Legal analysis: To operate without a license, you have to apply for the Business License of Individual Industrial and Commercial Households, and you have to go to the industrial and commercial offices under your jurisdiction. The materials to be submitted include: the photo of the operator, the identity card and photocopy of the operator, and the proof of the business place (i.e. the photocopy of the real estate license and the house lease contract). To apply for a self-employed business license involving licenses (such as dealing in food and catering), you should first go to the industrial and commercial office in your jurisdiction with your ID card, and then go to the Food and Drug Administration to apply for a Food Circulation License or a Catering Business License with a pre-approved name. After receiving the license, you should take the above materials to the industrial and commercial office in your jurisdiction to apply for the license.

Legal basis: Article 2 of the Regulations on the Administration of Registration of Industrial and Commercial Enterprises in People's Republic of China (PRC), the following production and business units (hereinafter referred to as industrial and commercial enterprises) in industry, transportation, construction, commerce, foreign trade, catering, service, tourism, handicrafts and repair industries shall register in accordance with the provisions of these Regulations:

(1) State-owned industrial and commercial enterprises;

(2) Cooperative camps under collective ownership and other industrial and commercial enterprises;

(3) Joint ventures or joint ventures;

(4) Industrial and commercial enterprises owned by railways, civil aviation, post and telecommunications departments and other public utilities.

Other industrial and commercial enterprises that the people's governments of provinces, autonomous regions and municipalities directly under the Central Government think need to be registered.
