonomous Region and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and control of air pollution and its supervision and management activities within the administrative area of this Municipality.

If the superior law has already made provisions, its provisions shall prevail. Article 3 The prevention and control of air pollution should aim at improving the quality of the atmospheric environment, follow the principles of planning first, source control, prevention first, combination of prevention and control, regional linkage, public participation and liability for damage, and establish a scientific prevention and control mechanism for the whole society. Article 4 This Municipality implements the target responsibility system and assessment system for atmospheric environmental protection.

The people's governments at the city and banner level shall incorporate the objectives of improving atmospheric environmental quality and the completion of key tasks of air pollution prevention and control within their respective administrative areas into the government performance appraisal, and the assessment results shall be made public to the public. Article 5 All units and individuals have the right and obligation to protect the atmospheric environment, have the right to report acts of polluting the atmospheric environment, and have the right to report and accuse the departments exercising supervision and management rights and their staff members of failing to perform their duties according to law.

News media should publicize laws, regulations and scientific knowledge on atmospheric environmental protection, strengthen policy interpretation and public opinion guidance, and timely and publicly report air pollution problems that are strongly reflected by the masses and have bad social impact. Chapter II Supervision and Administration Article 6 The municipal and county people's governments shall be responsible for the quality of the atmospheric environment within their respective administrative areas. And perform the following duties:

(a) the prevention and control of air pollution into the national economic and social development plan;

(two) the funds for the prevention and control of air pollution will be included in the fiscal budget, and financial subsidies will be given to the construction of clean heating projects such as coal to gas and coal to electricity;

(3) To report the implementation of air pollution prevention and control to the people's congress or the Standing Committee at the corresponding level every year and accept supervision;

(four) to formulate emergency plans for heavy pollution weather, report to the competent department of ecological environment of the people's government at the next higher level for the record, and announce them to the public, and start the emergency plans according to the early warning level of heavy pollution weather;

(five) strictly control the new construction, renovation and expansion of industrial construction projects that emit serious odor;

(six) to clean up and rectify the scattered enterprises that discharge atmospheric pollutants within their respective jurisdictions;

(7) Delineating, promulgating and managing high-pollution fuel no-burn zones according to law;

(eight) the promotion of scientific planting techniques, scientific and rational use of fertilizers and pesticides in accordance with the relevant provisions of the state, and reduce the emission of atmospheric pollutants such as ammonia and volatile organic compounds;

(nine) to encourage and support the use of straw as fertilizer, feed, energy, industrial raw materials and edible fungi and other advanced and applicable technologies;

(ten) the introduction, support and training of professionals in the prevention and control of air pollution, encourage scientific and technological research on the prevention and control of air pollution, and develop environmental protection industries;

(eleven) the implementation of public transport priority development plan, guide citizens to low-carbon travel, support and promote the use of new energy vehicles;

(twelve) the projects prohibited by these regulations have been completed and rectified by the people's government at the county level according to law;

(thirteen) according to the needs of air pollution prevention and control, establish and improve the cooperation mechanism, implement cross regional air pollution prevention and control, and strengthen joint monitoring, joint law enforcement and cross law enforcement;

(fourteen) other duties as prescribed by laws and regulations. Article 7 The competent department of ecological environment of the Municipal People's Government shall exercise unified supervision and management over the prevention and control of air pollution. And perform the following duties:

(a) according to the autonomous region people's government issued by the total emission control index of key air pollutants and the binding target of ambient air quality, formulate the total emission reduction plan of key air pollutants and the plan to meet the standards within a time limit, organize the implementation after the approval of the Municipal People's government, and announce it to the public;

(two) in conjunction with the relevant departments to determine the key pollutant discharge units that discharge pollutants into the atmosphere according to law, and announce them to the public every year;

(3) To establish a consultation mechanism for atmospheric environmental information and meteorological information with the competent meteorological departments, carry out atmospheric environmental quality forecast and jointly issue forecast and early warning information;

(four) responsible for the prevention and control of pollution in livestock and poultry farms and breeding communities above designated size, and realize information sharing with other competent departments;

(five) responsible for the demolition of distributed heating coal-fired boilers in the area covered by the heating pipe network;

(six) responsible for the supervision and management of the open burning of asphalt, linoleum, rubber, plastic, leather, garbage and other toxic and harmful smoke and malodorous gas substances outside the urbanization management area, and the open burning of straw, weeds, fallen leaves, branches and other smoke and dust pollutants;

(seven) to announce the way of reporting complaints to the public, and handle the reporting complaints according to law;

(eight) other duties as prescribed by laws and regulations. Eighth other relevant departments of the municipal and county people's governments shall, within the scope of their respective duties, supervise and manage the prevention and control of air pollution. And perform the following duties:

(a) the development and reform department is responsible for controlling the total coal consumption, planning the coal market, rationally distributing urban central heating, promoting clean energy, organizing the implementation of clean production, developing circular economy, and formulating and improving relevant policies such as atmospheric environmental protection;

(two) the competent department of industry and information technology is responsible for organizing the promotion of technological transformation and upgrading of industrial enterprises, eliminating backward production capacity, organizing the implementation of clean energy substitution transformation of production and operation enterprises, and supervising and managing the dust in the material yard of enterprises;

(three) the heating management department is responsible for the adjustment of central heating resources, the transformation of central heating in old residential areas, the improvement of regional central heating and the heating rate of clean energy, and the implementation of urbanization management;

(four) the natural resources department is responsible for the prevention and control of dust in mining and processing, and strengthens the supervision and management of stone processing sites;

(five) housing and urban and rural construction, public utilities, urban management, transportation, water affairs and other departments are responsible for the supervision and management of dust from engineering construction, soil dust, road dust and yard dust;

(six) the administrative law enforcement department of urban management is responsible for the supervision and management of cooking fume pollution, open burning and open barbecue in the catering service industry in the urbanization management area, and jointly supervise and manage road dust with the transportation department;

(seven) public security, transportation, commerce, market supervision and management departments are responsible for the supervision and management of motor vehicles and off-road mobile machinery, oil and gas recovery and management, oil quality and other aspects. According to their respective responsibilities;

(eight) the market supervision and management department is responsible for the supervision and management of coal business premises, and the unlicensed coal business premises and coal business premises in the high pollution fuel no-burn zone shall be banned according to law;

(nine) emergency management and public security departments are responsible for the supervision and management of the storage, sale and discharge of fireworks and firecrackers;

(ten) the agriculture and animal husbandry department is responsible for the supervision and management of the comprehensive utilization of straw;

(eleven) agriculture, animal husbandry, forestry, grassland, ecological environment and other departments are responsible for the supervision and management of air pollution caused by agricultural production and livestock breeding;

(twelve) the prevention and control of air pollution without the supervision and management department shall be designated by the municipal and county people's governments according to law.
