Article 5 A production and business operation entity shall establish and improve the responsibility system for production safety, implement the responsibility system for all employees, clarify the responsibility for production safety of the main persons in charge of the production and business operation entity, other persons in charge, persons in charge of functional departments, persons in charge of production workshops (teams), persons in charge of production teams and general employees, and carry out implementation and assessment step by step.

(1) Establish and improve the responsibility system of production safety of the entity;

(2) to organize the formulation and supervise the implementation of the safety production management system and safety operation procedures;

(3) determine the qualified person in charge of production safety and technical person in charge;

(4) set up a safety production management organization and provide safety production management personnel according to law, implement the safety function of the technical management organization of the unit and provide safety technical personnel;

(5) regularly study the work of safety in production, report the situation of safety in production to the workers' congress, the workers' congress or the shareholders' congress, and accept the supervision of the trade unions, employees and shareholders on the work of safety in production;

(6) Ensure the effective implementation of investment in production safety, and fulfill the regulations that safety facilities and occupational disease prevention facilities of construction projects are designed, constructed and put into production and use simultaneously with the main project according to law;

(7) to organize the establishment of safety production risk management and control mechanism, supervise and inspect safety production work, and eliminate hidden dangers of production safety accidents in time;

(8) organize and carry out education and training on production safety;

(9) Carry out the standardization construction of safety production, the construction of safety culture and the construction of security team according to law;

(11) Organize the implementation of occupational disease prevention and control, prevent, control and eliminate occupational hazards, establish and improve the responsibility system for occupational disease prevention and control, and protect the occupational health of employees;

(11) to organize the formulation and implementation of emergency rescue plans for accidents;

(12) timely and truthfully report accidents and organize accident rescue;

(13) Other duties as stipulated by laws, regulations and rules.

the person in charge of production safety of the production and business operation entity shall assist the main person in charge to perform the duties of production safety, and the technical person in charge and other persons in charge shall be responsible for the work of production safety within their respective responsibilities. Article 7 The safety production management institutions and safety production management personnel of production and business operation entities shall perform the following duties:

(1) Organizing or participating in the formulation of safety production rules and regulations and operating rules of their own units;

(2) to participate in the business decisions of the unit involving safety production, put forward suggestions for improving the management of safety production, and urge other institutions and personnel of the unit to perform their duties of safety production;

(3) to organize the formulation of the annual work plan and objectives of the unit's safety production management, and conduct assessment;

(4) organizing or participating in the publicity, education and training of production safety in the unit, and truthfully recording the education and training of production safety;

(5) to supervise the capital investment and technical measures for production safety of the unit;

(6) to supervise and inspect the audit of the qualifications and conditions for safe production of contractors and lessees, and urge and inspect the contractors and lessees to perform their duties for safe production;

(7) Supervise and implement the safety management of major hazard sources in the unit, and supervise the procurement, distribution, use and management of labor protection articles;

(8) organize the implementation of safety production risk control measures, check the safety production situation of the unit, timely investigate the hidden dangers of accidents, stop and correct the behaviors of illegal command, forcing risky operations and violating operating procedures, and urge the implementation of safety production rectification measures;

(9) organizing or participating in the formulation and exercise of the emergency plan for production safety accidents of the unit;

(11) Other duties as stipulated by laws, regulations and rules.
