Chapter I General Provisions Article 1 In order to rationally develop, utilize, protect and manage water resources, prevent and control water disasters, give full play to the comprehensive benefits of water resources, and promote the economic development and the improvement of people's lives in the autonomous region, these measures are formulated in accordance with the Water Law of People's Republic of China (PRC) (hereinafter referred to as the Water Law) and relevant laws and regulations, combined with the actual situation of the autonomous region. Article 2 The water resources mentioned in these Measures refer to surface water and groundwater.

The development, utilization, protection and management of water resources in the autonomous region and the prevention and control of water disasters must abide by the water law and these measures. Article 3 Water resources are owned by the state, that is, by the whole people.

The water in the ponds and reservoirs owned by the collective economic organizations of agriculture and animal husbandry belongs to the collective. Article 4 The autonomous region encourages and supports the development and utilization of water resources.

The legitimate rights and interests of units and individuals that exploit and utilize water resources according to law are protected by law. Article 5 People's governments at all levels shall strengthen the protection of water resources, take effective measures to plant trees and grass, conserve water sources, protect natural vegetation, prevent soil erosion, land desertification and salinization, prevent water pollution and improve the ecological environment. Article 6 People's governments at all levels shall strengthen the publicity, education, organization and management of water conservation, implement planned water use, use water scientifically and strictly save water. Article 7 The autonomous region shall implement the system of combining unified management with hierarchical and departmental management of water resources. Article 8 Units and individuals that have made outstanding achievements in the development, utilization, protection and management of water resources, prevention and control of water disasters, drought resistance, water conservation and related scientific research shall be rewarded by people's governments at all levels. Chapter II Management Institutions and Responsibilities Article 9 The water administrative department of the people's government at or above the county level is the competent department of the people's government at the same level for the unified management of water resources within their respective administrative areas.

The relevant departments of the people's governments at or above the county level shall cooperate with the water administrative department in charge of water resources management within the scope of their duties. Geology and mineral resources departments participate in the investigation, evaluation and planning of water resources, cooperate with water administrative departments to manage groundwater resources, and supervise and manage the exploration, management, monitoring, statistics, analysis, development and utilization of groundwater resources; The construction department is responsible for the centralized management of urban water conservation and the development, utilization and protection of groundwater in urban planning areas; The environmental protection department is responsible for the unified supervision and management of water pollution.

Xinjiang Production and Construction Corps, under the leadership of the people's government of the autonomous region, is responsible for the development, utilization and protection of water resources in the area under its management according to the unified river basin planning and regional planning. The protection of water resources developed and utilized by the Corps must abide by the Water Law and these Measures and accept the supervision of the water administrative department at or above the county level. The water administrative law enforcement of the Corps shall be organized and implemented by the water administrative department of the autonomous region entrusted by the water administrative department of the Corps. Tenth the main responsibilities of the water administrative department at or above the county level are:

(a) to publicize and implement the Water Law and these Measures and other laws, regulations and rules related to water administration, and to be responsible for the water administrative law enforcement and water dispute handling authorized by the people's government;

(2) Organizing investigation, evaluation and scientific investigation of water resources in conjunction with relevant departments, making comprehensive plans for water resources development and utilization, protection and water disaster prevention according to river basins or regions, and formulating long-term water resources supply and demand plans and water allocation plans;

(three) to organize the implementation of the water permit system and organize the collection of water resources fees;

(four) overall planning of urban and rural water resources, centralized management of water conservancy and township water supply in agricultural and pastoral areas;

(five) responsible for flood control and drought relief, water conservancy planning, soil and water conservation, fisheries and hydrology;

(six) the management of flood control, irrigation and water supply based hydropower generation and rural hydropower;

(seven) responsible for the management of water engineering construction;

(eight) responsible for the planning, regulation, construction, management and protection of river courses;

(nine) responsible for the introduction and promotion of advanced science and technology and management experience in the development and utilization of water resources and water conservation;

(ten) other duties as prescribed by laws and regulations. Eleventh water conservancy and water resources institutions established by the water administrative department at or above the county level and their water conservancy supervisors shall exercise the power of water conservancy supervision and management in accordance with the law within their respective jurisdictions.

The water administrative department of the autonomous region shall dispatch river basin management agencies in rivers or boundary rivers across states, cities and regions, and rivers or boundary rivers across counties (cities). River basin management institutions shall exercise water administrative functions and powers such as river management, water project management and water use management within their own basins. Chapter III Development and Utilization Article 12 In order to develop and utilize water resources and prevent water disasters, comprehensive scientific investigation, investigation and evaluation must be carried out, and on the basis of comprehensive scientific investigation, investigation and evaluation, unified planning should be made according to river basins or regions. Planning is divided into comprehensive planning and professional planning. Professional planning should be subject to comprehensive planning. Plans made by all localities should be coordinated with those made by superiors.

The comprehensive planning of the whole region, the major rivers determined by the autonomous region and the rivers across states, cities and regions shall be compiled by the water administrative department of the autonomous region jointly with relevant departments and relevant states, cities and regions, and submitted to the people's government of the autonomous region for approval, and reported to the water administrative department of the State Council for the record. State, city and district comprehensive planning and cross-county (city) river comprehensive planning shall be compiled by the state, city and district water administrative departments in conjunction with relevant departments and counties (cities) and reported to the people's government at the same level for approval, and reported to the water administrative department of the autonomous region for the record. County (city) comprehensive planning by the county (city) water administrative department in conjunction with the relevant departments, reported to the people's government at the same level for approval, and reported to the state, city and district water administrative departments for the record.

Professional planning shall be compiled by the relevant competent departments of the people's governments at or above the county level, and after comprehensive balance by the water administrative departments at the same level, it shall be reported to the people's governments at the same level for approval and reported to the water administrative departments at the next higher level for the record.

The approved plan is the basic basis for the development and utilization of water resources and the prevention and control of water disasters, and should be observed and implemented.
