Article 1 These Provisions are formulated in accordance with the Education Law of the People's Republic of China, the Compulsory Education Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, in combination with the actual situation of this Municipality, in order to ensure the safety of schools and maintain the normal order of education and teaching in schools.

Article 2 These Provisions shall apply to the safety management of kindergartens, ordinary primary and secondary schools, various secondary vocational schools (including technical schools) and special education schools (hereinafter referred to as schools) within the administrative area of this Municipality.

Article 3 School safety work shall follow the principles of putting people first, putting prevention first and ensuring safety.

Article 4 School sponsors shall ensure school safety funds, which shall be included in the annual education budget to ensure the normal operation of school safety work.

Article 5 The municipal education administrative department shall be responsible for organizing the implementation of these Provisions. City, district and county education administrative departments are in charge of school safety work, and the competent department of secondary vocational schools is responsible for the school safety work.

The relevant functional departments of the government shall, according to their respective functions, perform the duties of school safety management, create a good safety environment and ensure school safety.

Article 6 The municipal, district and county education administrative departments shall establish a coordination mechanism with the departments of human resources and social security, public security, transportation, urban management, industry and commerce, health, food and drug supervision, safety supervision, environmental protection, justice, construction, land and housing management, quality supervision, disabled persons' federations, culture, radio, film and television press and publication at the same level, and regularly study and solve school safety problems to ensure school safety.

Seventh education administrative departments at all levels and the competent departments of secondary vocational schools are the competent departments of school safety work within their respective jurisdictions, and perform the following duties for school safety work:

(a) responsible for the preparation of school safety education work plan, to guide the school to carry out targeted and planned safety education for students, and constantly improve the educational effect;

(two) a comprehensive grasp of the status of school safety work, the development of school safety assessment objectives, the school safety work into the annual assessment target management, regular assessment;

(three) the establishment of safety work responsibility system and accident accountability system, eliminate potential safety hazards in time, and guide schools to properly handle student injury accidents;

(four) to formulate emergency plans for school safety emergencies, and to guide and supervise schools to establish, improve and implement safety management systems;

(five) to coordinate other relevant government departments to do a good job in school safety management, and to assist the local people's government in organizing the rescue, investigation and handling of school safety accidents;

(six) other school safety management work as prescribed by laws and regulations.

Educational supervision institutions shall organize special supervision of school safety work, and regard school safety work as an important supervision content of inspectors in the area of responsibility.

Eighth schools should establish a responsibility system for safety management, to determine the person responsible for school safety work. The legal representative of the school is the first person responsible for school safety, and the person in charge of school safety is the person directly responsible for school safety.

Ninth schools should set up full-time security personnel according to the proportion of students in school, clarify their security responsibilities, and be equipped with necessary safety protection equipment and monitoring, alarm and other equipment.

Article 10 Schools shall establish and improve the following safety work systems:

(a) security, safety inspection, safety education and safety publicity system;

(2) The reporting and emergency handling system for emergencies and other safety accidents;

(3) Management system of education and teaching, daily necessities and facilities, including dangerous building reports, food, drinking water, electricity consumption, fire safety management, medicines, dangerous goods, experimental supplies, sports venues, equipment and facilities management system in physical education class, and safety management system for the use of special equipment such as boilers and elevators;

(four) student safety information notification system;

(5) Campus network and information security management system;

(6) student health record system;

(seven) the legal education system for teachers and students;

(eight) other school safety management system.

Eleventh schools should establish and improve the guard system, establish a registration or verification system for off-campus personnel, and prohibit unauthorized off-campus personnel and motor vehicles from entering. It has been agreed that vehicles entering the school should drive at a speed limit and stop at designated places.

It is forbidden to bring inflammable and explosive substances, toxic substances, animals, control devices and other items that may endanger the safety of the school into the campus.

The school shall allow its students to stay overnight or enter the school from 7: 00 to 18: 00, except in the following circumstances:

(1) Statutory holidays;

(two) the administrative department of education or the competent department of secondary vocational schools to make epidemic prevention and safety arrangements;

(3) Other circumstances stipulated by laws, regulations and rules.

In accordance with the provisions of the preceding paragraph, students who stay in school or enter school during non-education and teaching shall abide by the relevant administrative regulations. The specific management measures shall be formulated separately by the municipal education administrative department or the competent department of secondary vocational schools.

Article 12 The public security organ shall strengthen the public security management and patrol prevention and control in the surrounding areas of the school and key road sections during the period of students' going to and from school, add public security sentry box and alarm points around the school with complicated public security situation, and promptly investigate and deal with cases that disturb the campus order and infringe on the personal and property safety of students and faculty.

Urban management law enforcement and construction departments should strengthen law enforcement inspection of planning and construction projects around the school; Departments of industry and commerce, health, culture, radio, film and television, press and publication, etc. shall strengthen the management and supervision of relevant business service places around the school, and investigate and deal with illegal business practices according to law.

Safety supervision, industry and commerce, planning and other relevant departments shall, according to their respective functions and duties, prohibit any unit or individual from setting up inflammable, explosive, toxic, corrosive, radioactive production, management, storage and use places or facilities around the school in violation of relevant laws, regulations, rules and norms, as well as other places or facilities that may affect school safety.

Thirteenth school organizers should give priority to the project funds to reduce noise and take measures to ensure a quiet teaching environment. The buildings of newly-built schools should use design and building materials with strong noise attenuation performance.

Public security, construction, transportation, urban management, planning, environmental protection and other relevant departments should strengthen the supervision of noise sources such as vehicles, construction sites and business premises around the school to ensure that the noise in the school campus does not exceed 70 decibels during the day and 55 decibels at night.

Article 14 Public security, transportation, construction and other departments shall set up complete traffic warning signs and safety facilities such as warning, speed limit, slow travel and yield on the roads around the school, draw a crosswalk on the road in front of the school, and set up traffic lights, speed bumps, overpasses and other facilities as needed.

When the school is in a complicated traffic section, the traffic management department of the public security organ shall deploy police or traffic assistants to maintain the traffic order of the road near the school gate.

In primary schools near traffic arteries, public security organs and traffic management departments should maintain good traffic order and ensure the safe passage of students when they go to and from school; The school should arrange a special person to escort juniors across the road.

Article 15 The traffic administrative department of the public security organ shall strengthen the supervision and inspection of the school bus operation, promptly investigate and deal with the school bus road traffic violations, and regularly send a copy of the school bus driver's road traffic violations and traffic accident information to the subordinate unit, the education administrative department or the competent department of the secondary vocational school.

The traffic administrative department of the public security organ shall not go through the inspection procedures for illegally modified vehicles whose safety performance does not meet the national standards.

The administrative department of education or the competent department of secondary vocational schools shall strengthen the inspection and supervision of the use of school buses. If it is found that the use does not meet the national safety technical standards, fake license plates, deck plates, unlicensed vehicles, assembled vehicles or scrapped vehicles, the school shall be ordered to stop using them, and the traffic management department of the public security organ shall be notified in time.

The administrative department of education or the competent department of secondary vocational schools and the traffic administrative department of public security organs shall establish and improve the information sharing mechanism of school bus safety management.

Sixteenth school buses to pick up students shall meet the following conditions:

(a) in line with the national standards for motor vehicle safety technology, the special school bus meets the national standards for special school buses, and has obtained the motor vehicle inspection certificate;

(two) the name of the unit and the number of people on both sides of the cab are painted, the car body is painted in a uniform color according to the regulations, and the words "school bus" are painted on the back of the car body;

(three) equipped with handrails, railings and other safety devices, seat belts;

(four) equipped with escape hammer, dry powder fire extinguisher, first aid kit and other safety equipment to ensure good performance and effective application;

(five) the installation and use of driving recorder with satellite positioning function;

(six) registration, registration procedures and registration to the administrative department of education or the competent department of secondary vocational schools.

The school has its own vehicle to pick up and drop off students, and the owner's name must be the same as the name of the unit. Schools that rent vehicles must rent vehicles with passenger transport qualification units as vehicles to pick up and drop off students, and sign lease contracts.

Seventeenth schools should be equipped with 1 or more full-time management personnel responsible for the students on the school bus, and regularly carry out safety education for the full-time management personnel on the bus, and organize the full-time management personnel on the bus to learn road traffic safety laws and regulations, safety precautions and first aid knowledge.

The full-time management personnel on board shall perform the following duties:

(1) When students get on and off the bus, they should guide and command under the bus to maintain the order of getting on and off; If students need to cross the road after getting off the bus, guide them to pass safely;

(2) Stop the school bus and immediately report to the person in charge of the school if it is found that the driver is not qualified to drive the school bus, or that the driver drinks alcohol and the school bus is overloaded, which obviously hinders traffic safety;

(3) Count the number of students on the school bus to ensure that the students are seated safely, and signal the driver to start the school bus after confirming that the doors are closed;

(four) to stop the school bus from leaving the seat and other dangerous behaviors;

(5) Check the number of students getting off the bus and confirm that all students have got off the bus before I can get off.

When children and pupils take the school bus to and from school or leave school, the full-time management personnel on the bus should hand over to the parents or other guardians of the students at the bus stop.

Eighteenth school buses carrying students can run in bus lanes and other sections where social vehicles are prohibited but public vehicles are allowed to pass.

When the school bus stops on the road to get on or off students, it should stop on the right side of the road, turn on the danger warning flash, and the driver will extend the parking sign out of the window. The vehicles behind should stop and wait, and they are not allowed to overtake.

The school bus shall not exceed the approved number of passengers, and shall not be overloaded for any reason.

The school bus shall abide by the speed limit provisions of road traffic safety laws and regulations, but when driving on urban roads, its maximum speed shall not exceed 60 kilometers per hour.

Nineteenth school organizers should provide school buildings and venues that meet safety standards.

Schools should carry out safety management on their buildings, structures, ancillary facilities, supporting greening and hidden dangers of geological disasters. If a potential safety hazard is found, the school shall submit a written report to the administrative department of education or the competent department of secondary vocational schools in a timely manner, and immediately take safety precautions such as stopping using, fencing, setting warnings and effective rectification.

The administrative department of education or the competent department of secondary vocational schools shall regularly organize school safety inspections.

The location of newly-built schools should meet safety standards, and avoid areas where floods, landslides, mudslides, ground collapses, lightning strikes and other disasters may occur, as well as factories and warehouses that produce and store inflammable and explosive dangerous goods; Should stay away from railways, highways, elevated roads, high-voltage lines, substations, garbage stations, hospital morgues and other places that may be detrimental to the physical and mental health of minors.

Article 20 Schools with boarders should be equipped with special personnel to be responsible for the life management and security of boarders, establish and improve the dormitory management system, implement the responsibility of night duty and inspection, and strengthen the safety inspection of electricity consumption and fire and theft prevention facilities in dormitories.

Schools should strengthen the safety management of girls' dormitories according to the characteristics of girls' dormitory safety work.

Twenty-first schools should establish and improve the fire safety responsibility system, strengthen the maintenance and management of safety evacuation facilities, fire control facilities and equipment, and ensure that fire control facilities and equipment are in good condition and effective; Formulate fire electricity safety, fire hazard rectification, flammable and explosive dangerous goods use system and fire fighting and emergency evacuation plan.

The public security fire department shall, jointly with the education administrative department or the competent department of the secondary vocational school, urge the school to fulfill its obligations of fire safety and assist the school to carry out fire safety education and emergency drills.

Twenty-second schools should ensure the safety of education and teaching equipment and living facilities, and may not purchase education and teaching equipment, daily necessities and appliances without production licenses or relevant safety performance certificates. School laboratories, skill operation, literature and art, sporting goods and other facilities and equipment shall be inspected for safety before use, and the inspection and maintenance shall be recorded.

Twenty-third schools should strengthen the safety management of dangerous chemicals, radioactive substances, living biological samples and biological agents used in teaching experiments, and standardize the safe operation of experiments and the teacher guidance system.

For hazardous chemicals, precursor chemicals, radioactive substances, living biological samples, biological agents and other hazardous substances, the school shall register and put on record in accordance with the relevant laws and regulations of the state, establish a management system for the purchase, storage, use, inspection and scrapping of hazardous chemicals, radioactive substances, living biological samples and biological agents, set up special warehouses according to law, collect and store toxic and hazardous wastes in a unified way, and hand them over to units with relevant qualifications for transportation and disposal.

Twenty-fourth schools should implement the safety duty system for school leaders and teachers, and arrange special personnel to inspect, manage, guide and protect students' outdoor activities during recess. If students are found to have dangerous behaviors or other illegal and disciplinary behaviors, they should be warned and stopped in time.

Schools should set warning signs or take protective facilities in dangerous places such as dangerous buildings, swimming pools, highlands, stairs and guardrails.

Schools should maintain trees with management responsibilities to eliminate potential safety hazards.

Twenty-fifth schools organize students to participate in teaching activities such as teaching experiments, military training, public welfare labor or social practice, as well as gatherings, cultural and sports activities. , and should inform the students of the safety matters that need to be paid attention to in advance, and take necessary protective measures. Those who participate in military training and have a live-fire training plan must be organized and implemented in accordance with the training regulations.

Schools shall not organize primary and secondary school students to participate in business celebrations; Students are not allowed to engage in labor in contact with inflammable, explosive, toxic, harmful and other dangerous goods in any form or name, and activities that do not meet students' physiological and psychological characteristics or exceed their self-protection ability; Shall not organize minors to participate in emergency rescue and disaster relief activities; Schools shall not carry out activities in places that may endanger the personal safety of students.

Secondary vocational schools should establish a safety management system for students' off-campus internships, abide by relevant state laws and regulations, and provide students with necessary internship conditions and a safe and healthy internship working environment. First-year students may not be arranged to practice in enterprises and other units; Students shall not be arranged to engage in high-altitude, underground, radioactive, toxic, flammable and explosive, fourth-level physical labor intensity places stipulated by the state and other jobs with potential safety hazards; Students are not allowed to practice in bars, baths, foot baths, nightclubs, karaoke bars and other business entertainment places; It is not allowed to organize, arrange and manage internships through intermediaries.

Twenty-sixth schools in organizing students' extracurricular activities, should formulate a safety work plan to ensure the safety of students' activities; It is necessary to know in advance the inspection of large amusement facilities and the number of people entering the venue on the day of the event to avoid safety problems caused by too many people. It is forbidden to organize students to enter illegal scenic spots.

When the school entrusts other units or organizes students to participate in extracurricular activities together with other units, it shall reach a written agreement with the entrusting unit or cooperative unit on safety matters, and take effective measures to provide students with safety protection in accordance with the provisions and agreements of laws, regulations and rules.

Twenty-seventh the government should increase investment in the construction of students' healthy Internet access.

Schools shall, under the guidance of public security, culture, radio, film, television, press and publication departments, strengthen the security monitoring of school local area networks, set up necessary security barriers, and prevent students from contacting harmful network contents such as violence, pornography, feudal superstition, cults and gambling.

Internet cafes shall not be set up within 200 meters around the school, and minors shall not be allowed to enter the Internet cafes.

Twenty-eighth health administrative departments should supervise and inspect the school's educational facilities, living facilities and drinking water hygiene, and guide the school to do a good job in public health.

The food and drug supervision and administration department shall supervise and inspect the food safety status of school canteens and other catering services, and guide schools to do a good job in food safety.

The administrative department for industry and commerce shall strengthen the supervision and inspection of food safety in supermarkets, canteens and other shops on campus, and prohibit the sale of expired, moldy, moth-eaten, mixed with foreign bodies or other foods that do not meet food safety standards and may endanger human health.

The food, medicine and articles for daily use provided by schools to students and faculty shall conform to national and local standards. Schools with canteens should establish a system of designated procurement, licensing and registration of canteen materials and a system of food inspection records to check the hygiene and safety of drinking water and ensure the hygiene and safety of teachers and students.

All kinds of food entering campus shops and canteens should be selected through bidding.

Twenty-ninth schools should be equipped with corresponding health technicians and medical supplies, and implement laws, regulations, rules and policies related to the prevention and control of infectious diseases. When patients with infectious diseases or suspected infectious diseases are found, they shall immediately report to the local disease prevention and control institutions, take temporary isolation measures, and notify the guardians of underage students.

The administrative department of health shall organize and urge the relevant medical units and professional prevention and control institutions to do a good job in the prevention and control of infectious diseases and common diseases in schools, and strengthen supervision over the prevention and control of infectious diseases and common diseases in schools.

Thirtieth schools should implement the system of students' regular health examination and establish students' health records. The health records of minor students shall be confirmed by their guardians.

Schools should give special attention and care to students with special physique, specific diseases or abnormal psychological conditions.

Schools should take necessary safety measures such as post adjustment and off-duty treatment. Staff and workers who are identified by hospitals with relevant qualifications as suffering from mental illness, infectious diseases or other situations that may affect school safety.

Article 31 A school shall establish a system for informing minor students of safety information, and promptly inform their guardians of information related to students' safety, such as the time of arrival and departure, abnormal absence from class or leaving school without authorization, and abnormal physical and psychological conditions of students. The guardian shall provide effective contact information when the students enter the school. If the contact information of the guardian changes, it shall inform the school in time.

Schools should properly keep students' health and safety information and other materials, and protect students' personal privacy according to law.

Thirty-second schools should establish a safety education system, formulate a safety education plan for the semester and school year according to the national curriculum standards and local curriculum requirements, and provide safety education and safety skills training for teachers and students to improve their self-help and mutual rescue capabilities. Safety education and learning shall not be less than two class hours per semester.

School safety education should include preventing and responding to accidents or events that affect students' safety, such as social security, traffic safety, public health, accidental injuries, network information security, natural disasters, etc. Schools should organize teachers and students to carry out various forms of accident prevention and handling drills according to the content of safety education.

Thirty-third schools should set up psychological counseling rooms, equipped with full-time or part-time psychological counseling counselors, offer psychological health counseling courses or lectures, and provide psychological health counseling to students.

Schools should actively cooperate with student guardians, strengthen students' mental health education, and prevent and reduce students' self-injury and self-injury accidents.

Article 34 In the event of a school safety accident, the school shall, according to the existing conditions and capabilities, take timely measures to rescue the injured, protect the scene of the accident, and promptly notify the guardian or relative of the injured.

Thirty-fifth found in the school area or school surrounding areas endanger the personal safety of students or major security risks, the school should immediately take corresponding preventive measures and report to the relevant departments. The local people's government and relevant departments shall promptly deal with it according to law to eliminate potential safety hazards.

In the event of a school safety accident, the school and the competent department of the school shall report to the people's government at the same level and the competent department at the next higher level in a timely manner in accordance with the relevant provisions of Guangzhou's emergency information report.

After receiving the report, the competent department of the accident shall immediately rush to the scene of the accident, organize rescue and conduct on-site disposal. Schools should cooperate to restore normal teaching order as soon as possible.

Schools shall not conceal, falsely report or delay reporting safety accidents.

Thirty-sixth students' personal injury compensation matters, the parties can negotiate or apply to the school education administrative department, the competent department of secondary vocational schools and other relevant departments for mediation, or directly bring a lawsuit according to law.

Article 37 During the handling of school safety accidents, relevant government departments and schools should cooperate with each other and take necessary measures to strengthen school safety and security.

Thirty-eighth schools should handle school liability insurance, and the funds needed for insurance should be included in the education funds.

Encourage students to voluntarily purchase accident insurance. Schools should provide convenient conditions for students to participate in accident insurance, but they should not charge any fees.

Thirty-ninth education administrative department or the competent department of secondary vocational schools in any of the following circumstances, the people's government at the same level or its superior administrative department shall order it to make corrections within a time limit and informed criticism; If the circumstances are serious, the main person in charge of the education administrative department or the competent department of secondary vocational schools and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

(a) in violation of the provisions of article seventh, did not perform the duties of school safety management according to law;

(two) in violation of the provisions of the fifteenth paragraph of this Ordinance, it is found that the school bus that picks up students does not meet the national safety technical standards and other provisions, and fails to stop in time and take measures;

(three) in violation of the provisions of the nineteenth paragraph of this Ordinance, failing to supervise and inspect the buildings, places and facilities with potential safety hazards in the school and taking corresponding measures;

(four) in violation of the provisions of the provisions of article thirty-fifth, after receiving the report of the school safety accident, it is not timely to report or not timely to guide the school to dispose of it;

(five) other dereliction of duty, abuse of power, corruption.

Fortieth the government and relevant departments in violation of laws, regulations and these Provisions, failing to perform the duties of school safety supervision, management and protection according to law, shall be ordered by the superior government or administrative department to make corrections within a time limit; If the circumstances are serious, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Forty-first schools in any of the following circumstances, the relevant competent departments shall order them to make corrections within a time limit; Refuses to correct, the legal representative of the public school or the person directly responsible shall be given administrative sanctions, and the school shall be fined 30 thousand yuan; Impose a fine of less than 30,000 yuan on the operator, legal representative, person in charge of safety or other persons directly responsible of private schools, and may not engage in school management or education management affairs within 5 years; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

In violation of the provisions of this Ordinance, the responsibility system for safety management has not been established, and the person responsible for school safety has been determined;

(two) in violation of the provisions of article ninth, there is no full-time security personnel, equipped with necessary safety protection equipment and monitoring, alarm and other equipment;

(three) in violation of the provisions of article tenth, the school safety system has not been established;

(four) in violation of the provisions of the first and second paragraphs of Article 11, failing to establish and improve the guard system or carrying inflammable and explosive substances, toxic substances, animals, control devices and other items that may endanger the safety of the school into the campus;

(five) in violation of the provisions of the third paragraph of article eleventh of these regulations, students are not allowed to stay or enter the school;

(6) employing drivers or using school buses in violation of the provisions of Article 16;

(seven) in violation of the provisions of the seventeenth paragraph of this Ordinance, the full-time management personnel of the school bus are not equipped to take care of the students on the bus or the full-time management personnel on the bus fail to perform the duties of education management;

(eight) in violation of the provisions of article nineteenth, article twentieth, article twenty-first and article twenty-second, not to strengthen the school buildings, dormitories, education and teaching equipment safety and fire safety;

(nine) in violation of the provisions of article twenty-third, the purchase, use and management of dangerous chemicals, radioactive substances, biological samples and biological agents and other dangerous goods;

(ten) in violation of the provisions of article twenty-fourth, failed to ensure the safety of students' recess activities;

(eleven) in violation of the provisions of the second and third paragraphs of article twenty-fifth and the provisions of article twenty-sixth, organizing students to engage in dangerous labor, sports and other activities that are not suitable for students to participate in;

(twelve) in violation of the provisions of the first, second and third paragraphs of article twenty-eighth, refusing or not cooperating with the relevant departments to perform their duties of safety supervision and management according to law;

(thirteen) in violation of the provisions of the fourth paragraph of article twenty-eighth, purchasing food, medicine and daily necessities that do not meet the national standards;

(fourteen) in violation of the provisions of article twenty-ninth, article thirtieth, not equipped with health technical personnel, the implementation of regular health examination system for students or the establishment of student health records;

(fifteen) in violation of the provisions of this Ordinance thirty-first, thirty-second and thirty-third, the information reporting system, safety education system or psychological counseling room for underage students have not been established;

(sixteen) in violation of the provisions of article thirty-fifth, concealing, lying, delaying the report of safety accidents or obstructing the investigation of accidents, providing false information;

(seventeen) in violation of the provisions of article thirty-eighth, did not apply for school liability insurance or provide convenient conditions for students to participate in accident insurance, and collect fees;

(eighteen) other violations of the relevant provisions of the school responsibility.

Forty-second full-time managers who violate the provisions of the second and third paragraphs of article seventeenth and fail to perform their duties shall be ordered by the school to correct or replace them; If the circumstances are serious, they shall be dismissed.

Forty-third the term "school organizers" as mentioned in these Provisions includes public school organizers and private school organizers.

The organizers of public schools refer to the people's governments at all levels and relevant administrative departments that invest in the establishment of schools by means of government financial allocation.

The sponsor of a private school refers to a social organization or individual other than a state institution who uses non-state financial funds to organize schools for the society.

Forty-fourth approved the establishment of educational institutions and other training institutions of safety management, with reference to these provisions.

Article 45 These Provisions shall come into force on April 1 day, 2065.
